EXECUTIVE SUMMARY
This item requires that Commission members provide ex-parte disclosure. Should a hearing be held on this
item, all participants are required to be sworn in. Recommendation to approve a Resolution of the Board of
County Commissioners of Collier County, Florida, renaming a street from BelleraWalk Circle to
BelleraWalk Way, as shown on the plat of Ave Maria Unit 5, BelleraWalk Phase 1A, and located
approximately 800 feet east of the intersection of Ave Maria Boulevard and BellaraWalk Boulevard, in
Section 9, Township 48 South, Range 29 East, Collier County, Florida. [PL202400015791
OBJECTIVE: That the Board of County Commissioners ("Board") approve the attached Resolution renaming
BelleraWalk Circle to BelleraWalk Way.
CONSIDERATIONS: Atwell, LLC, on behalf of Pulte Home Company, LLC and DiVosta Homes, LP, is
requesting to rename a street in Ave Maria from BelleraWalk Circle to BelleraWalk Way. The request is being
made due to site plan and development changes, which have resulted in the street no longer being a loop/circle. The
±0.58-mile road is a dead end at one end; the other end is where the next phase of the development will wind
through an internal network of side streets.
Homeowners within 1,000 feet were notified by mail of the proposed change. One-third of the owners (32% or 87
out of 268) are still one of the three developers for the project: DiVosta, Pulte, or Lennar. The Del Webb Naples
Community Association, Inc. received one letter of no objection.
Pursuant to Ordinance No. 2007-62, an advertised Neighborhood Information Meeting was held at the Del Webb
Naples Oasis Club Grande Hall located at 6008 Del Webb Way, Ave Maria, Florida, 34142 on June 20, 2024.
Approximately 10 people attended (in person and on line). There were no objections to the street name change.
There were two questions on the impact to the residents of the name change. All other questions were related to
other issues within the community.
FISCAL IMPACT: Fiscal impact will be incurred in the fon-n of staff time spent documenting the change on plats
and amending the affected address records. The fiscal impact to fire, police (Sheriffs Office), Post Office, EMS,
and 911 Emergency Services will be incurred in the form of costs to update records and maps. It shall be the
responsibility of the petitioner to bear the cost of replacing street signs on all public and private streets.
GROWTH MANAGEMENT IMPACT: No Growth Management Impact is associated with this action.
COLLIER COUNTY PLANNING COMMISSION (CCPQ RECOMMENDATION: The Collier County
Planning Commission does not review street name change petitions.
LEGAL CONSIDERATIONS: This is a request to change the name of a platted street, BelleraWalk Circle, to
BelleraWalk Way, pursuant to Sections 22-357 and 22-358, Collier County Code of Laws and Ordinances, and
Section 336.05(l), Florida Statutes. The petitioner must verify that the proposed street name is not duplicated and
provide the reason for requesting a name change. This item has been approved as to form and legality and requires
an affirmative vote of four for Board approval. - DDP

WHEREAS, the legislature of the State of Florida, by enacting section 336.05, Florida
Statutes, has conferred on all counties in Florida the power to name or rename streets and roads,
except for certain state roads; and
WHEREAS, the Collier County Board of County Commissioners ("Board") pursuant
thereto has adopted Collier County Ordinance No. 07-62, as codified in Chapter 22, Article X,
Sec. 22-357 of the Collier County Code of Laws and Ordinances, which establishes criteria and
procedures to rename streets or roads; and
WHEREAS, the Board has held a duly advertised public hearing after providing notice as
required by said ordinance and has considered the advisability of granting the request by
Nikolaus J. Kasten, P.E., of Atwell, LLC, on behalf of Pule Home Company, LLC and DiVosta
Homes, L.P., to rename a street from BelleraWalk Circle to BelleraWalk Way; and
WHEREAS, BelleraWalk Circle is located in in Section 9, Township 48 South, Range 29
East, Collier County, Florida, as shown as that portion of Tract "R" named BelleraWalk Circle,
Ave Maria Unit 5, BelleraWalk Phase IA, recorded in Plat Book 47, Pages 74 through 79, of the
Public Records of Collier County, Florida, and as shown on Collier County Official Zoning Atlas
Map Number 8909S; and
WHEREAS, the Board has determined that all criteria set forth in Ordinance No. 07-62
has been met and specifically finds that there is no other street in incorporated or unincorporated
Collier County with this name or any similar sounding name as is being requested; and
WHEREAS, the Board has deten-nined that it is necessary for identification purposes to
confin-n the name of this street.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Effective this date, the name of the street described in the above recitals is hereby
changed from BelleraWalk Circle to BelleraWalk Way and is confirmed as such.

BE IT FURTHER RESOLVED that this Resolution be recorded in the Public Records of

affirmative votes this 9th day of July 2024.

STREET NAME CHANGE PROCEDURES
Collier County Ordinance No. 2007-62 states that anyone wishing to rename a County street must submit a
petition of sixty-six percent of the property owners abutting the street to be renamed. The proposed name may
not duplicate an existing name. Applicants must verify with the Addressing Section of the Collier County
Growth Management Division (239-252-2482) that the proposed name is not a duplication prior to
submitting the application. An addressing checklist should be completed and provided with the application. The
application should be forwarded with a cover letter describing the proposed change to:

Section 22.357. — Duly advertised public hearing to rename a street.
(1) b.
Public notification process when renamingplatted streets or roadways where the change is initiated by
a private individual. The applicant shall be responsiblefor conducting at least one neighborhood
informational meeting. This meeting shall be held 30 days prior to changing of the roadway and the
petitioner is required to install street signs. The location of the neighborhood information meeting
should be reasonably convenient to those property owners affected by the renaming of the street and
thefacilities shall be ofsufficient size to accommodate expected attendance. The applicant shall cause
a display advertisement, in type no smaller than 12 point and said advertisement shall not be placed in
thatportion of the newspaper where legal notices and classified advertisements appear. The
advertisement shall state the purpose, location, and time of the meeting and shall be placed with a
newspaper ofgeneral circulation in the county at least seven days prior to the neighborhood
informational meeting.
Requirements:

interested parties are invited to attend and be heard.
All persons wishing to speak on any agenda item must register with the County Manager prior to
presentation of the agenda item to be addressed. Individual speakers will be limited to three (3) minutes
on any item. The selection of any individual to speak on behalf of an organization or group is encouraged.
If recognized by the Chairman, a spokesperson for a group or organization may be allotted ten (10)
minutes to speak on an item. Written materials intended to be considered by the Board shall be submitted
to the appropriate County staff a minimum of seven (7) days prior to the public hearing. All materials used
