REQUESTED ACTION:
The petitioner requests a 213-foot boat dock extension from the maximum permitted protrusion of
20 feet allowed by Section 5.03.06 of the Collier County Land Development Code (LDC) for
waterways greater than 100 feet in width to allow for the replacement of an existing boardwalk
with a new boardwalk that will include kayak storage, paddle-craft launch, and covered gazebo,
protruding a total of 233 feet into a waterway that is 1,524 feet wide.
GEOGRAPHIC LOCATION:
The subject site is located on the west side of Vanderbilt Drive, approximately one mile north of
Wiggins Pass Road at 377 Bay Forest Drive, in Section 8, Township 48 South, Range 25 East,
Collier County, Florida. (See location map on the following page)
PURPOSE/DESCRIPTION OF PROJECT:
The project is located within the 124-acre Bay Forest Planned Unit Development (PUD) with 697
residential units, per Ordinance 81-07, As Amended. The petitioner desires to replace a 238-foot
wooden fishing pier, approved by CCPC Resolution 93-14, that was damaged by Hurricane Ian.
The proposed boardwalk will protrude 233 feet from the MHWL and incorporate a gazebo, kayak
storage inside the walkway railings, and a paddle-craft launch. Said boardwalk is located within
the Wiggins Pass Estuarine Area on a man-altered waterway that is approximately 1,524 feet wide.
Said waterway is unmarked and there are no impacts to normal navigation that don’t already exist;
additionally, there are no docks in the immediate vicinity. Staff notes that a boardwalk and gazebo
are permitted uses in the Bay Forest Preserve Area per section .09 of the PUD.

ENVIRONMENTAL EVALUATION:
Environmental Planning Staff has reviewed this petition and has no objection to the granting of
this request. The proposed six-foot wide boardwalk replaces an existing boardwalk to be
constructed through native vegetation containing wetlands (0.25 Acres). A Florida Department of
Environmental Protection (FDEP) permit and US Army Corps of Engineers (USACE) permit will
need to be approved for the proposed kayak launch. State and Federal permissions have been
granted to rebuild the walkway. A submerged resources survey provided by the applicant indicates
there are areas of seagrasses (paddle grass, Halophila decipiens) found within 200 feet of the
proposed boardwalk; however, no impacts to submerged resources will occur. The location of the
boardwalk will be setback greater than 10 feet per LDC section 5.03.06.J (Exhibit page 10 of 10).
This project does not require an Environmental Advisory Council Board (EAC) review, because
this project did not meet the EAC scope of land development project reviews as identified in
Chapter 2, Article VIII, Division 23, Section 2-1193 of the Collier County Code of Laws and
Ordinances.
STAFF ANALYSIS:

In accordance with LDC Section 5.03.06.H., the Collier County Hearing Examiner shall approve,
approve with conditions, or deny a dock facility extension request based on certain criteria. In
order for the Hearing Examiner to approve this request, at least four of the five primary criteria
and four of the six secondary criteria must be met:
Primary Criteria:
1. Whether the number of dock facilities and/or boat slips proposed is appropriate in
relation to the waterfront length, location, upland land use and zoning of the subject
property. Consideration should be made of property on unbridged barrier islands,
where vessels are the primary means of transportation to and from the property.
(The number should be appropriate; typical single-family use should be no more than
two slips; typical multi-family use should be one slip per dwelling unit; in the case of
unbridged barrier island docks, additional slips may be appropriate.)
Criterion met. The applicant’s agent states: “The proposed structure replaces an existing
pier that has been in place since the early 1990s based on historical review. There are no
motorized vessels proposed, only a launch for paddle craft. The extension of the facility
was done to provide recreational opportunities for the residents of Bay Forest. The
extension allows for launching paddle craft, fishing, enjoying wildlife, and viewing
sunsets. In order to accommodate the new proposed paddle craft launch, the dock is being
shortened by approximately 20 feet from its current extension. The dock provides access
to and enjoyment of the water for all the residents of Bay Forest.” Staff concurs and further
notes that this is a private facility with no public access and that there are no real side or
riparian setback issues at the subject location.
2. Whether the water depth at the proposed site is so shallow that a vessel of the general
length, type, and draft as that described in the petitioner’s application is unable to
launch or moor at mean low tide (MLT). (The petitioner’s application and survey
should establish that the water depth is too shallow to allow launching and mooring
of the vessel(s) described without an extension.)
Criterion met. The applicant’s agent states: “The water depths immediately waterward of
the mangroves are very shallow. Also, since one of the purposes of the walkway is to
provide fishing opportunities to the residents, the extension is out into water depths that
are more supportive for fishing than the shallow waters immediately adjacent to the
mangroves. The depths further out also provide adequate depth for the proposed floating
launch.” Staff tends to concur; however, note that the subject facility was not designed for
the mooring of standard marine vessels but rather for non-motorized kayaks and canoes.
3. Whether the proposed dock facility may have an adverse impact on navigation within
an adjacent marked or charted navigable channel. (The facility should not intrude
into any marked or charted navigable channel, thus impeding vessel traffic in the
channel.)
Criterion met. The applicant’s agent states: “The walkway and deck do not interfere with
any marked or charted navigational channel. This facility has been in place for several

decades without any impact to navigation, and the proposed amendment will actually
reduce the protrusion by approximately 20 feet.” Staff concurs; however, they note that, as
submitted, the protrusion is being reduced by 5 feet but could be more depending on where
the measurement was taken from in the 1990s.
4.Whether the proposed dock facility protrudes no more than 25 percent of the width
of the waterway and whether a minimum of 50 percent of the waterway width
between dock facilities on either side is maintained for navigability. (The facility
should maintain the required percentages.)
Criterion met. The applicant’s agent states: “The facility does not protrude more than 25%
the width of the waterway, which is approximately 1,524 feet, and with the proposed
amendment, will protrude about 20 feet less than the existing facility. As proposed, the
facility will protrude 15% of the waterway width.” Staff concurs and further notes that
there are no dock facilities on the opposite shore.
5.Whether the proposed location and design of the dock facility is such that the facility
would not interfere with the use of neighboring docks. (The facility should not
interfere with the use of legally permitted neighboring docks.)
Criterion met. The applicant’s agent states: “There are no neighboring docks, and with the
conservation easements on the adjacent properties, none are expected in the future. The
facility has not interfered with any docking in the past and will not do so in the future.”
Staff concurs.
Secondary Criteria:
1.Whether there are special conditions not involving water depth related to the subject
property or waterway which justify the proposed dimensions and location of the
proposed dock facility. (There must be at least one special condition related to the
property; these may include type of shoreline reinforcement, shoreline configuration,
mangrove growth, or seagrass beds.)
Criterion met. The applicant’s agent states: “The shoreline is a natural mangrove fringing
forest, and the proposed extension of the facility locates the fishing and launching activities
well waterward of the shallow shoreline and mangroves. The site also has existing walkway
permits, which have been in place for several decades. The proposed facility is a
replacement of the existing facility. The facility's location with conservation areas all
around it also allows for the extension, which has been in place to avoid interfering with
any neighboring property uses.” Staff concurs.
2.Whether the proposed dock facility would allow reasonable, safe access to the vessel
for loading/unloading and routine maintenance, without the use of excessive deck
area not directly related to these functions. (The facility should not use excessive deck
area.

Criterion met. The applicant’s agent states: “The addition of the paddle craft launch
provides a safer means of launching and recovering the vessels than is currently available.
The walkway, launch, and end pavilion are all the minimum dimensions to allow for the
safe use of them by residents.” Staff concurs and further finds that there is no excessive
decking.
3.For single-family dock facilities, whether the length of the vessel or vessels in
combination described by the petitioner exceeds 50 percent of the subject property’s
linear waterfront footage. (The applicable maximum percentage should be
maintained.)
Criterion is not applicable. This petition is for a private multi-family boat docking facility,
and no motorized vessels will be allowed at the facility.
4.Whether the proposed facility would have a major impact on the waterfront view of
neighboring property owners. (The facility should not have a major impact on the
view of a neighboring property owner.)
Criterion met. The applicant’s agent states: “The waterfront view of the neighboring
properties will not appreciably change. The facility includes a new paddle craft launch, but
the launch is below the decking elevation that has been in place for decades and will not
increase any view restriction.” Staff concurs.
5.Whether seagrass beds will be impacted by the proposed dock facility. (If seagrass
beds are present, compliance with subsection 5.03.06.J of the LDC must be
demonstrated.)
Criterion met. The applicant’s agent states: “There are numerous beds of seagrass present
within the subject bay area; however, no impacts are proposed, nor will the proposed
structure be within 10 feet of the observed seagrass beds.” Staff concurs.
6.Whether the proposed dock facility is subject to the manatee protection requirements
of subsection 5.03.06(E)(11) of this Code. (If applicable, compliance with section
5.03.06(E)(11) must be demonstrated.)
Criterion is not applicable. The applicant’s agent states: “This facility is not subject to the
Manatee Protection Plan.” Staff concurs, finding that there are zero slips for use by
motorized vessels.
In accordance with LDC Section 5.03.06.F., the Collier County Hearing Examiner shall approve,
approve with conditions, or deny a Boathouse request based on certain criteria. Boathouses,
including any roofed structure built on a dock, shall be reviewed by the Hearing Examiner
according to the following criteria, all of which must be met in order for the Hearing Examiner to
approve the request.
Boathouse Criteria:

1.Minimum side setback requirement: Fifteen Feet.
Criterion met: The nearest applicable side or riparian line is greater than 15 feet from
either side of the subject gazebo/boathouse and boardwalk, kayak launch facility.
2.Maximum protrusion into waterway: Twenty-five percent of canal width or 20 feet,
whichever is less. The roof alone may overhang no more than 3 feet into the waterway
beyond the maximum protrusion and/or side setbacks.
Criterion met: Subject to approval of the Boat Dock Extension element of this petition,
which will extend the point of maximum protrusion to 233 feet from the Mean High Water
Line. As per Sheet 08 of the provided plans, the roof overhang alone will not protrude
greater than 3 feet beyond the maximum protrusion of 233 feet.
3.Maximum height: Fifteen feet as measured from the top of the seawall or bank,
whichever is more restrictive, to the peak or highest elevation of the roof.
Criterion met: The proposed gazebo/boathouse will measure not exceeding 15 feet above
the top of the boardwalk/dock facility.
4.Maximum number of boathouses or covered structures per site: One.
Criterion met. There are no other like facilities located on this site.
5.All boathouses and covered structures shall be completely open on all four sides.
Criterion met. The facility will be open on all four sides.
6.Roofing material and roof color shall be the same as materials and colors used on the
principal structure or may be of a palm frond “chickee” style. A single -family
dwelling unit must be constructed on the subject lot prior to, or simultaneously with,
the construction of any boathouse or covered dock structure.
Criterion met. As per Sheet 08 of the provided plans, the roofing material will be of a
chickee style or match that of the upland clubhouse.
7.The boathouse or covered structure must be so located as to minimize the impact on
the view of the adjacent neighbors to the greatest extent practical.
Criterion met. The subject facility is isolated within a forested preserve area and will not
affect any neighbor’s view.
Staff analysis finds this request complies with five of the five primary criteria and four of the six
secondary criteria, with the third and sixth criteria not being applicable. The boathouse/gazebo
complies with all 7 of the listed boathouse criteria.

APPEAL OF BOAT DOCK EXTENSION:
As to any boat dock extension petition upon which the Hearing Examiner takes action, an
aggrieved petitioner may appeal such final action. Such appeal shall be filed per Section 2 -88 of
the Collier County Code of Ordinances within 30 days of the Decision by the Hearing Examiner.
An aggrieved non-party may appeal a decision of the Hearing Examiner to the Circuit Court of
Collier County within 30 days of the decision. In the event that the petition has been approved by
the Hearing Examiner, the applicant shall be advised that he/she proceeds with construction at
his/her own risk during this 30-day period. Any construction work completed ahead of the approval
authorization shall be at their own risk.
STAFF RECOMMENDATION:
Based on the above findings, Staff recommends that the Hearing Examiner approve Petition BD-
PL20230014603, in accordance with the plans contained within Attachment A with the following
condition:
1.Motorized vessels are prohibited from using the subject Boardwalk as a docking facility.

DOCK EXTENSION PRIMARY CRITERIA
The following criteria, pursuant to LDC section 5.03.06, shall be used as a guide by staff in
determining its recommendation to the Office of the Hearing Examiner. The Hearing Examiner will utilize
the following criteria as a guide in the decision to approve or deny a particular Dock Extension request.
In order for the Hearing Examiner to approve the request, it must be determined that at least 4 of
the 5 primary criteria, and at least 4 of the 6 secondary criteria, must be met. On separate sheets,
please provide a narrative response to the listed criteria and/or questions.
1.Whether or not the number of dock facilities and/or boat slips proposed is appropriate in relation to the
waterfront length, location, upland land use, and zoning of the subject property; consideration should be
made of property on unbridged barrier islands, where vessels are the primary means of transportation to
and from the property.
(The number should be appropriate; typical, single-family use should be no more than two slips; typical
multi-family use should be one slip per dwelling unit; in the case of unbridged barrier island docks,
additional slips may be appropriate.)
2.Whether or not the water depth at the proposed site is so shallow that a vessel of the general length, type,
and draft as that described in the petitioner’s application is unable to launch or moor at mean low tide
(MLT). (The petitioner’s application and survey should show that the water depth is too shallow to allow
launch and mooring of the vessel(s) described without an extension.)
3.Whether or not the proposed dock facility may have an adverse impact on navigation within an
adjacent marked or charted navigable channel. (The facility should not intrude into any marked or
charted navigable channel thus impeding vessel traffic in the channel.)
4.Whether or not the proposed dock facility protrudes no more than 25% of the width of the waterway,
and whether or not a minimum of 50% of the waterway width between dock facilities on either side of
the waterway is maintained for navigability. (The facility should maintain the required percentages.)
5.Whether or not the proposed location and design of the dock facility is such that the facility would not
interfere with the use of neighboring docks. (The facility should not interfere with the use of legally permitted

BOATHOUSE CRITERIA
The following criteria, pursuant to LDC section 5.03.06 F, shall be used as a guide by staff in
determining its recommendation to the decision maker. The decision maker will utilize the following
criteria as a guide in the decision to approve or deny a particular Boathouse request. In order for the
request to be approved, all of the criteria must be met. On separate sheets, please provide a
narrative response to the listed criteria and/or questions.
DOCK EXTENSION SECONDARY CRITERIA
1.Whether or not there are special conditions, not involving water depth, related to the subject property or
waterway, which justify the proposed dimensions and location of the proposed dock facility. (There must be at
least one special condition related to the property; these may include type of shoreline reinforcement, shoreline
configuration, mangrove growth, or seagrass beds.)
2.Whether the proposed dock facility would allow reasonable, safe, access to the vessel for loading/
unloading and routine maintenance, without the use of excessive deck area not directly related to these
functions. (The facility should not use excessive deck area.)
3.For single-family dock facilities, whether or not the length of the vessel, or vessels in combination, described by
the petitioner exceeds 50 percent of the subject property’s linear waterfront footage.(The applicable maximum
percentage should be maintained.)

Narrative Description: The proposed Boat Dock Extension is to remove and replace a wooden
boardwalk that was damaged due to Hurricane Ian with associated covered gazebo for a multi-
family residential property located at 377 Bay Forest Dr. The boardwalk provides kayak storage
and paddle craft launch all on a man-altered waterway and considered to be part of Wiggins
Pass Estuarine Area which is a mix of state lands and non-state lands due to historical dredge
and fill operations. The subject property has a vegetated shoreline which is also where the mean
high-water line (MHWL) is located therefore the MHWL is considered the most restrictive
point.
The proposed boardwalk requires a BDE as the proposed walkway will include modifications
to the terminal structure, kayak storage along the walkway, and the addition of the paddle craft
launch. As proposed the entire boardwalk area allows for recreational activities, associated
storage, and routine maintenance activities without excessive decking. The walkway will be in
the same footprint as the existing damaged boardwalk but will be shortened by 20-feet from the
existing overall protrusion. The changes proposed result in an increase of approximately 1,870
square feet of boardwalk for kayak storage inside of the walkway railings as opposed to the
external storage previously in place, and approximately 258 square feet of additional overwater
structure associated with the paddle craft launch. The overall dock protrusion will be
approximately 233-feet from the MHWL. Therefore, the applicant is requesting a 213-foot
extension over the allowed 20-feet into a waterway that is approximately 1,524-feet wide. Based
off that the boardwalk as proposed would protrude approximately 15% into the subject
waterway. The subject waterway is an unmarked waterway and no impacts to normal
navigation of the subject waterway will result from this boardwalk being constructed.
Additionally, the ingress/egress to the proposed boardwalk will not interfere with
navigation/access as there are no immediate adjacent docks in the area.
There are both mangroves and submerged resources that are within 200-feet of the proposed
boardwalk. The only impact to the mangroves consists of lateral branch trimming to maintain
access for the boardwalk and a 10-foot offset will be provided for the observed seagrasses.

Primary Criteria:
a. Whether the number of dock facilities and/or boat slips proposed is appropriate in
relation to the waterfront length, location, upland land use, and zoning of the
subject property. Consideration should be made of property on unbridged barrier

property. (The number should be appropriate; typical, single-family use should be

The subject structure is the replacement of an existing pier that has been in
place since the early 1990’s based off historical review. There are no
motorized vessels proposed, only a launch for paddle craft. The extension of
the facility was done to provide recreational opportunities for the residents
of Bay Forest. The extension allows for launching of paddle craft, fishing,
and enjoyment of wildlife and sunset viewing. In order to accommodate the
new proposed paddle craft launch, the dock is being shortened by
approximately 20 feet from its current extension. The dock provides access
and enjoyment of the water to all the residents of Bay Forest.
Criterion Met
b. Whether the water depth at the proposed site is so shallow that a vessel of the
general length, type, and draft as that described in the petitioner's application is
unable to launch or moor at mean low tide (MLT). (The petitioner's application and
survey should establish that the water depth is too shallow to allow launching and
mooring of the vessel(s) described without an extension).
The water depths immediately waterward of the mangroves are very shallow.
Also, since one of the purposes of the walkway is to provide fishing
opportunities to the residents, the extension is out into water depths that are
more supporting for fishing than the shallow waters immediately adjacent to
the mangroves. The depths further out also provide adequate depths for the
proposed floating launch.
Criterion Met

c. Whether the proposed dock facility may have an adverse impact on navigation

The walkway and deck do not interfere with any marked or charted
navigational channel. This facility has been in place for several decades
without any impact to navigation and the proposed amendment will actually
reduce the protrusion by approximately 20 feet.
Criterion Met
d. Whether the proposed dock facility protrudes no more than 25 percent of the width
of the waterway, and whether a minimum of 50% of the waterway width
between dock facilities on either side of the waterway is maintained for
navigability. (The facility should maintain the required percentages).
The facility does not protrude more than 25% the width of the waterway
which is approximately 1,524 and with the proposed amendment will
protrude about 20 feet less than the existing facility. As proposed, the
facility will protrude 15% of the width.
Criterion Met
e. Whether the proposed location and design of the dock facility is such that the
facility would not interfere with the use of neighboring docks . (The facility should
not interfere with the use of legally permitted neighboring docks ).
There are no neighboring docks, and with the conservation easements on
the adjacent properties, none are expected in the future. The facility has not
interfered with any docking in the past and will not do so into the future.

Secondary criteria:

subject property or waterway, which justify the proposed dimensions and location
of the proposed dock facility. (There must be at least 1 special condition related to
the property; these may include type of shoreline reinforcement, shoreline
configuration, mangrove growth, or seagrass beds).
The shoreline is natural mangrove fringing forest, and the proposed
extension of the facility locates the fishing and launching activities well
waterward of the shallow shoreline and mangroves. The site also has
existing walkway permits which have been in place for several decades. The
proposed facility is a replacement of the existing facility. The location of the
facility with conservation areas all around it also allows for the extension,
which has been in place to avoid interfering with any neighboring property
uses.
Criterion Met
b. Whether the proposed dock facility would allow reasonable, safe access to the
vessel for loading and/or unloading and routine maintenance, without the use of
excessive deck area not directly related to these functions. (The facility should not
use excessive deck area).
The addition of the paddle craft launch provides a safer means of launching
and recovering the vessels than is currently available. The walkway, launch,
and end pavilion are all the minimum dimensions to allow for the safe use of
them by the residents.
Criterion Met
c. For single-family dock facilities, whether the length of the vessel, or vessels in
combination, described by the petitioner exceeds 50 percent of the subject
property's linear waterfront footage. (The applicable maximum percentage should
be maintained).

There are no motorized vessels allowed at the facility so they do not exceed
50% of the waterfrontage. The docking facility is for a multi-family residential
private, non-commercial condominium and therefore this criterion is not
applicable.
d. Whether the proposed facility would have a major impact on the waterfront view of
neighboring waterfront property owners. (The facility should not have a major
impact on the view of a neighboring property owner).
The waterfront view of the neighboring properties will not appreciably
change. The facility includes a new paddle craft launch but the launch is
below the decking elevation that has been in place for decades and will not
increase any view restriction. Additionally, the overall length of the facility
will be about 20 feet shorter.
Criterion Met
e. Whether seagrass beds are located within 200 feet of the proposed dock facility.
(If seagrass beds are present, compliance with subsection 5.03.06(H)(2). of this
LDC must be demonstrated).
There are numerous beds of seagrass present within the subject bay area
however no impacts are proposed, nor will the proposed structure be within
10-feet of the observed seagrass beds.
Criterion Met
f. Whether the proposed dock facility is subject to the manatee protection
requirements of subsection 5.03.06(E)(11) of this LDC. (If applicable, compliance
with section 5.03.06(E)(11) must be demonstrated).
This facility is not subject to the Manatee Protection Plan.

1 INTRODUCTION
Turrell, Hall & Associates, Inc. (THA) has been contracted to provide environmental permitting
and engineering services and as part of the permitting process an onsite Submerged Resource
Survey (SRS) was completed as required to provide planning assistance to both the property
owner and regulating agencies. The subject property is located at 377 Bay Forest Drive Naples,
Florida 34110 that can be identified by folio #22971800003.
The subject property consists of a multi-family community located in North Naples on the
southern end of Little Hickory Bay which is classified with the State of Florida as an Outstanding
Florida Waterway (OFW) which connects directly to the Gulf of Mexico through Wiggins Pass
just to the south. The project under review is the reconstruction of an existing boardwalk and
associated gazebo which was damaged during Hurricane Ian as well as the addition of a small
floating kayak launch. The boardwalk is currently being rebuilt within the existing footprint
except for the addition of a small kayak launch and modification of the terminal gazebo footprint.
A new Boat Dock Extension (BDE) is being requested to authorize the amended gazebo footprint
and new kayak float/launch.
The objective of an SRS is to identify and locate any existing protected submerged resources (i.e.,
seagrasses or oyster beds) within a project site boundary extending out 200 feet as required by
the Collier County Land Development Code (LDC). Ordinarily, if seagrasses are present within
the vicinity of a project area, an analysis will be required regarding species, percent cover, and if
any impacts are projected within 10-feet of the project footprint. The presence of seagrasses can
potentially drive re-configuration of a design to either eliminate or minimize impacts to those
resources.

2 METHODOLOGY
THA biologists design the methodology of the submerged resource survey (SRS) to cover not
only the entire project footprint but also to cover the adjacent area within 200 ft. of the proposed
site as required by the Collier County LDC. Survey methodology followed includes:
• Reviewing aerial photography of the surveyed area and mapping of known aquatic
resources within the subject waterway before the survey.
• Establishing survey transect lines (spaced approximately 10-20 feet apart) overlaid onto
aerials. (See attached Exhibits)
• Physically swimming the transects, GPS locating the limits of any resources identified,
documenting the substrate conditions, and determining the percent coverage of any
resources within the survey area.
• Documenting and photographing all findings.
The surveyed area was evaluated systematically by following the established transect lines
throughout the project site as shown on the attached exhibit. The existing boardwalk pilings and
structure provided reference markers which helped to maintain correct positioning over each
transect as the shoreline only consists of mangroves with no other structural reference points in
the bay.
During this SRS, one THA staff member swam the transect lines using snorkel equipment while
a second remained on the kayak taking notes and compiling findings on an aerial of the project
site. Aquatic resources found during the survey were mapped with a GPS along with pertinent
information regarding the species, size, abundance, etc. General species size was determined by
measuring several of the observed species in each bed and documenting the data. Upon
completion of the survey, all data was immediately scanned, downloaded, and unknown taxa
were identified using office reference material (list in Appendix II).
Field equipment included snorkel gear, a hand-held GPS, an aerial map, a ruler, a dive slate,
camera equipment (x2- Cannon Powershot SX230 HS and housing) and a one (1) meter square
quadrat which was further broken down into sections for better coverage identification.
The report contains the following information and the description:
• Date and time of day (start and finish).
• Names of diver(s) conducting survey.
• Temperature, ambient weather conditions, water clarity and tide conditions.
• Total water depth and depth of transects.
• General sediment type (e.g., silt, mud, sand, shell, etc.).

Depths increased gradually and sporadically throughout the entire bay with distance from the
shoreline out into the waterway and then got shallower working towards the marked channel
and then again on the other side of the waterway working your way up to the mangrove
shoreline. Water depths varied from approximately 1 to 4 feet.
During the survey, there were several areas where seagrass beds were observed, all throughout
the entire bay as indicated on the attached SRS map. The beds were low in density in most areas
ranging from 1-25% coverage all in and around the existing boardwalk. The observed seagrass
species was paddle grass (Halophila decipiens) which is a common resource in our waterways and
is ephemeral in nature meaning the exact location and densities can vary on a weekly to monthly
basis mostly dependent on overall water quality and growing conditions. Green macro algae
(Caulerpa spp.) was also observed interspersed with the shoal grass. Additionally, a red-boring
sponge (Cliona celata) was observed growing on the substrate, also indicating an overall good
water quality. A list of all species observed can be seen below in Table 2
Paddle grass varied in height from 2 to 4.5 cm, while the Caulerpa varied from 3 to 6 cm. Grasses
had a moderate amount of sediment on the leaves and epiphytic cover was also present.
Seagrasses appeared to be in a good healthy state at the time of the survey. Water clarity was
higher than normal for this waterway. Paddle grass presence and density can vary widely within

these waterways, dictated in large part by water quality, clarity, rainfall and salinity levels. We
generally observe higher concentrations of paddle grass early in the growing season with
densities dropping over the rainy season as water chemistry and conditions change with rainfall
and runoff.

4 CONCLUSION
The Collier County Manatee Protection Plan (MPP) requires that any docking facility or structure
maintain at least a 10-foot setback from, or impact more than 100 square feet of seagrasses to
qualify for “no impacts”. The boardwalk and gazebo are existing structures which are not subject
to the MPP as it is not a docking structure and prohibits any motorized craft from mooring on it.
Nevertheless, the project has tried to stay consistent with the provisions of the MPP and avoid
any new impacts to the greatest extent possible.
During the inspection one type of seagrass was observed adjacent to and within the 200-foot
surveyed area ranging from the mangrove fringe, around the existing structure and extending
out into the bay. The observed seagrass was paddle grass (Halophila decipiens) with green algae
(Caulerpa spp.) also scattered throughout. A few areas of red-boring sponge (Cliona celata) were
also noted.
As proposed, the majority of the proposed project is the repair and reconstruction of the existing
boardwalk all within the current permitted footprint. The existing boardwalk currently ramps
down at the terminus to allow for kayak launching off of the gazebo outer edge. The
reconstruction proposed will elevate the terminus end of the boardwalk and gazebo to a
consistent height with the rest of the walkway. The higher elevation will allow for more light
penetration under the edges of the boardwalk than currently occurs. The proposed project also
will redesign the gazebo to a rounder footprint which also reduces potential shading impacts.
The proposed project will also install a new kayak floating launch with an access ramp to allow
for safer and more secure launching of kayaks off the side of the walkway, rather than at the end.
The redesigned gazebo and kayak launch have been located in areas to avoid observed seagrass
concentrations and stay consistent with the MPP provisions, even though they should not apply
to this structure. To compensate for the additional structure associated with the kayak launce, the
overall protrusion of the structure from the MHW line has been reduced so that the total
overwater structure proposed is the same square footage as what is currently approved. As
designed and based off the most recent seagrass survey of the area, there will not be any new
impacts associated with the proposed modified footprint.

the construction of the boardwalk. Joe H. made a motion and Joe B seconded the motion
to approve $4,038,616.00 to be collected from the sub-associations to replace the
boardwalk that was destroyed during Hurricane Ian. Sixty percent of the revenue will be
due on October 6, 2023, and the balance due March 29, 2024. All in favor motion
