Resolution 2024-118 RESOLUTION NO. 2024—118 A RESOLUTION OF THE BOARD OF ZONING APPEALS OF COLLIER COUNTY, FLORIDA, DENYING PETITION PL20230013880, WHICH REQUESTED THE REZONING OF A ±2.16 ACRE PROPERTY FROM A RURAL AGRICULTURAL (A) ZONING DISTRICT TO A RESIDENTIAL SINGLE FAMILY-1 (RSF-1) ZONING DISTRICT, TO ALLOW UP TO TWO SINGLE FAMILY DWELLING UNITS WITH A MAXIMUM DENSITY OF UP TO ONE DWELLING UNIT PER ACRE, ON PROPERTY LOCATED AT 438 GORDONIA ROAD, ON THE SOUTHEAST CORNER OF GORDONIA ROAD AND CARICA ROAD, ALSO DESCRIBED AS LOT 19, BLOCK H, PINE RIDGE EXTENSION SUBDIVISION, IN SECTION 3, TOWNSHIP 49 SOUTH, RANGE 25 EAST, COLLIER COUNTY,FLORIDA. WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of Florida, and Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 2004-41, as amended) which establishes regulations for the zoning of particular geographic divisions of the County; and WHEREAS, property owner Eddy JD Olivares, II filed Petition PL20230013880 to rezone a ±2.16-acre property from a Rural Agricultural (A) Zoning District to a Residential Single Family-1 (RSF-1) Zoning District to allow up to two single family dwelling units with a maximum density of one dwelling unit per acre, more particularly described as: Lot 19, Block H, PINE RIDGE EXTENSION, according to the plat thereof as recorded in Plat Book 3, Page 51, of the Public Records of Collier County, Florida; and WHEREAS, on June 11, 2024, the Board of County Commissioners, acting as the Board of Zoning Appeals (the "Board"), held a properly noticed public hearing to consider Petition PL20230013880; and WHEREAS, all interested parties have been given the opportunity to be heard by this Board in public meeting assembled, and the Board has fully considered all matters presented. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS OF COLLIER COUNTY, FLORIDA, that: [24-CPS-02433/1873147/1] 39 Page 1 of 2 C"" Petition Number PL20230013880 filed by Eddy JD Olivares, II, is hereby DENIED in accordance with the record of the proceedings of the public hearing held before the Board of County Commissioners, acting as the Board of Zoning Appeals, on June 11, 2024.
