Agenda 06/11/2024 Item #16D 5 (Chairman to sign the Fourth Amendment to a HOME Investment Partnerships Program)06/11/2024 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to sign the Fourth Amendment to a HOME Investment Partnerships Program subrecipient agreement between Habitat for Humanity of Collier County, Inc., and Collier County, to revise language, update information, and clarify grantor requirements. (No Fiscal Impact - Housing Grant Fund 1835) OBJECTIVE: To continue the mission of accomplishing the goals of the Strategic Plan, preserving and enhancing the character of the community, while contributing to comprehensive affordable housing opportunities for low- to moderate-income persons in Collier County. CONSIDERATIONS: On June 25, 2019 (Agenda Item #16.D.2), the Board of County Commissioners (“Board”) approved the FY 2019-2020 One Year Action Plan, which allocated $886,345 to Habitat for Humanity of Collier County, Inc. (“Habitat”) for a housing development project under the HOME Investment Partnerships Program. Subsequently, the Board approved the Substantial Amendment to the FY 2019-2020 One Year Action Plan on January 28, 2020 (Agenda Item #16.D.1), which changed the geographic location for Habitat’s housing activity from the Davis Boulevard area to the Pine Ridge Road area. On April 13, 2021 (Agenda Item #16.D.1), the Board approved and executed a subrecipient agreement with Habitat, in the amount of $886,345, to implement the project. This agreement funds infrastructure costs for the new construction of HOME-assisted housing units located on Habitat’s Whippoorwill development in Naples. These units will be sold to eligible families and households, that income qualify at-or-below 80% of Area Median Income. Amendment #1 was approved by the Board on March 22, 2022, Agenda Item #16.D.6, and corrected a typographical error and increased the match commitment. Amendment #2 was approved by the Board on November 8, 2022, Agenda Item #16.D.6, and. updated the UEI number, period of performance, monitoring end date, performance deliverable due dates, subrecipient contact, and custodian of public records. Amendment #3 was approved by the Board on May 23, 2023, Agenda Item #16.D.2, and revised the number of HOME-assisted units and extended the agreement date. The proposed Amendment #4 will revise the address of the principal office of the subrecipient, clarify language regarding the scope of work in reference to the number of HOME -assisted units changing the requirement that the sub-recipient construct 52 unites to 10 HOME assisted units for income-eligible households, clarify the affordability period to increase the period from 10 years to a maximum of 15 years depending on the amount assisted per unit, strikeout rental rehabilitation information, and update County contact information. Pursuant to CFR 92.250 all HOME-assisted projects must be underwritten and meet the subsidy layering requirements. The HOME Program permits the funding of one or more units in a project, including mixed -income and mixed-use properties. However, HOME funds may only be used to pay eligible costs for HOME -assisted units. To align the agreement with the funds awarded and remain compliant with HUD HOME regulations, it is necessary to revise the number of units to clarify which are HOME-assisted. The total number of HOME-assisted units is ten (10) which was reduced from 52 units being constructed by the sub-recipient. FISCAL IMPACT: The proposed action has no new Fiscal impact. Funds are budgeted within HOME Investment Partnerships Program (1835), Projects (33480, 33581, and 33632). LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - DDP 16.D.5 Packet Pg. 1555 06/11/2024 GROWTH MANAGEMENT IMPACT: This item has no impact on the Housing Element of the Growth Management Plan of Collier County.
