EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners temporarily waive Domestic Animal Services
(DAS) Division Adoption Fees and Citation and Compliance Fees, per Resolution No. 2018-106, to promote
community participation and educational opportunities from Wednesday, June 26, 2024, through Monday,
September 30, 2024.
OBJECTIVE: To have the Board of County Commissioners (Board) approve temporarily waiving Domestic
Animal Services (DAS) Division Adoption Fees and Citation and Compliance Fees per Resolution No. 2018 -106
from Wednesday, June 26, 2024, through Monday, September 30, 2024.
CONSIDERATIONS: The Domestic Animal Services (DAS) Division animal shelter is centrally located at 7610
Davis Boulevard, Naples, Florida 34104, on approximately 9.44 acres of land approved by the Board on August 5,
1997. DAS is open to the public six (6) days a week, by appointment only on Thursdays, employs twenty-eight (28)
full-time employees, ten (10) temporary staffing, and hosts approximately two hundred (200) volunteers throughout
the calendar year to ensure safe boarding and proper medical care in order to adopt and foster animals in the shelter.
Per Board direction on June 11, 2024, staff is recommending the Board temporarily approve waiving Adoption
Fees to promote the reduction of animals boarded under the care of DAS. The reduction of animals boarded onsite
will lessen the impact to taxpayers, reduce the time animals are housed at the shelter, and facilitate the scheduled
building renovation project necessary to protect the health, safety, and welfare of the animals, staff, volunteers, and
customers.
In addition, staff is recommending the Board temporarily approve waiving Citation and Compliance Fees to
encourage community education opportunities conducted by the Code Enforcement Division. If approved by the
Board, Citation and Compliance Fee waivers will be addressed on a case -by-case basis at the discretion of the
County Manager or designee for severity and regulatory compliance.
FISCAL IMPACT: Changes in revenue for Fiscal Year (FY) 2024 Q4 are dependent on community response and
participation for adoptions and the number of educational activities performed.
GROWTH MANAGEMENT IMPACT: No Growth Management Impact is associated with this item.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for
Board approval. (HFAC)

A RESOLUTION OF COLLIER COUNTY BOARD OF COUNTY
COMMISSIONERS SUPERSEDING RESOLUTION NO. 2016-125 IN
ORDER TO ESTABLISH THE DOMESTIC ANIMAL SERVICES FEE
POLICY TO PROVIDE APPROPRIATE FEES FOR ALL SERVICES
PROVIDED BY COLLIER COUNTY DOMESTIC ANIMAL SERVICES
AND TO CONFORM WITH THE AMENDED COLLIER COUNTY
ANIMAL CONTROL ORDINANCE
WHEREAS, on June 14, 2016, the Board adopted Resolution No. 2016-125 which
established a revised Fee Policy in accordance recommendations made by the team of veterinarians
from Maddie's Shelter Medicine Program at the University of Florida; and
WHEREAS, the shelter assessment conducted by a team of veterinarians from Maddie's
Shelter Medicine Program at the University of Florida recommended giving the Director of Animal
Services discretion to reduce or waive adoption fees for promotional purposes and to implement a
Shelter-Neuter-Vaccinate-Return program for community cats; and
WHEREAS, on June 26, 2018, the Board adopted Ordinance No. 2018-33 , amending
Ordinance No. 2013-33, the Collier County Animal Control Ordinance; and
WHEREAS,the Ordinance updates the Division's current operations to be comparable to
other county and municipal animal control agencies, implementing fees for voluntary surrender of
animals by their owner's, animal bite quarantines and investigations, Trap-Neuter-Vaccinate-
Return of community cats, fees for County Rabies/License Tag program, and trap replacement
fees; and
WHEREAS, the Director of Animal Services recommends that the Board of County
Commissioners amend Exhibit A of the Domestic Animal Services Fee Policy, as attached hereto;
and
WHEREAS,the Board of County Commissioners hereby accepts the recommendations of
the Director of Animal Services.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY THAT:
Resolution 2016-125 is hereby superseded in its entirety and the Domestic Animal Services
Fee Policy is hereby amended as depicted in the attached Exhibit A.
BE IT FURTHER RESOLVED that this Resolution becomes effective upon adoption by
the Board of County Commissioners of Collier County, Florida.

EXHIBIT A
COLLIER COUNTY DOMESTIC ANIMAL SERVICES'
FEE POLICY
I.PURPOSE
The purpose of this policy is to establish user fees which will partially offset the cost of
providing domestic animal services to the taxpayers of Collier County. All terms shall be defined
as set forth in Ordinance No. 2013-33, as amended.
II. LIMITATIONS
A. Waiving of Fees. The Board of County Commissioner shall set all fees and
charges. Fees may be waived in accordance with policies articulated herein, such as under certain
conditions upon reclaim, when fees are for animals in safekeeping. Fees for field surrenders and
board for quarantine may be waived at the discretion of the Director when to do so will prevent
the suffering of an animal or ensure public safety and no reasonable alternative to waiving the fee
exists. Such waivers shall be brought before the Board in quarterly reports for after-the-fact
ratification.
B. Non-Fee-Related Policies. The Director of Animal Services, or designee, may
waive enforcement or application of any department policies or restrictions provided such waiver
does not conflict with applicable local, state, or federal laws and does not interfere with public
safety.
C. Promotional Sales and Advertisements. Fees may be reduced for special
promotional sales and advertisements if approved by the Director of Animal Services and such a
reduction is applied in a consistent and time-limited manner. Two-for-the-price-of-one cat
adoptions may be a perpetual adoption promotion.
D. Sponsored Fees. The depaftmentdivision may accept cash donations to sponsor
fees for customers in need. Fee sponsorship donations will be accounted for as the sale of gift
certificates to be redeemed at the time of the fee-incurring transaction. Redemption of sponsored
fee gift certificates will be at the director's discretion in accordance with the following general
guidelines: A customer cannot benefit from sponsored fees more than once in a twelve-month
period.
E. Reclaim Fees. Fees may be reduced or waived at the discretion of the Director of
Animal Services if such fees would facilitate a live release and allow for the animal to be returned
to a responsible home or community cat caregiver. Reducing and/or waiving of fees should only
be utilized once all fee-sponsored donations are exhausted. Collier County license and microchip
are not subject to reduction or waiver of fees. RFID fees are not applicable to community cats

being returned to a community cat colony. Reclaim fees do not apply to impounded animals with
an RFID that were previously adopted through a Rescue Organization, Animal Rescue Group,
Animal-related organization, or a Rescue Pet Placement Partner that are being reclaimed by the
same group or organization; this exception does not apply to dogs or cats that are not currently
sterilized, or any animals' impoundment that was a result of the group or organization violating
Collier County Animal Control Ordinance.
F. Safekeeping. If an animal is impounded at the request of a first-responding agency
due to the death, medical emergency, or disaster-related circumstance of its owner or caretaker,
and that animal is claimed by the owner, next of kin, or otherwise authorized party at the first
available opportunity, impound and board fees may be waived. This exception does not apply to
animals of owners or caretakers who have been arrested or incarcerated. Safekeeping animals are
subject to all other requirements of impounded animals at Domestic Animal Services as per Collier
County Animal Control Ordinance.
G. Refunds. The following fees are nonrefundable: Impoundment Fees, Owner
Surrender Fees (except as provided herein), License Fees (except as provided for herein), and
Permitting Fees (except situations where the applicant is not approved for zoning as required by
Collier County Animal Control Ordinance). The following fees are refundable only if service is
not rendered: Mandatory Spay/Neuter Fees, Micro-chipping Fees, and Euthanasia and Cremation
Service Fees may be refunded at the discretion of the Director of Animal Services, or designee,
upon written request received within 30 days of payment or receipt of service, whichever comes
first. Sterilization deposits are refundable if proof of mandatory sterilization is provided to the
division within the specified time provided by the Shelter Veterinarian or designee.
Adoption fees are nonrefundable. Adopted animals may be returned before the 30th day of
placement without incurring an owner surrender fee. On the 31st day and all those thereafter, an
owner surrender fee will be incurred for adoption returns. Days are counted as calendar days,
irrespective of Domestic Animal Services open-to-the public hours. If an animal is returned within
30 days of placement, the adopter may adopt a like type animal at no cost within 60 days of the
original adoption. Adoption fees may be refunded within ten(10) days of placement if the adopter
can demonstrate non-routine veterinary medical expenses in excess of the amount of the adoption
fee.Adoptions are considered"as is,"and no expenses beyond the adoption fee will be reimbursed.
Adoption fees will not be reimbursed if the adopter failed to sign up for free pet insurance offered
by Domestic Animal Services.
