Amendment
Recommendation to direct the County Attorney to advertise and bring
back for public hearing an amendment to Ordinance 2023-71 to (1)
remove roadways that are now in a passable condition; (2) add unpaved
private roadways; and (3) establish an opt -out provision.

MSTU should encompass all private unpaved roadways that are not included in HOA's, Special
Districts, etc.
Roads to be repaired to and maintained at a passable condition for emergency vehicle access.
Opt -Out Provision — Property Owners abutting/accessing MSTU designated roadways may
opt -out if the roadway is(1) currently maintained, (2) has sustainable maintenance plan,
and (3) is not expected to need maintenance within the next five years.

Next Steps — If Advertised &
Subsequently Approved
• Establish an Advisory Committee composed of First Responders.
• Finalize ❑pt-Out Application and publish on Public Transit & Neighborhood Enhancement MSTU website.
• Hold at least one Advisory Committee meeting to review submitted Opt -Out Applications.
• Finalize properties (bona fide opt -outs excluded) and transmit to Collier County Property Appraiser prior ❑ecember 31, 2024 deadline.
• Prepare a bid for the 16.366 miles of roadways deemed impassable.
• Prior to or concurrent with bid award, estimated FY 2026 taxable values and revenues at 1.0000 mil to be provided to the Board.
• Monitor level of effort necessary for MSTU Project Management to determine if additional staff and resources are necessary.
• Future year process:
• Advisory Committee will present a list of roads needing maintenance to remain passable to the MSTU Project Manager.
• Advisory Committee will rank the roadways (worst first).
• MSTU Project Manager will develop a budget for the roadways based on the anticipated revenues generated by the MSTU to be
presented via the Board's annual budget process.
