CESM Minutes 07/12/2024 July 12, 2024 1 MINUTES OF THE HEARING OF THE COLLIER COUNTY SPECIAL MAGISTRATE Naples, Florida, July 12, 2024 LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the following persons present: SPECIAL MAGISTRATE: Honorable Patrick H. Neale ALSO PRESENT: Thomas Iandimarino, Code Enforcement Director Jeff Letourneau, Manager of Inspectors Helen Buchillon, Code Enforcement Specialist July 12, 2024 2 Any person who decides to appeal a decision of the Special Magistrate will need a record of the proceedings pertaining thereto, and therefore may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. Neither Collier County nor the Special Magistrate shall be responsible for providing this record. I. CALL TO ORDER-SPECIAL MAGISTRATE PATRICK H. NEALE PRESIDING The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those testifying at the proceeding did so under oath. II. Pledge of Allegiance The Pledge of Allegiance was recited. Prior to conducting the Hearing, Respondents were given an opportunity to speak with their Investigating Officers for a Resolution by Stipulation. MOTION FOR EXTENSION OF TIME OF COMPLIANCE DEADLINE 1. CASE NO: CESD20220009434 OWNER: William J Snider OFFICER: Delicia Pulse VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e), and 10.02.06(B)(1)(e)(i). Deck installed, screen enclosure removed and replaced with sliders. All these improvements and alterations require Collier County Building Permits. FOLIO NO: 24220001687 PROPERTY 2084 Pine Isle Ln #2084, Naples, FL 34112 Mr. Snider testified there were 2 violations associated with the case and he abated one by removing the patio. The sliding doors were installed over 20 years ago before he purchased the property, and he had difficulty locating an architect or engineer to process the permit given it was a small job. He has now engaged a consultant and requested a 120-day Extension of time to abate the violation. Officer Pulse represented the County and had no objection to the request. Special Magistrate Neale GRANTED and Extension of Time of Compliance Deadline until the November 1, 2024 hearing date. 2. CASE NO: CEROW20220001483 OWNER: WEJ JR LLC OFFICER: Bradley Holmes VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 110, Article II, Sections 110-31(a) and 110-32. Unpermitted fencing and electric powered/gate installed within Collier County Right of-Way (within drainage swale) and over Hickory Wood Drive blocking access to Hickory Wood Drive section on the Western side of Logan Blvd N. FOLIO NO: 41820480005 PROPERTY ADDRESS: 5405 Hickory Wood Dr, Naples, FL 34119 William E. Jones, Jr. was present represented by his attorney Zachary Lombardo. Officer Holmes represented the County. Mr. Lombardo reported they are working with the County on a Right-of-Way vacancy which is taking longer than anticipated. He requested a 90-day Extension of Time of Compliance Deadline to finalize the agreement. Officer Holmes had no objection to the request. Special Magistrate Neale GRANTED the Motion for an Extension of Time of Compliance Deadline until the October 4, 2024 hearing date. 3. CASE NO: CESD20220007518 July 12, 2024 4 OWNER: Harry Seaman III and Loren B Seaman OFFICER: Donald Joseph VIOLATIONS: Collier County Land Development Code 04-41, as amended, 10.02.06(B)(1)(a) and 10.02.06(B)(1)(e)(i). Built a chickee hut on top of a deck without a required Collier County permit. FOLIO NO: 1057280005 PROPERTY ADDRESS: 307 Pettit Dr, Goodland, FL 34140 Zach Lombardo, Attorney represented the Respondent requesting a 90 Extension of Time of Compliance Deadline as the permits have been granted for demolition of the chickee hut. Officer Joseph represented the County and had no objection to the request. Special Magistrate Neale GRANTED the Motion for an Extension of Time of Compliance Deadline to the October 4, 2024 hearing date. 4. CASE NO: CENA20180012429 OWNER: Angelo Lucarelli and Gail Lucarelli OFFICER: Adam Collier VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-185(d). Prohibited exotic vegetation including, but not limited to, Brazilian Pepper and Melaleuca trees on an unimproved parcel not zoned Estates or Agricultural, within 200 feet of improved property. FOLIO NO: 163080006 PROPERTY ADDRESS: NO SITE ADDRESS Zach Lombardo, Attorney represented the Respondent testifying he recently became in involved with the case and noted:  The Respondent could not comply with the original stipulation to abate the violation because it turned out platforming would be required for the machinery, or manual removal of the species which became cost prohibitive.  An application to develop the property has been filed and requires County and South Florida Water Management District approvals.  Corrections letters have been issued for the applications and the consultants are working on addressing the items.  He requested an Extension of the Time of Compliance and ceasing of the fines accruing as the amount owed is now approximately 75 percent of the property value. Officer Collier represented the County and objected to a stay in the fines accruing. Special Magistrate Neale noted the case has been going on since 2018 without resolution and CONTINUED the case until the October 4, 2024 Special Magistrate hearing with fines continuing to accrue. C. MOTION FOR REHEARING None VI. STIPULATIONS 1. CASE NO: CESTVR20240000530 OWNER: Bouyancy, LLC OFFICER: Charles Marinos July 12, 2024 5 VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections 2.02.03 and 5.02.03(J), and the Collier County Code of Laws and Ordinances, Article X, Sections 26-384(1), 26-384(2) and 26-384(4). An improved Estates zoned property being utilized for short term vacation rentals with multiple rooms being rented to multiple, unrelated parties at the same time in a manner similar to a hotel which is not an allowable usage on site. Additionally, the short-term rental(s) are being done without the required Collier County Registration/Approval, which includes, but is not limited to: Valid Florida D.B.P.R Licensure, a Collier County Business Tax Receipt, and an approved Short Term Rental Registration Form FOLIO NO: 45960240004 PROPERTY ADDRESS: 2225 23rd St SW, Naples, FL 34117 Date of Notice of Hearing by Certified Mail: 6/18/24 Date of Property/Courthouse Posting: 6/19/24 Kristin Jasinski of Buoyancy, LLC and Morgan Hila, Attorney were represented the Respondent. Officer Marinos requested the hearing. The Stipulation was entered into by Kristin Jasinski on July 12, 2024. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.75 incurred in the prosecution of this case within 30 days of this hearing. 2. Cease the individual room rental activity and renting to no more than four (4) unrelated individuals within 30 days of this hearing or a fine of $200.00 per day will be imposed until the violation has been abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. Total Amount Due: $111.75 VIII. NEW BUSINESS B. MOTION FOR IMPOSITION OF FINES AND LIENS 10. CASE NO: CEVR20230000832 OWNER: EDISON VILLAGE PROPERTY OWNERS ASSOCIATION INC CO REGIONS CORP REAL ESTATE OFFICER: Jason Packard VIOLATIONS: Collier County Land Development Code 04-41, as amended, Section 3.05.07(H)(1)(g)(ii). Area designated as Preserve are for Edison Village PUD contains prohibited exotic plant species, including but not limited to Earleaf Acacia and Brazilian Pepper. FOLIO NO: 30806000025, 30806000041, 30806000067. PROPERTY ADDRESS: NO SITE ADDRESS, Naples, FL 34113 Robert Cousins and Michael Tompkins represented the Respondent. Officer Packard represented the County. Mr. Cousins testified:  The case evolved due to a Notice issue as the property has changed hands at least 2 times since 2011 and the appraiser’s office has not updated ownership of the preserve parcel. July 12, 2024 6  The notices were sent to the prior owners until the County determined the appropriates agents through Sunbiz.  They are the most recent owners and when they were informed of the violation they took immediate action to rectify the situation.  He requested the prior Order be vacated and the fines be waived Officer Packard had no objection to the request. Special Magistrate Neale, after hearing the testimony and reviewing the factors of the case Granted the County’s Motion for Imposition of Fines and Liens in the amount of $111.80 (the Operational Costs for today’s hearing). VI. STIPULATIONS 3. CASE NO: CEROW20220008103 OWNER: Enea Pezzotti, Jana Koliskova and Pezt CO USA LLC OFFICER: Cristina Perez VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 110 Article II, Section 110- 31(a). Altered Right of Way (ROW) and removed grass, being used as driveway. FOLIO NO: 37229680009 PROPERTY ADDRESS: 661 8th St SE, Naples, FL 34117 Supervisor Perez requested the hearing. The Stipulation was entered into by Enea Pezzotti on July 10, 2024. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing. 2. Obtain all required Collier County Right-of-Way permits, Inspections and Certificate of Compliance or restore the right-of-way to an originally permitted condition within 90 days of this hearing or a fine of $150.00 per day will be imposed until the violation has been abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. CASE NO: CEPM20230008345 OWNER: Phillip T McKee OFFICER: Jeff Ethridge VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Section 22- 231(15). Un-maintained pool with black pool water in a residential pool. FOLIO NO: 29381400009 PROPERTY ADDRESS: 9500 Campbell Cir, Naples, FL 34109 Date of Notice of Hearing by Certified Mail: 6/13/24 Date of Property/Courthouse Posting: 6/13/24 Supervisor Ambach requested the hearing. The Stipulation was entered into by Harris Leidy on July 12, 2024. July 12, 2024 7 Discussion occurred noting Ms. Leidy is Mr. McKee’s caregiver and assisted him in signing the document however a County official did not witness the signature. Special Magistrate Neale requested a witnessed signature be obtained for the Stipulation. Special Magistrate Neale CONTINUED the case until the August 2024 Special Magistrate hearing date. 9. CASE NO: CESD20240002779 OWNER: Sondra Bablitz OFFICER: Adam Collier VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e), and 10.02.06(B)(1)(e)(i). Unpermitted wall build back after repairs in the unit bathroom wall. FOLIO NO: 79621280007 PROPERTY ADDRESS: 1 Bluebill Ave Unit 311, Naples, FL 34108 Date of Notice of Hearing by Certified Mail: 6/13/24 Date of Property/Courthouse Posting: 6/17/24 Officer Collier requested the hearing. The Stipulation was entered into by Sondra Bablitz on July 12, 2024. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing. 2. Obtain all required Collier County Building Permit(s), or Demolition Permits, Inspections and Certificate of Completion/Occupancy for the unpermitted wall built within 180 days of this hearing or a fine of $200.00 per day will be imposed until the violation has been abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. Un-permitted altered electrical improvement removed prior to obtaining an electrical demolition permit. FOLIO NO: 38501160000 PROPERTY ADDRESS: 41 33rd Ave NE, Naples, FL 34120 Date of Notice of Hearing by Certified Mail: 6/18/24 Date of Property/Courthouse Posting: 6/19/24 Officer Cooper requested the hearing. The Stipulation was entered into by Fernando Perez and Mercedes Alonso on July 11, 2024. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: July 12, 2024 8 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing. 2. Obtain all required Demolition Permits, Inspections and Certificate of Completion/Occupancy for the removal of unpermitted electrical work within 60 days of this hearing or a fine of $100.00 per day will be imposed until the violation has been abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. FOLIO NO: 39661920008 PROPERTY ADDRESS: NO SITE ADDRESS Date of Notice of Hearing by Certified Mail: 6/13/24 Date of Property/Courthouse Posting: 6/13/24 Officer Cooper requested the hearing. The Stipulation was entered into by Johanna Dominquez on July 11, 2024. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing. 2. Cease the unauthorized storage of the shipping containers on the unimproved property which is not a permitted accessory or conditional use in this zoning district without an approved use within 90 days of this hearing or a fine of $100.00 per day will be imposed until the violation has been abated. 3. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the Respondent fails to abate the violation the County may abate the violation and may use the assistance of the Collier County Sheriff’s Office to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property owner. CASE NO: CEV20230007055 OWNER: Greg Bee and Jane Bee OFFICER: Donald Joseph VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 130, Article III, Section 130-95. Inoperable and unregistered recreational vehicle improperly stored on the property. FOLIO NO: 1134801909 July 12, 2024 9 PROPERTY ADDRESS: 560 Webb Rd, Copeland, FL 34137 Officer Joseph represented the County noting the violation has not been abated amassing fines and costs in the amount of $2,011.75. Jane and Gregg Bee were present and testified they are almost finished abating the violation. Special Magistrate Neale CONTINUED the case until the August Special Magistrate hearing date with fines ceasing to accrue. 13. CASE NO: CENA20230006263 OWNER: Mary I Wiggin and John Joseph Wiggin OFFICER: Bradley Holmes VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Sections 54-179, 54-181 and 54-185(a), and the Collier County Land Development Code 04-41, as amended, Section 2.02.03. Litter and/or prohibited outdoor storage including but not limited to: yard tools, buckets, plastic containers, and wood scattered throughout the property. Also weed/grass in excess of 18 inches on the property. FOLIO NO: 35780000007 PROPERTY ADDRESS: 2190 41st Terr SW, Naples, FL 34116 John Joseph Wiggin was present. Officer Holmes represented the County testifying the violation has been abated. Special Magistrate Order: No. 6357 Page: 737 Fine Amount: $100.00/day Duration: 6 days Total Fine Amount: $600.00 Unpaid Operational Costs: $111.85 Total to Date: $711.85 Special Magistrate Neale, after reviewing the factors in the case, GRANTED the County’s Motion for Imposition of Fines and Liens in the amount of $211.85 ($100.00 in fines and $111.85 in Operational Costs). Said amount to be paid within 30 days and become a lien on the property. VII. PUBLIC HEARINGS A. HEARINGS 20. CASE NO: CEEX20240005432-DAS-V24-020244 OWNER: Tim Rushing OFFICER: Hope Ress VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 14, Article II, Section 14-35(1)(B). Running at large on public/private property, 7th offense, “Ranger”. FOLIO NO: PROPERTY ADDRESS: In front of 1390 Delmar Ln, Naples, FL 34104 Manager Timothy Crotts and Officer Ress represented the County. Officer Ress provided an overview of the case noting it involves a 7th offense for “Ranger” running at large on May 11, 2024. The investigation started with a complaint filed by Brian Lambert who provided a photo and video of the incident. The Citation was issued on 6/20/24 following the investigation. Mr. Lambert testified he provided the photograph and video of the incident and filed an affidavit on the event. July 12, 2024 10 Evidence Entered: Exhibit 1: Order issued 6/7/24 Exhibit 2: Affidavit of Brian Lambert Exhibit 3 Video of incident dated 5/1/24 Exhibit 4: Map of the area of incident Exhibit 5: Photo dated 5/11/24 Manager Crotts recommended a fine of $500.00, Operational Costs of $50.00 and a $7.00 Administrative Fee be imposed for the violation. Special Magistrate Neale, after hearing the testimony and reviewing the Evidence found the Respondent in violation of the Ordinance and ordered him to pay a fine of $500.00, Operational Costs of $50.00 and a $7.00 Administrative Fee for a total amount of $557.00 to be paid within 30 days of this hearing. CASE NO: CEEX20240005438-DAS-V24-020243 OWNER: Rodney Francisdaky OFFICER: Hope Ress VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 14, - Article II, Section 14-35(1)(E). Damage to property, issued on 05-17-2024, 1st offense, “Whiskey”. FOLIO NO: PROPERTY ADDRESS: River Reach Dr, In front of The Leasing, Naples, FL 34104 Manager Timothy Crotts and Officer Ress represented the County noting there was a plea agreement and the case has been withdrawn and replaced with Case #DASV24-0202523 Mr. Francisdaky was present and testified he has agreed to plead guilty to a charge of the dog “Running at Large.” He was walking the dog on a leash and lost control of it when it encountered another dog. Special Magistrate Neale, after hearing the testimony found the Respondent in violation of the Ordinance and ordered him to pay a fine of $100.00, Operational Costs of $50.00 and a $7.00 Administrative Fee for a total amount of $157.00 to be paid within 30 days of this hearing. Said fine to be waived if Mr. Francisdaky completes a Responsible Pet Owner class within 30 days of this hearing. VIII. NEW BUSINESS B. MOTION FOR IMPOSITION OF FINES AND LIENS 1. CASE NO: CEAU20210004410 OWNER: Camilo Leon and Teresa Leon OFFICER: Sherry Patterson VIOLATIONS: Collier County Land Development Code 04-41, as amended, Section 10.02.06(B)(1)(a), and Florida Building Code 7th Edition (2020), Chapter 1, Section 105.1. Expired fence permit PRBD20200310510 and rejected Building Permit PRBD20210520341. FOLIO NO: 38966560009 July 12, 2024 11 PROPERTY ADDRESS: 2740 50th Ave NE, Naples, FL 34113 Supervisor Perez represented the County noting the violation has been abated but not in the prescribed timeframe. Special Magistrate Order: No. 6357 Page: 2536 Fine Amount: $100.00/day Duration: 150 days Total Fine Amount: $15,000.00 Unpaid Operational Costs: $112.25 Total to Date: $15,112.25 Teresa Leon testified the carport was removed on 6/24/24 and wetland issues delayed abating the violation. Special Magistrate Neale, after reviewing the factors in the case, GRANTED the County’s Motion for Imposition of Fines and Liens in the amount of $612.85 ($500.00 in fines and $112.25 in Operational Costs). Said amount to be paid within 30 days and become a lien on the property. 2. CASE NO: CEPM20230003893 OWNER: Timothy Schaus OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Sections 22-228(1), 22-231(12)(L), 22-231(15) and 22-231(19). Pool that is green, stagnant, and not properly maintained, ripped or missing screen panel on the pool enclosure, and microbial growth on the pool enclosure frame. FOLIO NO: 24690000946 PROPERTY ADDRESS: 3222 Karst Ct, Naples, FL 34112 Officer Musse represented the County testifying the violation has been abated but not in the prescribed timeframe amassing fines and costs in the amount of $2,723.55 Special Magistrate Order: No. 6357 Page: 2536 Fine Amount: $250.00/day Duration: 10 days Total Fine Amount: $2,500.00 Unpaid Operational Costs: $111.85 Total to Date: $2,611.85 Mr. Schaus was present noting health issues and the ability to obtain equipment delayed abatement of the violation. Officer Martinez provided an overview of her education, work experience and industry certifications and Special Magistrate Neale qualified her an expert witness in Animal Cruelty. Evidence Entered: Composite Exhibit 1: Officer Martinez Certificates of Education Exhibit 2: Photo dated 3/28/24 of “BB” Exhibit 3 – 4: Photo of dog chain and clip Exhibit 5: Dog chain Officer Martinez testified  On 3/28/24 she responded to a complaint and took possession of the dog “BB” which was in poor health.  BB could not raise his head, stand or walk and was severely underweight.  BB had a chain attached to a collar with a snap which is in violation of the Ordinance for safety reasons.  She had to carry BB to the vehicle and upon inspection determined he was in shock or had poor blood flow. July 12, 2024 16  She transported the dog to an emergency animal hospital where the veterinary reports indicated BB had abnormal medical values, flea infestation and heartworm.  On 3/29/24 BB was released from the hospital and taken to Collier County Domestic Animal Services facility where he was fed and subsequently vomited dirt, grass and debris.  Contact was made with the BB’s owner who indicated he had moved to North Florida on 3/23/24 and left the dog in care with a friend of his mother-in-law. He obtained the dog as a puppy and BB is 7 – 11 years old.  Upon a site visit to Mr. Lilly’s former residence, investigation revealed the dog’s shelter was a trampoline, in violation of the Ordinance.  Research of available data revealed there were no vaccination records for BB.  Based on the investigation she determined the dog’s condition was level 2 – 2.5 on the Nestle Purina Body Condition System scale and was the subject of long-term neglect.  She issued a Citation for Cruelty to Animals in accordance with Collier County Ordinance 14-37 and Florida Statute 828.12.  Records indicate Mr. Lilly received the Citation on 5/14/24.
