Due to the abundance of protected floral and faunal species within Picayune Strand, Tim created an Environmental Protection Plan (EPP), an educational program and video for every contractor who entered the worksite, conducted training seminars for those workers, assessed wildlife nesting and utilization during construction to make changes to routes temporarily as needed, provided annual reporting to U.S. Fish & Wildlife, and oversaw all environmental permit conditions. Blasting and watch plans were created and permitted with state and federal wildlife agencies to allow for the creation of a Manatee Mitigation Feature adjacent to the Faka-Union Canal, which would experience a change in freshwater inputs as a result of rehydrating Picayune Strand to the north. 2022-Current: Naples City Pier Rebuild (Collier County, FL) - The City Pier has been the most recognized landmark in Collier County for nearly 100 years. In 2022 the aging pier was destroyed by Hurricane Ian and Turrell, Hall & Associates were selected to oversee its redesign, engineering and permitting. Tim is leading the permitting process to expand the existing footprint of the historical pier based on public comment. The current land use is a multi -family (condominium) residential development with 60 dwelling units, an accessory pool and spa, and an accessory private marina with 44 boat slips, which were constructed in +1984 per the Collier County Property Appraiser's records. The proposed project consists of: (a) replacing the existing seawall along 625 linear feet of shoreline on Vanderbilt Lagoon; (b) modernizing and reconfiguring the existing docks to accommodate full length finger piers and install 44 boatlifts; and (3) reconfiguring the existing pool and spa within the same general area as exists currently, but in a manner that will increase the setback from the East and North sides of the Condominium Property. These structures are legally non -conforming and exist on subject property today. The proposed alterations will not increase the density or alter the existing land uses of the subject property. The applicant just wants to modernize its facilities with approval from Collier County. NUA Criteria Evaluation Criteria • The alteration, expansion, or replacement will not exceed the building height requirements of the district most closely associated with the subject nonconforming use; The proposed project is to modernize the existing docks, shoreline, and upland pool/spa layout. The proposed. project will not result in any height increases. • The alteration, expansion, or replacement will not further encroach upon any nonconforming setback; The proposed modernization of the docks and shoreline will maintain the existing setbacks being 04eet on the SE .riparian line and 54eet from the NW riparian line. As to the proposed reconfigured. pool and spa, setbacks will be increased on the East and North sides of the Condominium Property. No further encroachments are proposed. • The alteration, expansion, or replacement will not decrease or further decrease the existing parking areas for the structure; No, there will not be a decrease in parking areas as a result of the proposed n rniPrt BDE Criteria Primary Criteria • Appropriate slip #? Yes. The subject property is zoned as C-3 and is a legally non- conforming a multi -family residential condominium with 60 livable units and 44 boat slips. The current configuration and slip number has existed in its current state since the late 1980s. Collier County's LDC recommends no more than 1 slip per dwelling unit for typical multi -family uses. The current use at this location equals less than 1 slip per dwelling unit. • Water depths at the site? Satisfied. The proposed boat dock is to modernize the existing facility by extending the existing finger pier with new boatlifts to extend out to sufficient water depths. This will allow the proper perpendicular mooring keeping the deepest drafting part of the boats out in deeper water. • Impact on navigation? No. No marked or navigable channels will be affected. Approved by FDEP and USACE. • Protrusion of more than 25% waterway width? 50% of waterway retained? Satisfied on the bayside of the subject property. Not satisfied on the canal side towards the terminus end, but not encroaching beyond the existing pilings. • Interference with neighboring docks? No. The proposed facility does not expand upon the maximum protrusion (existing). BDE Criteria Secondary Criteria • Special Conditions? Yes. Existing facility that pre -dates BDE process. Proposed changes are minimal and predominantly occur within existing footprint. No way to reconfigure and accommodate the new sea wall without a. BDE/NUA. • Excessive Decking? No. Satisfied.. A reduction in the total decking square footage is proposed. Proposed dock allows reasonable, safe access to vessels without excessive deck area. • For single-family dock facilities - Length of vessels > 50% of shoreline? N/A. The subject property is currently being used for multi -family residential purpose. • Major impact on views? No. The proposed project site's use and number of slips will not be changing as part of this project. The project will have a net reduction in overall decking square footage. And the overall extent of change for the project site versus the existing structure will be minimal at no more than 2 feet. The proposed project will not result in a major impact the neighbors' views. • Impacts to seagrasses? No. There are no seagrass beds present within 200' of the property nor the neighboring properties. • Compliance with MPP? Criterion Met. Facility was existing prior to 1995, when the MPP requirement was adopted and is considered a "grandfathered" facility.
