Agenda 06/25/2024 Item #16A11 (The Board to release a code enforcement lien, in relation to CESM Case No. CESD20190002904)06/25/2024 EXECUTIVE SUMMARY Recommendation to approve, pursuant to Resolution No. 2023-90, the release of a Code Enforcement lien with an accrued value of $233,423.89, for a reduced payment of $3,055.60, in the Code Enforcement action titled Board of County Commissioners vs. Johnny R. Mollett, relating to Folio #41508600000, Collier County, Florida. Case No. CESD20190002904. OBJECTIVE: To have the Board of County Commissioners accept an offer to release a code enforcement lien with an accrued value of $233,423.89 for payment of $3,055.60 in relation to Code Enforcement Special Magistrate Case No. CESD20190002904. CONSIDERATIONS: As a result of a code violation at an unimproved property, Folio #41508600000, the Code Enforcement Board ordered the imposition of liens against Johnny R. Mollett in Case No. CESD20190002904. The violation consisted of the removal of vegetation from an unimproved parcel without a permit. The lien was recorded in the Official Records on September 18, 2020, at O.R. Book 5817, Page 3132, and the lien amount of $252,000 is based on 1,260 days of accrued fines ($200 per day from April 24, 2020, through October 5, 2023) plus $118.56 in operational costs for a total of $252,118.56. The property was brought into compliance on October 5, 2023. CDL Naples Investments LLC., acquired the property via Tax Deed recorded on August 15, 2023, at O.R. Book 6278, Page 1224. Surplus funds in the amount of $18,694.67 were applied to the recorded lien, leaving a balance of $233,423.89. The property was brought into compliance on October 5, 2023. Pursuant to Resolution No. 2023-90, a request for reduction of fines may be considered, in part, when a lien encumbers property under new ownership, and the new owner has diligently pursued abatement and achieved compliance and/or when payment of the lien would impose a severe financial hardship on the owner. The property is being actively maintained, and CDL Naples Investments LLC. offers to pay $3,055.60 to settle the lien. The recommended payment of $3,055.60 is based on ten percent of the Collier County Property Appraiser’s Assessed Value of $30,556 and meets the criteria outlined in Resolution 2023-90. There are no known violations at this time. Code Enforcement is recommending a reduction in the amount of $230,368.29 in accrued fines, as outlined in the attached Code Lien Relief Application. There are currently no known violations on the property. FISCAL IMPACT: Acceptance of payment of $3,055.60 to settle the lien will correlate to what is outlined in Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2023-90. RTT RECOMMENDATION: To approve the recommended reduction of fines in the amount of $230,368.29, accept payment amount of $3,055.60, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records.
