Agenda 11/12/2024 Item #11C (Awarding Construction Invitation to Bid #24-8217R "Collier County Government Operations Business Park-Sheriff Forensics & CID Buildings" to Rycon Construction, Inc.)11/12/2024 Item # 11.C ID# 2024-1629 Executive Summary Recommendation to award Construction Invitation to Bid No. 24-8217R, “Collier County Government Operations Business Park–Sheriff Forensics & CID Buildings,” to Rycon Construction, Inc., in the amount of $51,935,473.50, with an Owner’s Allowance of $4,000,000 for potential unforeseen conditions, and authorize the Chairman to sign the attached Agreement and approve the necessary Budget Amendments. OBJECTIVE: To approve an Agreement for the construction of a Forensics/Evidence Facility for the Collier County Sheriff to be located off City Gate Boulevard. CONSIDERATIONS: The construction of a Forensics/Evidence Facility for the Collier County Sheriff is an authorized and validated Surtax project. As design proceeded, it became evident that the County should consider upsizing the facility by approximately 40,000 sq-ft to allow the Sheriff to completely relocate his Criminal Investigation Division, Youth Relations, and Patrol Administration from its current location at 2373 East Horseshoe Drive. This move will achieve operational consolidation and efficiencies while eliminating a facility constructed in 1989 with sub-optimal design characteristics and long-term capital maintenance concerns, including roofing, HVAC, building envelope, general moisture control, and energy efficiency. On May 1, 2019 (Agenda Item 8.B.2), the Infrastructure Surtax Citizen’s Oversight Committee validated funding of $33,000,000 for the Forensic and Evidence Facility (Project No. 70167). On January 11, 2022, the Board reviewed a status report on Infrastructure Sales Surtax projects and authorized design completion for the Sheriff’s Forensic Facility. The Board directed staff to upsize the Forensics Facility to relocate the Sheriff's Criminal Investigations Division (“CID”) and other Sheriff operations currently located at the Horseshoe Drive location. Collier County Facilities Management Division engaged design firm, Stantec Consulting Services, Inc., (“Stantec”), to provide the design of the new facility, an opinion of probable cost, and a construction bid schedule for the project. The Forensic/Evidence facility will include a two-story main building and a one-story vehicle storage building. On September 12, 2024 (Agenda Item 7.2), the Infrastructure Surtax Citizen’s Oversight Committee validated additional funding of $35,213,832.81 for the Forensic and Evidence Facility (Project No. 70167), authorizing a total project value of $68,213,832.81. The total project cost includes cost of land, design, construction, permitting fees, builders risk insurance, engineering and construction management services. On May 10, 2024, the Procurement Services Division issued Construction Invitation to Bid No. 24-8217R, Collier County Government Operations Business Park - Sheriff Forensics & CID Building. Rycon Construction, Inc., O-A- K/Florida, Inc. d/b/a Owen-Ames-Kimball Company, and H.A Contracting Corp. had minor irregularities. Staff determined that Rycon Construction, Inc. (“Rycon”) is the lowest responsive and responsible bidder. Stantec evaluated Rycon’s references and determined four out of five acceptable based on its experience with work of a Page 519 of 5419 11/12/2024 Item # 11.C ID# 2024-1629 similar magnitude performed within the last five years. A reference provided by Rycon concerning the construction of a building in Harrison County, West Virginia did not respond due to an ongoing dispute involving various issues concerning construction and dispute resolution efforts between the parties. On October 17, 2024, Facilities Division held a pre-award meeting with Rycon Construction confirming the County’s strategy for mitigating any potential risks associated with disputes associated with Rycon on prior projects. Facilities is recommending award and has provided the attached memorandum documenting its reasons for recommending the award not-withstanding at least issues on two recent out of state projects. Therefore, staff recommends the attached contract be awarded to Rycon Construction, Inc., the lowest responsive and responsible bidder for a total contract amount of $51,935,473.50. In addition to the total bid amount, staff has allocated $4,000,000 in Owner’s Allowance, for Owner’s use as directed. Rycon is a Florida corporation with offices in Fort Myers. It is an employee-owned firm established in 1989 with over $1.1 billion in annual revenue as of 2023 and operates in nine cities nationwide. Rycon has garnered industry recognition for their work, being ranked #167 and #111 on Engineering News Record’s (ENR) Top 400 Contractor’s List in 2023 and 2024 and was named 2022’s MidAtlantic Contractor of the Year by the same industry publication. Rycon is currently the general contractor working on Collier County's Fire and EMS Station 74 project, a $9 million essential services project. Over the last several months, Rycon has consistently demonstrated professionalism, adhered to the project schedule, and maintained a positive working relationship with County staff. Their performance thus far has given us no reason to doubt their capabilities or commitment to executing projects to the expected standards. The Owner’s Allowance of $4,000,000 is for unanticipated costs including, but not limited to, unforeseen site conditions that might be encountered during construction, and will also be included in the Purchase Order. Use of the allowance will be only as directed by the County, if necessary, and subject to the Procurement Ordinance, as amended and proper documentation involved with any work authorized and performed under the allowance. FISCAL IMPACT: Funding for this agreement and the associated owners' allowance, totaling $55,935,473.50, is available within Infrastructure Sales Tax (3018) Reserves. The total validated project budget for the Forensics/Evidence Facility is $68,213,832.81. This budget includes the original allocation of $33,000,000 validated on May 1, 2019, along with an additional 35,213,832.81, comprised of surplus surtax collections and interest earnings, validated on September 12, 2024. To date, $5 million of the validated amount has been appropriated within Infrastructure Sales Tax Fund (3018), Govt Ops Business Park, Project 70167. A budget amendment is necessary to allocate the remaining validated funding, in the amount of $63,213,832.81, from reserves to Govt Ops Business Park, Project No. 70167 within the Infrastructure Sales Tax Fund (3018). GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with this Executive Summary. LEGAL CONSIDERATIONS: As part of Stantec’s October 3, 2024, Design Engineer’s Letter of Recommended Award, it noted that it was able to contact four of the five references submitted by Rycon. The fifth reference, on which it was unable to receive feedback, concerned the construction of a General Services Building in Harrison County, West Virginia. Online news articles from 2023 reported that there were construction delays, cost increases, and various mechanical and equipment issues on that West Virginia project. However, fault could not be definitively attributed to the contractor based upon available information. Although not submitted as a reference on this particular solicitation, it should also be noted that a recent construction project for the Brimfield Fire Department & Township Administration Building in Kent, Ohio, also failed to be completed on time and within budget by Rycon as reported in a County Vendor Reference Check Log earlier this summer. Additional details are unavailable but it was reported to staff that a dispute resolution process is pending. Staff has submitted a memorandum supporting its reasons for recommending that the award be made to Rycon, whose base bid is $1,644,909.91 dollars lower than the second lowest bidder. Staff also has some existing experience with Rycon on the EMS Station 74 project, which they report has been favorable so far. Considering the importance and dollar amount of this construction project, County project management staff need to take a proactive approach to insure that the work stays on schedule and that construction is undertaken in conformance with the terms and conditions of the design plans and the Agreement if the Board awards this project to Rycon. Their performance thus far has given us no reason to doubt their capabilities or commitment to executing our project to the expected standards. Cost Savings: Rycon’s bid for the Sheriff’s Office Forensics and Evidence Storage Building is significantly lower than the next qualified bid, a difference of $1.6 million. This cost advantage, combined with Rycon’s satisfactory performance on a similar ongoing County project, makes their proposal attractive from both a fiscal and performance standpoint. Recommendations: We recommend awarding the contract to Rycon Construction, contingent upon a pre- award meeting where our project team will have the ability to gain clarity on the contractor’s project team and ensure Rycon is fully prepared and committed to the project’s timeline and requirements. The pre-award meeting will also provide an opportunity for Rycon to confirm their strategy for mitigating any potential risks associated with the disputes referenced in the past. The scope of the Collier County Government Operations Business Park – Sheriff Forensics & CID Buildings project includes a new Collier County Forensics & CID building. It will be constructed to meet the ever grow need of the Sheriff’s department. The new two-story facility will include a crime scene investigation lab, supporting office spaces and processing garage bays on level one. Additionally, the evidence bureau which includes processing area and supporting office area, long term storage, short term storage, fire-arm storage, narcotics storage and ammo storage areas. On the second level the criminal investigation department offices and administrative support spaces. To the north of the Two -story main building will the long-term evidence vehicle storage area. The building will be Pre-engineered Metal building structure used to storage evidence vehicle and controlled temperature environment. General mechanical, electrical and plumbing rooms will be required in this building. Collier County Procurement’s review of the bid tabulations determined that the apparent low bidder is Rycon Construction, Inc with a bid of $51,935,473.50. Stantec Consulting Services Inc. was provided with the bid Schedule for Rycon Construction, Inc. Rycon Construction, Inc bid is approximately 8.83% higher than the Engineer’s Opinion of Probable Construction Cost (OPC) of $47,722,317.62. A total of five references were provided, and the completed Vendor Reference Check Logs for four out of the five references are attached hereto. One reference was non-responsive, and it has been documented. The project references provided by Rycon Construction, Inc. were all contacted, Stantec Consulting Services, Inc determined the references contain sufficient relevant experience with similar projects to demonstrate the required successful experience to complete the project. The bid was initially advertised for forty-five (45) days, with the due date extended two (2) times for a total of twenty-eight (28) additional days. The County received four (4) bids by the July 22, 2024, deadline. Staff reviewed the four (4) bids received and all four (4) were deemed responsive and responsible. Rycon Construction, Inc. O-A-K/Florida, Inc. d.b.a. Owen-Ames-Kimball Company, and H.A Contracting Corp. had minor irregularities. Staff determined that Rycon Construction, Inc. is the lowest responsive and responsible bidder.
