Attachment 1 6 A 1 FIRST AMENDMENT TO AGREEMENT FOR COLLER COUNTY HEARING EXAMINER SERVICES THIS FIRST AMENDMENT TO AGREEMENT (hereinafter referred to as the "Amendment") is made and entered into this J(/bf , 2024, by and between Andrew W.J. Dickman, AICP, Esq., a licensed Florida Bar attorney (h einafter referred to as the "Hearing Examiner" or "HEX") and Collier County, Florida, a political subdivision of the State of Florida (hereinafter referred to as "County") each individually referred to as the "Party" and collectively referred to as the "Parties." RECITALS: WHEREAS, Hearing Examiner and County entered into an Agreement dated July 14, 2020 (hereinafter referred to as the"Agreement"),for Hearing Examiner services for a period of two years; and WHEREAS,the County gave written notice to the Hearing Examiner to renew the Agreement for one additional two-year period, and the Hearing Examiner agreed to extend the term to July 13, 2024 on the same terms and conditions; and WHEREAS, the Collier County Board of County Commissioners and the Hearing Examiner desire to amend the Agreement to allow for two additional two-year renewals of the Agreement on the same terms and conditions. WITNESSETH NOW, THEREFORE, in consideration of Ten Dollars (10.00) and other good and valuable consideration exchanged amongst the parties, and in consideration of the covenants contained herein, the parties agree as follows: 1. All of the above RECITALS are true and correct and are hereby expressly incorporated herein by reference as if set forth fully below. 2. The Agreement is hereby amended to add the following paragraph: 1. Commencement. The Agreement shall be for a twe-four year period, commencing on July 14, 2020 and terminating July 13, 2-022 2024 or until all outstanding Purchase Order(s) issued prior to the expiration of the Agreement period have been completed or terminated. The County may, at its discretion and with the consent of the HEX, renew the Agreement under all terms and conditions contained in this Agreement for ene two additional two-year periods. The County shall give the HEX written notice of the County's intention to renew the Agreement term prior to the end of the Agreement term or renewal term then in effect.
