EXECUTIVE SUMMARY
Recommendation to declare a vacancy on the Golden Gate Beautification MSTU Advisory Committee.
OBJECTIVE: To declare a seat to be vacant on the Golden Gate Beautification MSTU Advisory Committee.
CONSIDERATIONS: This five-member committee was created by Ordinance No. 87-78 to advise and make
recommendations to the BCC regarding the beautification and maintenance of landscape improvements within the
road right of way as described by ordinance boundary and to annually prepare an itemized budget of the amount of
money required to carry out the business of the committee for the next Fiscal Year. Members must be residents of
one of the following precincts: 323, 324, 325, 326, 327, and part of 322. Terms are 4 years. A list of the current
membership is included in the backup.
A member of this board, Oscar Marimon, has been unable to attend any of the Golden Gate Beautification MSTU
Advisory Committee meetings this year, with one excused absence and four unexcused absences. Collier County
Ordinance No. 2001-55, as amended, provides that if any board member is absent from two consecutive meetings
without a satisfactory excuse acceptable to the board chairperson, the board chairperson shall state such fact at the
next board meeting and if the Commission concurs with the chairperson’s notification, the Commission shall
declare the board member’s position to be vacant.
There are no vacant seats at this time.
COMMITTEE RECOMMENDATION: On May 21, 2024, the advisory board voted 4-0 to recommended to the
Board of County Commissioners that Mr. Marimon’s absenteeism be deemed a tender of resignation and that his
seat be declared vacant. A recommendation email with the meeting date and vote count, as well as the current year
attendance sheet are included in the backup.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board
approval. -JAK
RECOMMENDATION: That the Board of County Commissioners adopts the Committee Recommendation,
declares Oscar Marimon’s seat to be vacant, and authorizes the Chair to execute the attached resolution confirming
the vacancy.

RESOLUTION NO. 2024 - _____
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, DECLARING A VACANCY ON
THE GOLDEN GATE BEAUTIFICATION ADVISORY COMMITTEE.
WHEREAS, Collier County Ordinance No. 87-78 confirmed the creation of the Golden
Gate Beautification Advisory Committee which advises the Board of County Commissioners
(Board) on matters pertaining to the Golden Gate Beautification Municipal Taxing Unit
(MSTU); and
WHEREAS, Ordinance No. 87-78, as subsequently amended, provides that this Advisory
Committee shall consist of 5 members who represent the voting precincts within the MSTU; and
WHEREAS, Collier County Ordinance No. 01-55, as amended, provides that any board
member who is absent for more than one-half of the board’s meetings in a given fiscal year shall
be deemed to have tendered his or her resignation from such board; and
WHEREAS, member Oscar Marimon has missed all meetings held thus far in 2024, four out
of five absences without a satisfactory excuse; and
WHEREAS, the Golden Gate Beautification Advisory Committee have requested that the
Board of County Commissioners declare that the seat held by Oscar Marimon be vacant on their
Board.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the seat of Oscar Marimon is
hereby declared to be vacant on the Golden Gate Beautification Advisory Committee.
This Resolution adopted upon majority vote on this the 11th day of June, 2024.
