EXECUTIVE SUMMARY
Recommendation to accept a donation of public art to be installed in the Bayshore Gateway Triangle
Community Redevelopment Area parking lot, 3321 Bayshore Drive.
OBJECTIVE: To accept the donation and install a piece of public art at the Collier County Community
Redevelopment Agency (CRA) parking lot located at 3321 Bayshore Drive review. The public art will be included
in the Collier County Public Art Collection.
CONSIDERATIONS: On July 13, 2021, the Board of County Commissioners approved the Bayshore Gateway
Triangle Public Art Pilot Plan. The Plan outlines guiding principles, goals, and program management strategies for
plan implementation in the Bayshore Gateway Triangle Community Redevelopment Area (BGTCRA) including a
policy on donations, requiring review and recommendation by the Public Art Committee prior to Board of County
Commissioners approval. The Plan identifies the CRA Parking lot as a potential site for public art. Further, said lot
was designed and constructed to accommodate an art piece on the southwest comer.
In March 2021, Jeanne Harvey a local entrepreneur, community trailblazer, philanthropist, owner of The Real
Macaw Restaurant for over thirty years, and advocate for the BGTCRA passed away. On May 13, 2022, the
BGTCRA held a dedication ceremony at the new CRA parking lot to honor Jeanne Harvey, who sold the property
to the BGTCRA. In August 2022, Ms. Harvey's daughter, Siobhan Cleveland reached out to the BGTCRA
regarding a proposed sculpture of a Macaw (see attachment 1) to be commissioned. This sculpture would become
the first public art for the Bayshore Drive community. The sculpture received the following approvals:
On December 6, 2022, the Bayshore Gateway Triangle Local Redevelopment Advisory Board reviewed the
application package and voted unanimously (8-0) to recommend approval of the donation and to pay for the
shipping, installation, signage, and routine maintenance of the sculpture. At the time, this was estimated at
around $3, 100 plus ongoing maintenance.
On December 14, 2022, the Bayshore Beautification Municipal Services Taxing Unit (MSTU) Advisory
Committee reviewed the application package and voted unanimously (6-0) to recommend approval of the
donation and continue routine maintenance of the sculpture in the event the CRA sunsets in 2030.
On December 21, 2022, the Public Art Committee reviewed the application and voted unanimously to
recommend approval of the donation to the Board of County Commissioners.
Following the approvals of the advisory committees, questions have been raised as to the use of taxpayer funds and
public property in support of art projects. To minimize these concerns, Ms. Cleveland has agreed to fully fund the
donation, with the exception of ongoing maintenance. With respect to maintenance, the sculpture will be powder -
coated to protect the paint. Touch-ups of the paint are expected every 7-10 years. It is expected that the sculpture
will require minimal maintenance of which the MSTU will budget accordingly. Further, should the art become a
nuisance, Ms. Cleveland recognizes that it will be the right of the BGTCRA to remove the sculpture without
recourse.
While the parking lot was designed for art, there is a thought that the sculpture closely resembles the restaurant
name and therefore, the public lot may be perceived as an extension of the restaurant. While patrons of the Real
Macaw do utilize the CRA lot, their primary parking has been addressed through a long-term agreement with Labor
Finders, a neighboring business. Coupled with the fact that many neighboring restaurants and businesses already
take advantage of the public lot, staff does not believe placement of the sculpture at the BGTCRA lot will have a
dampening effect on public use. Nonetheless, the CRA will add wayfinding signage to ensure there is no
ambiguity.
Another issue that has been questioned is why can't the sculpture be located at the restaurant. At first glance, the
space in front of the building could work. However, in speaking with Ms. Cleveland, the grease trap for the
restaurant is located underground in that space. A site plan amendment and relocation of infrastructure to the
restaurant is cost -prohibitive. Additionally, the BGTCRA community has been supportive of art in public places.
This would be the first piece in the community.

This issue has been ongoing for three years. While this item should have been approved by the County Commission
acting as the CRA before fundraising efforts were underway, this was an oversight by staff. Ms. Cleveland believed
in good faith that the Advisory Board's support of the initiative was enough to commence a fundraising campaign.
Year-to-date, $10,675 has been raised through donations with the balance of the project to be funded by the family.
To change the concept of the fandraising from "public art" and then to place it at the restaurant, may be perceived
as a bad faith effort from the family.
The proposed public art piece will be created by Jacob Novinger, a renowned art, immediately should the Board
support the item. Mr. Novinger has been creating similar sculptures since 2002. His portfolio includes several
public art pieces installed throughout the United States and Canada. The proposed commissioned piece is a metal,
hand -welded stainless -steel sculpture of a macaw bird (parrot), approximately six feet tall.
FISCAL IMPACT: There will be no fiscal impact for the purchase, delivery, and installation of the art piece.
Ongoing maintenance is expected to cost several thousand dollars every 7-10 years for paint touch-up. Funds will
be budgeted in Fund 1630 (Bayshore MSTU Operating)
GROWTH MANAGEMENT IMPACT: No impact at this time.
ADVISORY BOARD RECOMMENDATION: The BGTCRA Advisory Board recommended approval of the
donation and funding with a vote of 8-0 at the December 6, 2022, meeting. Further, while not voted upon, the
BGTCRA Board and the Bayshore MSTU Beautification Advisory Board expressed support for the donation at the
most recent June 4-5, 2024, Advisory Board meetings.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues, and
requires majority vote for approval. -JAK

Gateway Triangle Community Redevelopment Area.
