Agenda 09/10/2024 Item #16F7 (To ratify Change Order No. 8, adding ten days to the Substantial Completion date and utilizing $42,329.74 of the Owner's Allowance for required additional work)16.F.7 09/ 10/2024 EXECUTIVE SUMMARY Recommendation to ratify Change Order No. 8, adding ten days to the Substantial Completion date and utilizing $42,329.74 of the Owner's Allowance for Purchase Order No. 4500229878, under Agreement No. 21- 7883-ST with O-A-K/Florida, Inc., d/b/a Owen -Ames -Kimball Company, for the Main Campus Upgrades, and authorize the Chairman to sign the attached Change Orders. (Project No. 50214) OBJECTIVE: To ratify Change Order No. 8, adding ten days to the Substantial Completion date and utilizing $42,329.74 of the Owner's Allowance for required additional work. CONSIDERATIONS: On May 10, 2022 (Agenda Item No. 16.C.4), the County entered into Construction Manager At Risk (" CMAR") Agreement No. 21-7883-ST (the "Agreement") with the Construction Manager to manage and coordinate the construction of the Main Campus Upgrades, which include the surtax approved New Chiller Plant Building and the Underground Chilled Water Mains. On January 9, 2024 (Agenda Item I LG), the Parties entered into a First Amendment to the Agreement (the "First Amendment") to include the Construction Phase scope, provide for a total Guaranteed Maximum Price ("GMP") to be paid to the Construction Manager in the amount of Seventeen Million Six Hundred Forty -Eight Thousand Six Hundred and Eighty -Nine Dollars and Ninety -Seven Cents ($17,648,689.97), and establish the Contract Time for the Work. On June 25, 2024 (Agenda Item 161.1), the Board approved the Second Amendment to the Agreement to conform the insurance requirements in Exhibits E-l(1) and E-2(1) to the Guaranteed Maximum Price and associated schedule of values with no increase in cost or time under the Agreement, and ratify and authorize any payments related to work performed by subcontractor Nauti Electric, Inc. Staff's request to ratify Change Order No. 8 will add ten days to the Substantial Completion date and utilize $42,329.74 of the Owner's Allowance for Work Directive No. 3, 4, 6, 7, and 9, leaving a balance of $421,236. These Work Directives involve additional underground work, construction work associated with design changes to the roof area, hardware continuity, and additional safety measures necessary for the project. Work Directive No. 9, in the amount of $16,250.40, includes five days and the purchase and installation of the new Collier County logo on the Thermal Energy Storage (TES) tank. This change is because the preferred method for logo application (paint or adhered graphic) could not be determined during the GMP solicitation, and the new logo design had not yet been finalized. This item is consistent with the Infrastructure, and Asset Management, and Quality of Place elements of the Collier County Strategic Plan. The County's Procurement Services Division administratively approved Change Order No. 8, as authorized under the Procurement Ordinance, Section Nineteen, Contract Administration, Section 19, subsection 3. b. Including Change Order 8, there have been eight change orders as provided in the table below. The Guaranteed Maximum Price for the project is unchanged. The project is funded by the Infrastructure Sales Tax Fund (3018), Main Campus Upgrades, Project 50214. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT GROWTH MANAGEMENT IMPACT: This action has no impact on the Growth Management Plan. We have attached the roof access hatch product specifications that indicate the opening is 36" by 30". Detail 2 on sheet Al51 shows the stairs leading up to the roof access hatch. Detail 3 on sheet A521 indicates for the stairs to terminate 8" below top of roof hatch curb. We have concerns with available space for personnel to climb up the stairs and access through the roof hatch. The width of the opening will be 30". We also want to confirm that there are no clearance concerns with personnel walking up the steps and hitting their head on the underside of the concrete hollow core planks. Please confirm clearance and confirm that the ladder safety up post is not required, as this will only work with a vertical ladder 180 degrees, Roof hatch curb height is 12" above concrete deck. This can be built up with wood blocking if need be. Please advise. All insurance shall be from responsible companies duly authorized to do business E in the State of Florida and/or responsible risk retention group insurance companies registered with the State of Florida. Construction Manager shall carry professional liability insurance in an amount not less than $1,000,000, but only if the Contract Documents and Project require the Construction Manager to provide professional architectural, design or engineering services to Owner. Construction Manager shall ensure that all subcontractors comply with the same insurance requirements that it is required to meet. (8) Construction Manager shall submit within twenty-four (24) hours to Owner and Design Professional a copy of all accident reports arising out of any injuries to its employees or those of any firm or individual to whom it may have subcontracted a portion of the Work, or any personal injuries or property damages arising or alleged to have arisen on account of any work by Construction Manager under the Contract Documents. (9) The Owner shall be exempt from, and in no way liable for, any sums of money that may represent a deductible in any insurance policy except deductibles as agreed to by the Owner in obtaining Builder's Risk xi Property Insurance. Key Personnel 27 10-26 Q K-1 127025798.5 Packet Pg. 1697 1 6.F.7.b ARTICLE 2 GUARANTEED MAXIMUM PRICE 2.1 Construction Contractor's Guaranteed Maximum Price ("GMP") for the Work, including the estimated Cost of the Work as defined in Section 5 of the Agreement and Construction Contractor's Fee as defined in Section 4 of the Agreement, is seventeen million, six hundred forty-eight thousand, six hundred eighty-nine dollars and ninety-seven cents ($17,648,689.97). 2.2 Omitted. 2.3 The Construction Contractor's Fee for the entire Work anticipated on this Project is hereby established as a lump sum amount of eight hundred forty thousand, four hundred thirteen dollars and eighty-one cents ($840,413.81), said lump sum amount is included within the above noted GMP. 2.4 The General Condition expenses for the entire Work anticipated on this Project are a, hereby established as a lump sum amount of one million, one hundred fifty-eight thousand, eight hundred dollars ($1,158,800.00), said lump sum amount is included within the above noted v GMP. Construction Contractor shall not proceed with any portion of the Work associated with the aforesaid allowance ("Allowance Work") without first obtaining Owner's express written authorization to proceed with the said Allowance Work. Allowance Amounts are reflected in Attachment 8. 2.8 Omitted 2.9 Construction Contractor recognizes that this Contract includes work for trench excavation in excess of five feet deep. Construction Contractor acknowledges the requirements set forth in Section 553.63 of the Florida Statutes titled Trench Safety Act. Construction Contractor certifies that the required trench safety standards will be in effect during the period of construction of the Project and Construction Contractor agrees to comply with all such required trench safety standards. 2.9.1 The amount of seven hundred fifty dollars ($750) has been separately identified for the cost of compliance with the required trench safety standards; said amount is included within the GMP. ARTICLE 3 x i CONTRACT TIMELO W 3.1 The Construction Phase Commencement Date for the Work will begin upon issuance of a Notice to Proceed (NTP). The total period of time beginning with the Construction Phase Commencement Date through the date required for Substantial Completion of the Work is four hundred twenty-five (425) days ("Contract Time"). 3.2 Pursuant to this Agreement, the parties have established a liquidated damage rate for reasons stated therein, which the parties acknowledge and agree apply to this Amendment and Construction Contractor's responsibility to complete the Work within the Contract Time as stated herein.
