RECITALS: WHEREAS, on January 28, 2003, the North Naples Fire Control and Rescue, Golden Gate Fire Control and Rescue District, Big Corkscrew Island Fire Control and Rescue District, Immokalee Fire Control District, East Naples Fire Control and Rescue District, Ochopee Fire District, and Isle of Capri Municipal Rescue and Fire Services Taxing District (collectively referred to as the "Fire Districts"), entered into an Interlocal Agreement with Collier County, for the purpose of delineating the responsibilities of Collier County and the Fire Districts with respect to plan reviews and fire inspections for new construction, construction projects, and existing structures, a copy of which is attached as Exhibit A (the "Fire District Agreement"); and WHEREAS, on April 22, 2014, the North Naples Fire Control and Rescue District and Collier County entered into an Interlocal Agreement Concerning Fire Plans Review and Inspection, a copy of which is attached as Exhibit B (the "Plan Review Agreement"), which provides for the collection of certain fees for NCFD fire plan reviews and inspections; and WHEREAS, the North Naples Fire Control and Rescue District and the Big Corkscrew Island Fire Control and Rescue District merged into the North Collier Fire Control and Rescue District in accordance with section 189.074, Florida Statutes, and operates pursuant to Chapter 2015-191, Laws of Florida; and WHEREAS, the Plan Review Agreement was extended by Agreement dated January 26, 2021 between NCFD and County; and WHEREAS, the Parties desire to terminate the Fire District Agreement and amend the Plan Review Agreement. All of the above RECITALS are true and correct and are hereby expressly incorporated herein by reference as if set forth fully below. 2. The NCFD will conduct and manage all fire plans review for the NCFD and any areas now known or that may subsequently be incorporated into or with the NCFD through agreement, expansion or consolidation. 3. The County agrees to provide workspace within the Growth Management Community Development Department building, 2800 North Horseshoe Drive, Naples, Florida 34104, suitable to accommodate a five member NCFD plans review team as provided in the Lease Agreement attached to the Plan Review Agreement. The termination of the Lease Agreement or failure to execute a lease agreement shall not affect the authority of the NCFD to conduct and manage all fire plans review as provided for in paragraph 2. 4. NCFD will use the same equipment and resources as County employees within the County's Building Code Office, including but not limited to phones, computers, computer software, and other physical systems, which will be provided by the County. The County shall provide the NCFD with availability or access to ten (10) CityView licenses for plans reviewers and inspectors that it will use for fire plans reviews and to utilize for reviewing and approving plans. NCFD and the County will collaborate on all future system upgrades, software purchases, and any improvements that affect the delivery of service to our mutual customers. If changes to the CityView software are requested by NCFD including fee changes, NCFD will provide no less than 180 days prior written notice to County. Any fees or costs associated with software changes such as vendor costs will be paid by the party requesting the change. All other software upgrade costs will be paid based on fair share as follows: NCFD 50%, Greater Naples Fire Rescue District 25% and Collier County 25%. 5. The cost for providing NCFD with equipment, licenses, upgrades and maintenance of the systems used by both parties within the County's Building Code Office and portable electronic devices is included in the annual rent set forth in the Lease Agreement. The purchase, operation, and maintenance of vehicles used by either party are expressly excluded from this Agreement. 6. County will collect certain fees for NCFD fire plans review and inspections within the boundaries of NCFD in accordance with the fee schedule effective January 1, 2024, with the portion of the adopted fee schedule that is to be collected by the County in accordance with this Agreement attached hereto as Exhibit C and incorporated herein. NCFD may change these fees by Resolution, and by providing County written notice of the change no later than 180 days prior to the effective date of the new fees. NCFD agrees to coordinate with the other Fire Districts and will strive to ensure that all Fire Districts are charging the same fees. 16A14 7. County and NCFD will cooperatively review existing plan review and inspection functions and work collaboratively to eliminate non-essential redundant, and duplicative reviews and inspections. The parties will continue to cooperatively explore ways to improve service to customers throughout the duration of this Agreement. 10. The term of this Amended Interlocal Plan Review Agreement is five (5) years, but it may be terminated by either party upon thirty (30) days written notice to the other. Thereafter, unless notice of termination is given by either party, this Agreement shall automatically and without further notice or action of either party renew for additional five years periods on each five-year anniversary date. 11. The Parties hereby terminate the Fire District Agreement. 12. This Amended Interlocal Plan Review Agreement contains the complete and entire understanding of the Parties. 13. In accordance with § 163.02(11), Florida Statutes, this Amended Interlocal Plan Review Agreement shall be recorded by the Clerk of the Circuit Court in the Official Records of Collier County, Florida by the County. County will collect all inspection fees remitted for NNFD fire ans review,along with the County's permit fees, to eliminate the need for customers to makerseparate payments to the County and to NNFD. 7. Each Party shall set its own inspection fees. The County will provide NNFD monthly fee collection reports and NNFD will review and approve fee collections monthly. The County will make adjustments upon written approval from NNFD following verification by the County.Distribution of fees to NNFD shall occur on a monthly basis. 8.
