Agenda 08/27/2024 Item #16C 4 (Agreement No. 24-036-NS with Fluid Control Specialties, LLC (“FCS”))08/27/2024 EXECUTIVE SUMMARY Recommendation to approve Agreement No. 24-036-NS with Fluid Control Specialties, LLC (“FCS”), and authorize expenditures from FCS as a single source provider of standardized specialized proprietary equipment and services with an estimated $250,000 annual spending on Rotork Controls, Inc., products/services, and an estimated $100,000 annual spending on Rosemount Inc., measurement and analytical products/services for a five-year period, and authorize the Chairman to sign the attached Agreement. OBJECTIVE: To continue consistency with the reliable products, equipment, and services that are standardized and utilized at the critical infrastructure, water plants, wastewater plants, and wastewater collection system for staff to provide continuous operations and maintenance of those critical facilities. CONSIDERATIONS: On September 26, 2023 (Agenda Item 16.C), the Board approved a group of exemption from the competitive process waivers, including one for FCS for Fiscal Year 2024 only, with direction that Staff seek formal agreements with the various venders. Subject to Board approval, this Agenda item will establish the negotiated Agreement with FCS. The County has invested over one million dollars on Rosemount Inc. (“Rosemount”) and Rotork Controls, Inc. (“Rotork”) equipment. Rotork valve actuators are connected to the Collier County Supervisory Control and Data Acquisition System. The Rotork actuators provide protection for equipment that may be located where the surrounding atmosphere may produce an explosive gas or dust mixture are located in an area of potential flooding. Those devices are highly technical, requiring investment in infrastructure, systems, spare parts, and training. The Rosemount equipment, which includes Rosemount Analytical, Emerson, AMS TREX, and Micromotion products, services and Equipment, is used to measure pressure, flow, temperature, and liquid levels in the treatment and distribution of water, wastewater, and reclaimed water. The County has been procuring the Rotork and Rosemount equipment/services through FCS for over twenty years through prior Board approved Waivers. Further, on July 10, 2018 (Agenda Item 17.D and 17.E), the Board approved the recommended standardized items in the Utilities Standards Manual for installation at Master Pump Stations, Submaster Pump Stations, and Wastewater/Water Treatment Facilities, and included a County Approved Products List as Appendix F in the Board approved Collier County Water-Sewer District Utility Standards Manual under Ordinance No. 2018-36. The approved listed includes these specialized proprietary Rotork and Rosemount equipment and services from FCS. In accordance with Section Eleven, Subparagraph 11, of the Collier County Procurement Ordinance 2017 -08, as amended, staff requests that the Board find that it is in the best interest of the County to purchase Rotork valve actuators, replacement parts and repair services and Rosemount analytical measurement equipment and services from Rosemount to meet the Water and Wastewater operational needs on a single source basis from FCS, and that the Board approve attached Agreement No. 24-036-NS with Fluid Controls Specialties, LLC. Procurement Services Division posted a public notice of the County’s intent to designate Fluid Control Specialties as a single source to the vendor community through OpenGov for seven days and did not receive any responses. FISCAL IMPACT: Funds are available in the Collier County Water-Sewer District Operating Fund (4008) and the Wastewater User Fee Fund (4014). As the utility system ages, the quantity of materials purchased will vary depending on the actual repair/replacement needs. GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. These valve actuators are connected to the Collier County’s (the County) Supervisory Control and Data Acquisition (SCADA) System. The actuator provides protection for equipment that may be located where the surrounding atmosphere may produce an explosive gas or dust mixture or located in an area of potential flooding. Historical spend was compiled since FY 2006 and includes the purchases of Rosemount products which are being authorized by a separate waiver request. County staff estimated that the historic spend for Rotork products is approximately $970,000 and the remainder is for Rosemount products. To ensure that Collier County Water and Wastewater Divisions comply with all applicable, State and Federal codes, laws, regulations, standards, policies and operating permits. Multiple Rotork valve actuators products are installed throughout the Water, Wastewater, and IQ distribution systems. These valve actuators are connected to the Collier County’s (the County) Supervisory Control and Data Acquisition (SCADA) System. The devices are highly technical, requiring investment in infrastructure, systems, spare parts, and training. The performance and reliability of this equipment has been above industry standards. The benefits of these actuators include a doub le-sealed enclosure, non-intrusive infra-red commissioning, datalogging, and predictive maintenance capabilities. The actuator features p rovide protection levels required for equipment that may be located where the surrounding atmosphere may produce an explosive gas or dust mixture or located in an area of potential flooding. These actuators are cost-effective to operate and maintain, and meet the h ighest standards for property loss prevention and safety. To switch products to a different vendor would require redesign, training staff, new integration into the SCADA system, significant downtime and risk of health and safety to the community. As the equipment listed is the most suitable and cost-effective for our individual application, a side-by-side competitive bid is not practical as other units would not be a direct fit to our current system. Additional costs to prepare multiple designs would be required. The additional capital cost of utilizing other units is estimated to be $1-2 million. To ensure that Collier County Water and Wastewater Divisions comply with all applicable, State and Federal codes, laws, regulations, standards, policies and operating permits. In many cases, the SCADA and operational systems were designed around these specific devices. Switching to other manufactures could cause compatibility or interface problems, piping, and wiring modifications, potentially costing the County millions. These products have been proven reliable to withstand the harsh environment they are in. Maintaining the current investment is in the best interest of the County. To switch products to a different vendor would require redesign, training staff, new integration into the SCADA system, significant downtime and risk of health and safety to the community. As the equipment listed is the most suitable and cost-effective for our individual application, a side-by-side competitive bid is not practical as other units would not be a direct fit to our current system. Additional costs to prepare multiple designs would be required. The additional capital cost of utilizing other units is estimated to be $1-2 million.
