RESOLUTION NO. 2024-OI
A RESOLUTION OF THE CONTRACTORS' LICENSING
BOARD OF COLLIER COUNTY, FLORIDA, DECLARING
AN EMERGENCY SHORTAGE OF CERTAIN
DESIGNATED CONTRACTOR TYPES, AUTHORIZING
ADMINISTRATIVE APPROVAL OF COUNTY LICENSES
FOR THOSE DESIGNATED CONTRACTOR TYPES
MEETING SUBSTANTIALLY COMPARABLE CRITERIA;
AND APPROVING CERTAIN PROVISIONAL LICENSES
ISSUANCE.
WHEREAS, on October 7th,2024, the Collier County Board of County Commissioners
declared a state of emergency throughout Collier County, Florida under Resolution No. 2024-
192, respectively, pursuant to the statutory authority afforded by Chapter 252,Florida Statutes;
and
WHEREAS, the Code of Laws and Ordinances of Collier County in Section 22-190,
provides that in the event of a such declaration of a state of emergency in Collier County by the
board of county commissioners in which substantial damage has occurred to buildings and
structures so as to cause a shortage of available persons in the contracting trades for which there
are Collier County/city certificates of competency, the contractors' licensing board is then
authorized to declare an emergency contracting trade shortage of designated categories of
contractors and/or subcontractors for a period of time not to exceed six months; and to authorize
the contractor licensing supervisor to prepare and regulate the selection of contractors and/or
subcontractors from other predetermined jurisdictions whose licensing requirements are
substantially comparable to those licensed in the county; and
WHEREAS, a current shortage of qualified locally licensed or registered contractors of
various specialties and types may be needed to repair the substantial damage caused by the
effects of Hurricane Milton; and
WHEREAS, in order to meet the emergency needs of the general public to provide
access to property, remove dangerous debris, prevent further harm to property, or to begin
repairs to such property, certain contractors who would have otherwise substantially complied
with the County's testing and licensing requirements and were also able to demonstrate adequate
insurance protection for themselves and their customers have been issued provisional licenses
pursuant to the powers set forth in Florida Statutes Sec.252.38 (3Xa) 5.a. & d., and Collier
County Resolution No.2024-192, the contractors' licensing board now desires to verify and
validate those provisional licenses already issued.

NOW THEREFORE BE IT RE,SOLVED BY THE CONTRACTOR LICENSING
BOARD OF COLLIER COUNTY, FLORIDA, meeting in a duly noticed session on this l6th
day of October, 2024, that because the effects of Hurricane Milton may cause substantial damage
to occur to buildings and structures posing a serious threat to the property of the residents and
guests of Collier County, and that because a State of Local Emergency has been declared and is
presently in effect:
an emergency contracting trade shortage of the following categories of contractors
and/or subcontractors is now declared to exist for a period of time not to exceed six
months:
a. To be determined by the Contractor Licensing Supervisor.
the County's contractor licensing supervisor is now authorized to accept, review, and
administratively approve properly submitted applications for the above-designated
categories of contractors and/or subcontractors so long as those contractors and/or
subcontractors are able to adequately demonstrate current licensure in those
jurisdictions whose testing and licensing requirements are substantially comparable to
those required by the County, including providing proof of proper and adequate
insurance; and

WHEREAS, on October 7. 2024, the Board of County Comrnissioners of Collier
County, Florida adopted Proclarnatior/Resolution No. 2024-190 to Declare a State of Ernergency
for all territory within the legal boundaries of Collier County including all incorporated and
unincorporated areas; and
WHEREAS, Proclamation/Resolution No. 2024-190 was adopted under the authority of
Chapter 252.38(3)(a)(5), l7a. ,S/(r/., and Collier County Ordinance Nos. 84-37, 2001 -45,2002-50,
2007-49,2011-34,2017-38. and 2018-37 (codified in Sections 38-56 through 3S-72 in the
Collier County Code of Larvs arrd Ordinances) pr:oviding lbr a political subdivision such as
Collier County to declare a state of local elrergency and to waive procedures and fbrmalities
otherwise required of political subdivisions by law; and
WHEREAS, I.lurricane Milton may cause extensive darnage to public utilities. public
buildings, public comtnunications systems, public streets and roads, public drainage systems,
commercial and residcntial building areas, as well as private property and private roads
throughout Collier Cor.rnty; and
WHEIIBAS, the removal of debris fiom or adjacent to public or private roads throughout
Collier County is in the public interest in order to lessen or eliminate immediate threats of
significant damage to improved property and threats to life, public health and safety;
NOW THEREFORE, IT IS ITESOLVED BY THE BOARD OF COUNTY

'l-he removal ol'debris lrom or adjacent to public and private roads throughout
Collier County is hereby declared to be in the public interest and necessary to
elinrinate or lessen imniediate threats to lifb. public health and safbty and to
eliminate irnrnediate threats of significant darnage to improved property; and
Debris from areas ad.iacent to or on public and private roads, including gated
communities, may be removed by Collier County or its contractors provided the
following procedures are followed:
a. Debris fiom areas adjacent to private roads must be placed on or at the private
street orprivate road right of way. Access on to the private properties will not
be allowed.
b. Communities adjacent to private roads must allow unlimited access fbr and
during debris removal operations.
c. l'here must be unrestricted access during debris removal operations and the
private road is to be subject to normal public services such as school bus and
postal i,ehiclc routes.
d. Debris nray also be removed lrorn mobile home parks provided that access to
the park is made by norrnal public services such as school bus and postal
vchicle routes.
e. Nevertheless, debris resulting from demolition of mobile hornes,
mauufactured homes, residential buildings or colnlnercial buildings that is
"pushed out" to the right of way will not be cligible fbr removal operations ol'
Collier County or its contractors.
