Agenda 06/25/2024 Item #16A13 (Cycle 12B Conservation Collier Active Acquisition List (AAL)06/25/2024 EXECUTIVE SUMMARY Recommendation to approve the Cycle 12B Conservation Collier Active Acquisition List (AAL) and direct staff to pursue projects recommended within the A-Category, in sequential order, funded by Conservation Collier Land Acquisition Fund. OBJECTIVE: To obtain Collier County Board of County Commissioners (Board) approval to pursue Cycle 12B project acquisitions. CONSIDERATION: On November 3, 2020, the Collier County electors approved the Conservation Collier Re - establishment Referendum with a 76.5% majority. Pursuant to Section 11 of Conservation Collier Ordinance No. 2002-63, as amended, the Conservation Collier Land Acquisition Advisory Committee (CCLAAC) recommends qualified acquisition proposals for the Active Acquisition List (AAL) to the Board for approval. On March 6, 2024, the CCLAAC selected qualified acquisition proposals for inclusion in the AAL (Attachment 1). The AAL includes the CCLAAC recommendations. Page 2 of the AAL provides companion information about the properties, including whether the owner lives adjacent and estimated maintenance costs. The map provided as backup shows the location of all proposed Cycle 12B properties along with currently owned Conservation Collier properties (Attachment 2). The proposed AAL has been separated into three (3) categories, A, B, and C, as required by Conservation Collier Ordinance (No. 2002-63, as amended) Section 11, which states: The Active Acquisition List shall separate proposals into three (3) categories: A (pursue acquisition), B (hold for re-ranking in the next cycle), and C (no interest in acquiring). The A-category parcels/projects shall be further categorized as 1 (high priority), 2 (medium priority), and 3 (low priority) to give County staff direction as to priority for acquisition tasks. Staff prepared and presented property reports, called Initial Criteria Screening Reports (ICSR), to aid the CCLAAC in evaluating each property. Included in each ICSR was a scoring matrix based on researched and observed data. The ICSRs have been posted on the Conservation Collier website (Cycle 12B): Twelfth Cycle | Collier County, FL (colliercountyfl.gov) <https://www.colliercountyfl.gov/government/public-services/divisions/conservation-collier/public- documents/twelfth-cycle> At the March 6, 2024, CCLAAC meeting, property ranking occurred after staff presented all property summaries and after public comments. A-CATEGORY PROPERTIES Caracara Prairie Preserve Target Protection Mailing Area (TPMA) - Wildcat Acres This 73.6-acre parcel is adjacent to a private mitigation easement, just south of the Hendry County line and east of the Lee County line within the Open Lands of Collier County’s Rural Lands Stewardship Area (RLSA). Staff and the CCLAAC recommend this property for the A-category due to its size and the habitat it provides for the state- listed gopher tortoise, multiple listed wading birds, the federally listed Florida panther, Everglade snail kite, and crested caracara. The property has an estimated value of $1,357,800 ($18,448 per acre). A Phase I environmental site assessment is recommended prior to acquisition due to historic agricultural land uses on the subject property. I-75/Everglades Blvd. TPMA - Hendrix House, Inc. This 17.66-acre property, which is estimated to be valued at $503,000 ($28,482 per acre), is located in North 16.A.13 Packet Pg. 315 06/25/2024 Golden Gate Estates, adjacent to the Miller Canal and I-75, and is recommended for the A-category by CCLAAC and staff. This property includes four distinct native plant communities, both wetland, and upland and provides an important North Golden Gate Estates/Picayune Strand State Forest wildlife connection via an adjacent I-75 wildlife underpass. Additionally, Florida panthers have been observed on the property, Transportation coordination: There is potential for an I-75 Interchange in this area. Staff will consider this information when planning amenities and public access on the site. Additionally, when applicable, language will be memorialized in the Purchase Agreements and related closing documents to ensure Collier County Transportation will be able to purchase a portion of the properties from Conservation Collier for future right -of-way, if and when needed, at the original per-acre acquisition cost. Marco Island TPMA -HK Investments/Van Cleef (2 parcels) These two parcels, totaling 0.8 acres, are located on Marco Island, off S. Barfield Dr., south of San Marco Rd. The 0.37-acre HK Investment parcel is recommended for the A-category by CCLAAC and staff due to its location adjacent to the recently acquired Annecy/Barfield property and due to the presence of burrowing owls and a large gopher tortoise population. Staff recommended the 0.43-acre Van Cleef parcel for the B-list to the CCLAAC due to its isolated nature without the acquisition of the HK Investment parcel; however, the CCLAAC recommended it for the A-List. Staff is agreeable to an “A” Ranking for this property as it contains burrowing owls and gopher tortoise. The Commercial Professional/Transitional District zoned HK Investment parcel has an estimated value of $800,000 ($2,162,162 per acre), and the Commercial Intermediate zoned Van Cleef parcel has an estimated value of $950,000 ($2,209,302). Wildlfowerz Ranch LLC This 639.17-acre property is adjacent to a private conservation easement, east of SR29, north and south of Oil Well Rd, within the Open Lands of Collier County’s RLSA. Staff and the CCLAAC recommend this property for the A- category due to its size and the habitat it provides for the state -listed gopher tortoise, Big Cypress fox squirrel, multiple listed wading birds, and the federally listed Florida panther, Everglade snail kite, and crested caracara. This property enhances the connection for wildlife moving north from the Florida Panther National Wildlife Refuge and Big Cypress National Preserve through private conservation lands and undeveloped lands slated for conservation (such as Owl Hammock) to OK Slough State Forest and Dinner Island Ranch Wildlife Management Area. Wildflowerz Ranch LLC is identified as an opportunity area within the Florida Wildlife Corridor - a high- priority area that is currently unprotected. The property has an estimated value of $ 5,522,400 ($8,640 per acre). A Phase I environmental site assessment is recommended prior to acquisition due to historic agricultural land uses on the subject property. Dr. Robert H. Gore Preserve TPMA - (7 parcels) Staff and the CCLAAC recommend these properties for the A-list. These seven parcels are located off Desoto Blvd., just north of I-75 between 34th and 40th Ave. SE in North Golden Gate Estates. The addition of these seven parcels, which are not within the existing Board, approved Dr. Robert H. Gore (aka Gore preserve) multi -parcel project boundary would expand the existing 215-acre Gore preserve by 20.77 acres and would cost an estimated $803,000 ($38,662 per acre). Six of the seven parcels are vacant, wooded wetlands; however, the 10.0 -acre parcel currently owned by The Cypress Cove Landkeepers is adjacent to the county-owned Gore preserve on all sides and contains a public parking area, a nature center building, and an extensive trail system. The Gore Preserve has had a trail installed and is in the process of installing other amenities. The addition of The Cypress Cove Landkeepers parcel would provide a unique opportunity for Conservation Collier to connect trails, provide parking, and expand educational programs. The Gore Preserve and the parcels surrounding it are within a historic wetland that connects with the Florida Panther National Wildlife Refuge (FPNWR) to the east, Picayune Strand State Forest (PSSF) across I-75 to the south, and Fakahatchee Strand State Preserve to the southeast across I-75. Transportation coordination: There is potential for an I-75 Interchange in this area. If these properties are approved for the A-List, staff will take this information into consideration when planning amenities and public access on the site. Additionally, when applicable, language will be memorialized in the Purchase Agreements and related closing documents to ensure Collier County Transportation will be able to purchase a portion of the properties from 16.A.13 Packet Pg. 316 06/25/2024 Conservation Collier for future right-of-way, if and when needed, at the original per-acre acquisition cost. Winchester Head - Lynch Staff and the CCLAAC recommend this property for the A-list. Although this 1.14-acre parcel is outside of the existing Board approved Winchester Head Preserve multi-parcel project boundary, it is within the topographic feature known as Winchester Head. This wetland parcel on the outer edge of Winchester Head, with a value estimate of $29,000 ($25,439 per acre), contributes to water storage and flood protection during the wet season and acts as a buffer for the deeper areas of Winchester Head. Multi-parcel projects Staff and the CCLAAC recommend that the Dr. Robert H. Gore III, Panther Walk, Red Maple Swamp, and Winchester Head Preserve projects remain an A-Category acquisition area. Staff continues to acquire parcels in these areas. Additionally, Red Maple Swamp and Winchester Head are specifically identified in LDC section 3.05.07.H.1. to satisfy on-site preservation requirements off-site. In recent years, off-site preserve donation funds have been used to acquire parcels in these areas. Dr. Robert H. Gore III Multi-parcel project (North Golden Gate Estates Units 91 and 92) This Multi-Parcel project was established in February 2023 to expand upon the original 169-acre Dr. Robert H. Gore III preserve: 215.4 acres (36%) of the 597.6-acre project have been acquired. During this cycle, it is anticipated staff will acquire ten parcels, consisting of approximately 20.50 acres, at an estimated cost of $420,250 ($20,500 per acre). Transportation coordination: There is potential for an I-75 Interchange in this area. Staff will consider this information when planning amenities and public access on the site. Additionally, when applicable, language will be memorialized in the Purchase Agreements and related closing documents to ensure Collier County Transportation will be able to purchase a portion of the properties from Conservation Collier for future right -of-way, if and when needed, at the original per-acre acquisition cost. Panther Walk Preserve Multi-parcel project (North Golden Gate Estates Unit 42, Horsepen Strand) This Multi-Parcel project was established in February 2023 to expand the existing preserve; 55.7 acres (13%) of the 437.9-acre project have been acquired. During Cycle 12B, staff anticipates acquiring 15 parcels, approximately 31.60 acres, within Panther Walk, at an estimated value of $1,001,664 ($31,698 per acre). During the establishment of this project area, Collier County Stormwater Management has expressed that this is an important area for preservation to provide natural water storage. Transportation coordination: Portions of this area may be needed for roadway expansion in the near future. Staff will consider this information when planning amenities and public access on the site. Additionally, language will be memorialized in the Purchase Agreements and related closing documents to ensure Collier County Transportation will be able to purchase a portion of the property from Conservation Collier for future right -of-way, if and when needed, at the original per-acre acquisition cost. Red Maple Swamp Multi-parcel project (North Golden Gate Estates Unit 53) This Multi-Parcel project in North Golden Gate Estates south of Shady Hollow Boulevard was established in 2004; 245.1 acres (80%) of the 305.8-acre project have been acquired. It is anticipated that 10.00 acres (4 parcels) will be acquired during Cycle 12B at an estimated cost of $206,000 ($20,600 per acre). Winchester Head Multi-parcel project (North Golden Gate Estates Unit 65) This Multi-Parcel project, located north of Oil Well Road and east of Everglades Boulevard, was established in 2005; 108.8 acres (69%) of the 158.4-acre project have been acquired. During this cycle, it is anticipated that four parcels will be acquired, consisting of 10.00 acres, at an estimated cost of $254,390 ($25,439 per acre). 16.A.13 Packet Pg. 317 06/25/2024 B-CATEGORY PROPERTIES B-Category properties are not recommended for acquisition at this time. These properties are proposed to be reconsidered for acquisition after one calendar year. C-CATEGORY PROPERTIES C-Category properties are not recommended for acquisition and are proposed to be removed from the AAL. Property owners may apply for consideration during a future cycle. ADVISORY COMMITTEE RECOMMENDATIONS: On March 6, 2024, the CCLAAC held a public meeting and selected qualified acquisition proposals for Board consideration. CCLAAC recommends properties, including multi-parcel projects, for a total of 825.24 acres for the “A” list category in Cycle 12B. The total projected acquisition cost for all Cycle 12B A-list category CCLAAC recommended properties is $11,847,504. FISCAL IMPACT: The total estimated cost of all properties under consideration in Cycle 12B is $11,847,504; this includes multi-parcel project parcels allocated for Cycle 12B. Funds in the amount of $26,088,483 are available for land acquisitions within the Conservation Collier Land Acquisition Fund (1061) FY24 budget. Properties pending acquisition in Cycle 11B and 12A total approximately $20,929,224. Funding for acquiring potential properties in Cycle 12B depends upon the Board approved budget and spending in previous cycles. Closings on properties in Cycle 12B would occur no sooner than FY25. Funding for managing any lands acquired by the program is budgeted in the separate Conservation Collier Land Management Fund (1062), funded via a transfer from the net Conservation Collier ad valorem tax levy. GROWTH MANAGEMENT IMPACT: Fee-simple acquisition of conservation lands is consistent with and supports Policy 1.3.1(e) in the Conservation and Coastal Management Element of the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: The Conservation Collier Ordinance (No. 2002-63, as amended), in Section 11, provides a legal framework for developing the Active Acquisition List. The recommendation to acquire A-List properties on the Active Acquisition List falls within this legal framework. As such, this item is approved for form and legality and requires a majority vote for Board action. - SAA RECOMMENDATION: To approve the Cycle 12B Conservation Collier Active Acquisition List (AAL), direct staff to pursue projects recommended within the A-Category, in sequential order, and bring the Purchase Agreements to the Board for review and approval.
