10/22/2024 Item # 16.A.17 ID# 2024-854 Executive Summary Recommendation to approve the release of a code enforcement lien with an accrued value of $96,400, for a reduced payment of $894.20, in the code enforcement action titled Board of County Commissioners vs. Luis Rios Centeno, relating to property leased at 301 Fillmore St., Collier County, Florida. OBJECTIVE: To have the Board of County Commissioners (Board) consider accepting an offer to release a code enforcement lien with an accrued value of $96,400, for payment of $894.20, in relation to Code Enforcement Special Magistrate Case No. CESD20190004631. CONSIDERATIONS: As a result of a code violation on the property leased at Southwind Village Manufactured Home Community (301 Fillmore St.), the Special Magistrate ordered the imposition of a lien against Luis Rios Centeno in Case No. CESD20190004631. The violation consisted of additions or alterations to a mobile home and a shed without obtaining the required Collier County permits. The lien was recorded on April 5, 2021, at O.R. Book 5920, Page 3899, for the mobile home only, in the amount of $68,259.70. Fines continued to accrue; therefore the lien amount of $96,400 is based on 482 days of accrued fines ($200 per day from March 20, 2020, through July 16, 2021), totaling $96,400. The property was brought into compliance on July 16, 2021. Pursuant to Resolution No. 2023-90, a request for reduction of fines may be considered, in part, when a lien encumbers property under new ownership, and the new owner has diligently pursued abatement and achieved compliance and/or when payment of the lien would impose a severe financial hardship on the owner. Due to several extenuating life circumstances, including the birth of a child and the COVID-19 pandemic, it took a substantial amount of time, commitment, and resources to achieve compliance. Since the property that has the lien is not real property, staff recommends that the reduction of the lien be based on 10% of the National Automobile Dealers Association (NADA) estimated value of $8,942 for his 1974 single-wide mobile home as he does not own the real property the trailer sits on. Mr. Centano offers to pay $894.20, which meets the spirit of Resolution 2023-90. There are no known violations at this time. FISCAL IMPACT: Acceptance of payment of $894.20 to settle the lien will correlate to what is outlined in Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2023-90. RTT RECOMMENDATIONS: To approve the recommended reduction of fines in the amount of $95,505.80, accept payment amount of $894.20, release the liens, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records.
