A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
ACCEPTING COUNTY MAINTENANCE
RESPONSIBILITIES FOR A SIDEWALK EASEMENT,
AUTHORIZING FINAL ACCEPTANCE OF CERTAIN
ROADWAY AND DRAINAGE IMPROVEMENTS AND
PLAT DEDICATIONS IN FOUNDERS SQUARE,
ACCORDING TO THE PLAT THEREOF RECORDED IN
PLAT BOOK 67, PAGES 9 THROUGH 12, AND RELEASE
OF THE MAINTENANCE SECURITY.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
December 10, 2019, approved the plat of Founders Square for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and drainage
improvements in accordance with the approved plans and specifications as required by the Land
Development Code (Collier County Ordinance No. 04-41, as amended); and
WHEREAS, a sidewalk easement (SWE), on Founders Square, Tract H-2, according to the plat
thereof recorded in Plat Book 67, Pages 9-12, in the public records of Collier County, Florida,
were dedicated to the County with the responsibility for maintenance in plat dedication
paragraph 5.D; and
WHEREAS, the County seeks to formally accept maintenance responsibilities for that
sidewalk easement (SWE) on Founders Square, Tract H-2, according to dedication paragraph
5.D., on the plat thereof recorded in Plat Book 67, Pages 9-12, in the public records of Collier
County, Florida; and
WHEREAS, the Developer is requesting final acceptance of the roadway and drainage
improvements and release of the maintenance security; and
WHEREAS, the Development Review Division has inspected the roadway and drainage
improvements, and is recommending acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby
granted for those roadway and drainage improvements and plat dedications in Founders Square,
pursuant to the plat thereof recorded in Plat Book 67, pages 9 through 12, and the Clerk is hereby
authorized to release the maintenance security.
BE IT FURTHER RESOLVED AND ORDERED that the roadway and drainage
improvements within Founders Square, except for the sidewalk easement on Tract H-2 pursuant
to plat dedication paragraph 5.D., will be maintained privately in the future and will not be the
responsibility of Collier County. Collier County will maintain a sidewalk easement(SWE) over a

portion of the northeast corner of Tract H-2, which was dedicated on the plat to the County with
responsibility for maintenance in dedication paragraph 5.D.
This Resolution adopted after motion, second and majority vote favoring same, this
224A day of OcTo6E2 2024.
