EXECUTIVE SUMMARY
*** This item continued from the May 14, 2024, BCC Meeting. *** Recommendation to approve final
acceptance of the sewer utility facilities, accept the conveyance of the sewer utility facilities and appurtenant
utility easement for Seychelles - Offsite Utilities Relocation (PL20240001240), and Seychelles - Offsite
Utilities (PL20190001953), and to authorize the County Manager or designee to release the Final Obligation
Bond and the Utilities Performance Security (UPS) in the total amount of $9,957.64 that was submitted for
PL20190001953, to the Project Engineer or the Developer’s designated agent.
OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier
County Water-Sewer District, approve final acceptance of these sewer utility facilities, accept the conveyance of the
sewer utility facilities and appurtenance utility easement, and release the Utilities Facility Performance Security
(UPS) in the total amount of $9,957.64, accordance with the Collier County Utility Standards and Procedures,
Ordinance No. 2004-31.
CONSIDERATIONS:
1) The Developer of Seychelles - Offsite Utilities Relocation and Seychelles - Offsite Utilities has constructed the
sewer utility facilities within dedicated easements to serve this development (see attached location map). The
sewer utility facilities were offered for conveyance to the County, as described in Official Records (O.R.) Book
6362, Page (PG) 2105, together with appurtenant Deed of Utility Easements recorded in O.R. 6323, PG 1171;
O.R. 6089, PG 3665; O.R. 6089, PG 3662; O.R. 6113, PG 385; O.R. 6113, PG 388; O.R. 6100, PG 2325, O.R.
6189, PG 3132, O. R. 6100, PG 2328, and O.R. 6089, PG 3672, of the Public Records of Collier County,
Florida. The total value of these sewer utility facilities (assets) was $31,086.59 (See attached asset sheet).
2) The Development Review staff approved Preliminary acceptance of these utility facilities on November 18,
2019.
3) Staff recorded all acceptance documents associated with the sewer utility facilities conveyed to the County in
the public records of Collier County, which were reviewed and approved by the County Attorney’s office as to
form and legality. The county acquired its interest in the sewer utility facilities through the warranty deed and
bill of sale recorded in O. R. Book 6362, PG 2105 of the Public Records of Collier County, Florida (“The
Utilities Facilities Deed”).
4) The sewer utility facilities have been operated and maintained during the required one (1) year warranty period
following preliminary acceptance.
5) Staff conducted a final inspection on February 26, 2024, in coordination with Public Utilities, to discover
defects in materials and workmanship, and these facilities have been found to be satisfactory and acceptable.
6) Staff recommends final acceptance of the subject sewer utility facilities in the total amount of $31,086.59. Staff
also recommends acceptance of the Utilities Facilities Deed and the facilities described in the Certification of
Contributory Assets, which are attached to this Executive Summary.
7) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended.
8) Staff is unaware of any issues that would serve to negate the recommendation to approve this final acceptance.
FISCAL IMPACT: Approval of this Executive Summary will result in the Collier County Water-Sewer District
receiving title to the sewer utility facilities, which have a gross value of $31,086.59 (no depreciation applied), and
an asset will be recorded in the financial records of the county.
GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote
for Board approval. -DDP
RECOMMENDATION: To approve final acceptance of the sewer utility facilities, accept the conveyance of the
