Agenda 06/11/2024 Item #16K 7 (Resolution - Declaring a vacancy on the Code Enforcement Board)06/11/2024 EXECUTIVE SUMMARY Recommendation to declare a vacancy on the Code Enforcement Board. OBJECTIVE: To declare a seat to be vacant on the Code Enforcement Board. CONSIDERATIONS: This quasi-judicial board is established pursuant to Chapter 162 of the Florida Statutes by Ordinance No. 07-44, as amended, and is composed of seven regular members and two alternates representing the occupations of architect, businessperson, engineer, general contractor, subcontractor and realtor, and who are considered on the basis of their experience or interest in the areas of the codes and ordinances to be enforced. A member of this board, Mr. James York, has been unable to attend any of the Code Enforcement Board meetings this year. A total of two excused absences at the beginning of the year, followed by three unexcused absences. Collier County Ordinance No. 2001-55, as amended, provides that if any board member is absent from two consecutive meetings without a satisfactory excuse acceptable to the board chairperson, the board chairperson shall state such fact at the next board meeting and if the Commission concurs with the chairperson’s notification, the Commission shall declare the board member’s position to be vacant. Mr. York is one of two alternates on the Code Enforcement Board. There are no vacant seats at this time. COMMITTEE RECOMMENDATION: In accordance with Collier County Ordinance No. 2001-55, Section 8, the Code Enforcement Board Chair has recommended to the Board of County Commissioners that Mr. York’s absenteeism be deemed a tender of resignation and that his seat be declared vacant. A recommendation memo from the current chair as well as the current year attendance sheet are included in the backup. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. - JAK RECOMMENDATION: That the Board of County Commissioners adopts the Committee Recommendation, declares James York’s seat to be vacant, and authorizes the Chair to execute the attached resolution confirming the vacancy. WHEREAS, the Board of County Commissioners adopted Ordinance No. 07-44, as amended, the Consolidated Code Enforcement Ordinance, which established the Collier County Code Enforcement Board to hear and decide cases in which violations are alleged of any provision of Collier County codes or ordinances; and WHEREAS, Ordinance No. 07-44, as amended, provides that the Collier County Code Enforcement Board shall consist of seven regular members and two alternate members; and WHEREAS, Collier County Ordinance No. 01-55, as amended, provides that any board member who is absent for more than one-half of the board’s meetings in a given fiscal year shall be deemed to have tendered his or her resignation from such board; and WHEREAS, member James York has missed all meetings held thus far in 2024, the last three absences without a satisfactory excuse; and WHEREAS, the Chairman of the Code Enforcement Board has requested that the Board of County Commissioners declare that the seat held by James York be vacant on their Board. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the seat of James York is hereby declared to be vacant on the Collier County Code Enforcement Board.
