EXECUTIVE SUMMARY
Recommendation to authorize the County Manager or designee to meet with representatives of the Greater
Naples Fire Control and Rescue District and the North Collier Fire Control and Rescue District to review,
reaffirm, and update the 2013 Agreement regarding access to raw water for supplemental use for fighting
fires and bring the update back to the Collier County Board of County Commissioners, as the ex-officio the
governing board of Collier County Water -Sewer District, for consideration.
OBJECTIVE: To obtain authorization from the Board of County Commissioners (Board), as the ex-officio
Governing Board of the Collier County Water -Sewer District (CCWSD), to review, reaffirm and update the
agreement with the Greater Naples Fire Control and Rescue District and the North Collier Fire Control and Rescue
District regarding access to Collier County Water Sewer District raw water supplies as supplemental water sources
for firefighting capabilities in the rural areas of Collier County and bring back the update to the Board for
consideration.
CONSIDERATIONS: On November 12, 2013, agenda item 16.C. 1, the Board approved the "Agreement for Fire
Department Accessible Raw Water Connections Between Big Corkscrew Island Fire Control and Rescue District
and Golden Gate Fire Control District and Collier County Water Sewer District." This agreement memorialized
the historic practice whereby the CCWSD provided access to raw water in the well fields via the raw water booster
station hydrants and wellheads fitted with special connections.
On May 12, 2014, the Governor approved the Greater Naples Fire Rescue Enabling Act Chapter 2014-240. Upon
voter ratification on November 4, 2014, the Golden Gate Fire Control and Rescue District and the East Naples Fire
Control and Rescue District merged into the Greater Naples Fire Control and Rescue District.
On November 4, 2014, voters from the North Naples Fire Control and Rescue District and the Big Corkscrew
Island Fire Control and Rescue District voted that the two districts should merge. The North Collier Fire Control
and Rescue District was formed from this merger on January 1, 2015.
On September 11, 2018, agenda item 17.17, the Board formally adopted a Resolution to expand the CCWSD service
area.
Expansion of CCWSD infrastructure in rural areas of Collier County may provide new options or opportunities for
collaboration and the Fire Control and Rescue Districts have indicated their interest in reviewing and updating the
agreement.
FISCAL IMPACT: There is no fiscal impact.
GROWTH MANAGEMENT IMPACT: These agreements meet Growth Management Plan standards to ensure
the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues at this
time and requires majority vote for approval. -JAK

RAW WATER CONNECTIONS
BETWEEN
BIG CORKSCREW ISLAND FIRE CONTROL AND RESCUE DISTRICT
AND
GOLDEN GATE FIRE CONTROL DISTRICT
AND
COLLIER COUNTY WATER — SEWER DISTRICT
This AGREEMENT is made and entered into this M�� day of _, 2013, by and
between the Big Corkscrew Island Fire Control and Rescue District and the Golden Gate Fire
Control District (collectively, the "Fire Districts") and the Board of County Commissioners of
Collier County, Florida, and as Ex-Officio the Governing Board of the Collier County Water -
Sewer District ("CCWSD"), collectively ("Parties").
WITNESSETH
WHEREAS, the Fire Districts are desirous of accessible CCWSD raw water connections
to access supplemental water sources for fighting fires; and,
WHEREAS, the CCWSD has one Raw Water Booster Station hydrant available; and
WHEREAS, the CCWSD has 6 wellheads already fitted with connections available; and
WHEREAS, the CCWSD has 2 additional wellheads available to be fitted with
connections; and
WHEREAS, the Parties wish to enter into an agreement to provide accessible raw water
connections for use as supplemental water sources to fight fires; and
WHEREAS, the Parties agree that it is in the best interests of each Party to enter into this
Agreement to facilitate the availability of raw water connections as supplemental water sources
to fight fires; and
WHEREAS, it is in the best interest of the Parties, the residents of Collier County and the
customers of the CCWSD to facilitate the availability of raw water connections as supplemental
water sources to fight fires.

NOW THEREFORE, in consideration of the mutual understandings and considerations
contained herein, the sufficiency of which is hereby acknowledged, the Parties agree as follows:
1. The CCWSD will allow the Fire Districts to withdraw water for the purpose of fighting
fires from the following agreed upon CCWSD sources:
a. Raw Water Booster Station hydrant located at 8417 Ih Street SW
b. 6 existing wellhead connections at Tarniami Wells 11, 14, 19, 23, 24, and 30
c. and any mutually agreeable additional wellheads (2 currently identified) once they
are retrofitted with connections.
• The mutually agreeable and identified location in the area of 10' Ave. NE
and Wilson Blvd will be retrofitted within 12 months.
• The mutually agreeable and identified location in the area of Wilson Blvd.
and Immokalee Road will be retrofitted within 24 months.
2. Attached as Exhibit "A" is a map showing the locations of current existing and identified
mutually agreeable connections. Should those connection sites change, the CCWSD will
provide updated maps to the Fire Districts.
3. The CCWSD will provide a map showing the locations of current watermains in the
Tamiami Wellfield, and will provide updated maps upon request. Example included as
Exhibit 11B."
4. There is no guarantee of water availability. At times no raw water is flowing through
portions of the wellfield (i.e., during annual pigging of the raw water transmission mains,
during periodic planned or unplanned maintenance of wells or the raw water distribution
system, etc.). These raw water connections should be considered only as supplemental to
regularly utilized sources of water.
5. There is no guarantee of water quality or suitability for use in fighting fires. The water is
available "as is," and the CCWSD disclaims all warranties, whether express or implied,
as to the water's suitability for fighting fires. It is understood and accepted by the Fire
Districts that their use of the water is wholly at their discretion and risk.
6. The CCWSD is responsible to complete the work to retrofit additional mutually agreeable
wellheads with connections within its current work program.
7. The Fire Districts will bear all costs related to retrofit of additional mutually agreeable
wellheads with connections. The current cost is approximately $750 - $1,000 per
connection. Payment to the CCWSD shall be promptly made by the Fire Districts within
thirty (30) days upon presentment of an invoice detailing the retrofit costs.
8. The first source of water should be from the fire hydrant located at the Raw Water
Booster Station. This location provides for ingress from 7th Street SW with egress to 9th

Street SW, facilitating a smooth flow for vehicles in and out of the site. The protocol for
obtaining water from the Raw Water Booster Station is as follows:
a. The Fire Districts shall contact the South County Regional Water Treatment Plant
(SCRWTP) at (239) 252-6115 to inform Operations personnel that they are at the
gate to the RWBS and request permission to begin to fill their tanks. The
SCRWTP is staffed 24 / 7 / 365. In the unlikely event an alternate contact is
needed, Fire Districts shall contact:

* Steve Messner, Water Director at 239-822-4659.
b. CCWSD will dispatch CCWSD personnel to the site.
c. Fire Districts' personnel may enter the site utilizing the automatic gate code and
begin to fill their tanks from the fire hydrant located approximately 200 feet from
the entrance on the right (north) side of the property while CCWSD personnel are
in route.
d. Fire Districts' personnel must record the amount of water taken along with times
and dates of use to submit with their monthly water usage report to the CCWSD
by the I O'h of each month.
e. Failure to request and / or obtain permission prior to taking water or failure to
submit water use records to the CCWSD will result in termination of this
agreement as the South Florida Water Management District and the Florida
Department of Environmental Protection require recording and reporting of all
raw and finished water usage.
9. Should the need arise for additional water resources, the Fire Districts may request use of
other connections at Tamiami Wells located throughout the Golden Gate Estates area.
The Fire Districts shall use the following protocol to gain access to those secondary raw
water resources:
a. The Fire Districts shall contact the South County Regional Water Treatment Plant
(SCRWTP) Operations personnel at 252-6115. The SCRWTP is staffed 24 / 7 /
365. In the unlikely event an alternate contact is needed, Fire Districts shall
contact:

b. CCWSD personnel will be routed to the requested location immediately.
Response time may be up to 30 minutes depending on the location of responding
personnel.
c. CCWSD personnel will operate the valve.
d. Fire District personnel will provide tanks to be filled.
e. CCWSD personnel will record all water taken. Fire Districts will not be required
to report water taken on their monthly water report.
f. CCWSD personnel will remain on site until usage is no longer needed.
10. The Fire Districts shall be liable for its own actions and negligence and, to the extent
permitted by law, the Fire Districts shall indemnify, defend and hold harmless the
CCWSD against any and all actions, claims and/or damages arising out of the Fire
Districts' actions in the performance of this Agreement, including but not limited to
environmental risks and risk of application to structures. The foregoing indemnification
shall not constitute a waiver of sovereign immunity beyond the limits set forth in Florida
Statutes, Section 768.28, nor shall the same be construed to constitute agreement by any
party to indemnify the other party for such other party's negligent, willfid or intentional
acts or omissions. This indemnification obligation shall not be construed to negate,
abridge or reduce any other rights or remedies which may otherwise be available.
11. The Parties may terminate this Agreement without cause upon providing thirty (30) days
written notice to the other parties.
12. All notices from any of the parties to the other shall be deemed duly served if mailed,
emailed or faxed at the following:
