Agenda 06/25/2024 Item #10B (Golden Gate Golf Course property pledged for the construction of a State Veterans’ Nursing Home in Collier County)06/25/2024 EXECUTIVE SUMMARY Recommendation to direct the County Manager or designee to begin the process of preparing the required real property documents and appraisal for conveyance to the State of Florida the approximately 22 acres of Golden Gate Golf Course property pledged for the construction of a State Veterans’ Nursing Home in Collier County. OBJECTIVE: To begin the process necessary to convey County-owned property to the State of Florida for the construction of a State Veterans’ Nursing Home. CONSIDERATIONS: On April 9, 2024, the State of Florida submitted two construction grant applications to the United States Department of Veterans Affairs (VA); one for the 65% match for the State Veterans’ Nursing Home and the other for authorization to include as part of new construction an adjoining Adult Day Health Care facility. The federal government does not match construction funding for the latter. The Secretary of the VA sets the State Home Construction Grant Priority List, in part, by definition of “need” and whether the state applicant has their 35% construction match in hand and unencumbered. The State of Florida is defined as a state of “great need,” the highest category of need, based on the need for over 2,000 veterans’ nursing home beds to accommodate our senior veteran population. The Secretary’s ranking list is expected to be released before the beginning of the next congressional budget cycle. Previously, Collier County placed into escrow $30 million in Infrastructure Sales Surtax funds approved by voters. Another $10 million in surplus Infrastructure Sales Surtax funds for the Adult Day Health Care and outpatient therapy services have previously been approved by the Board and currently remain in the Surtax fund. The State Legislature has also appropriated $10 million for this project. To facilitate enough lead time in the preparation to donate approximately 22 acres of Golden Gate Golf Course property to the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (BOTIITF) for the construction of the State Veterans’ Nursing Home and Adult Day Health Care facilities, I recommend that we direct the County Manager to begin the process to: - Prepare the required real property documents, including but not limited to: deed, property survey, appraisal, and updated legal description for the entirety of the proposed property based on the additional acreage necessary to facilitate the Golden Gate Parkway ingress/egress, and submit such documents to the State of Florida for approval of the form; - Work with the State of Florida to create an Escrow Agreement for the aforementioned real property; and, - Prepare an Amendment to the Memorandum of Agreement between the State of Florida - Department of Veterans’ Affairs and the Collier County Board of County Commissioners, as needed to include the updated legal description and sketch of the property. FISCAL IMPACT: Funding for an appraisal, estimated at $5,500, is available within County-Wide Capital Fund (3001), Golden Gate Golf Course Project #80412. GROWTH MANAGEMENT IMPACT: This Executive Summary has no immediate growth management impact. LEGAL CONSIDERATIONS: Collier County’s Memorandum of Agreement with the State of Florida Department of Veterans’ Affairs, dated March 14, 2023, provides “the parties agree that unless and until there is a reasonable degree of certainty that the Project will proceed as planned, no conveyance of title to real property will occur.” The parties will discuss the appropriate milestone for the transfer of title and documents will be prepared subject to Board approval. RECITALS WHEREAS, on March 14, 2023, the FDVA and Collier County entered into a Memorandum of Agreement regarding the FDVA's State Veterans' Nursing Home("Project")to be developed on property presently owned by Collier County; and WHEREAS,the Memorandum of Agreement required the County to commit$30 million thirty million dollars) in County funds to be used as matching funds toward the construction and development costs of the Project, and further required the County to commit County-owned land for donation to the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida("BOTIITF") for the Project; and WHEREAS,the Parties wish to amend the Memorandum of Agreement,to replace Exhibit B, Grady Minor Property Description and Sketch of Proposed Area for Home (dated 7/9/21 and 7/13/21), with a revised Exhibit B, Sketch and Legal Description for the Proposed VA Parcel prepared by Coastal Engineering Consultants, Inc. (dated 10/13/23). WITNESSETH NOW, THEREFORE, the FDVA and the County agree to amend the Memorandum of Agreement as follows: 1. The recitals above are true, correct, and incorporated herein. 2. The Memorandum of Agreement is amended to replace Exhibit B, Grady Minor Property Description and Sketch of Proposed Area for Home, with a revised Exhibit B, Sketch and Legal Description for the Proposed VA Parcel prepared by Coastal Engineering Consultants, Inc. (Attached hereto as Exhibit "A"). This revised Sketch and Legal Description increases the proposed property for the project from approximately 13.58 acres to approximately 20.07 acres of land. 3. As previously set forth in the Memorandum of Agreement, the Parties agree that unless and until there is a reasonable degree of certainty that Project will proceed as planned, no conveyance of title to real property will occur and no construction funds will be requested or released. 4. Except as modified by this Amendment, the Memorandum of Agreement shall remain in full force and effect.
