AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AMENDING ORDINANCE NO. 2004-41, AS AMENDED,
THE COLLIER COUNTY LAND DEVELOPMENT CODE,
WHICH ESTABLISHED THE COMPREHENSIVE ZONING
REGULATIONS FOR THE UNINCORPORATED AREA OF
COLLIER COUNTY, FLORIDA, BY AMENDING THE
APPROPRIATE ZONING ATLAS MAP OR MAPS BY
CHANGING THE ZONING CLASSIFICATION OF THE
HEREIN DESCRIBED REAL PROPERTY FROM THE
RURAL AGRICULTURAL (A) ZONING DISTRICT TO
THE RESIDENTIAL SINGLE FAMILY-2 (RSF-2) ZONING
DISTRICT, TO ALLOW UP TO THREE SINGLE FAMILY
DWELLING UNITS ON PROPERTY LOCATED AT 135
PRICE STREET, IN SECTION 4, TOWNSHIP 51 SOUTH,
RANGE 26 EAST, COLLIER COUNTY, FLORIDA,
CONSISTING OF ±4.86 ACRES; AND BY PROVIDING AN
EFFECTIVE DATE. [PL20220002704]
WHEREAS, Blair A. Foley, P.E., of Blair A. Foley, PE, L.L.C., on behalf of M.C.G.
Properties 135, LLC, petitioned the Board of County Commissioners to change the zoning
classification of the herein described real property.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE:
The zoning classification of the herein described real property consisting of±4.86 acres
and more particularly described in Exhibit "A", attached hereto and incorporated herein by
reference, located in Section 4, Township 51 South, Range 26 East, Collier County, Florida, is
changed from the Agricultural (A) Zoning District to the Residential Single Family-2 (RSF-2)
Zoning District to allow up to three single family dwelling units, subject to those Conditions of
Approval attached hereto as Exhibit "C" and incorporated herein by reference. The appropriate
zoning atlas map or maps, as described in Ordinance Number 2004-41, as amended, the Collier
County Land Development Code, is/are hereby amended accordingly.

SECTION TWO:
This Ordinance shall become effective upon filing with the Department of State.
PASSED AND DULY ADOPTED by super-majority vote of the Board of County
Commissioners of Collier County, Florida, this 11th day of June 2024.

Exhibit "C"
Conditions of Approval
1. The property described in Exhibit "A" is limited to only one guesthouse
until that time County sewer service is made available adjacent to the
property on Price Street. Once the sanitary sewer service is available for
connection, the property shall be permitted one guest house per lot, in
accordance with the Collier County Land Development Code.
2. The owner shall construct at their sole expense a 6-foot-high PVC fence
along the western property line.
