EXECUTIVE SUMMARY
Recommendation to adopt the attached Resolution in opposition to Amendment 4 titled as an Amendment to
Limit Government Interference with Abortion, which if enacted would amend the Florida Constitution to
greatly enhance abortions in Florida.
OBJECTIVE: To adopt the attached Resolution in opposition to Amendment 4.
CONSIDERATIONS: Amendment 4, titled as “Amendment to Limit Government Interference with Abortion”,
would amend the Florida Constitution as follows:
The ballot initiative would add a new section to Article I of the Florida Constitution. The following underlined text
would be added to the Constitution:
Limiting government interference with abortion.- Except as provided in Article X, Section 22, no
law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect
the patient’s health, as determined by the patient’s healthcare provider.
The amendment is scheduled to be on the November 5, 2024, ballot in Florida.
The amendment would provide a constitutional right to abortion before fetal viability (not clearly defined) or when
necessary to protect the patient's health, as determined by the patient's healthcare provider (not defined at all).
The initiative purportedly would not change the state legislature's authority to enact a law requiring the parents of a
minor to be notified if their child is seeking an abortion, with exceptions that can be attained through a judicial
waiver.
I believe that Amendment 4 is vague, deceptive, and overbroad. As there is already a legislative process,
representing the people of Florida and established by our Florida legislators which protects life, it is necessary to
educate voters who may not fully understand the extreme impact of Amendment 4. This amendment would strike
already enacted protections instituted by Florida, by broadening the definition of healthcare providers to those not
medically licensed, eliminating parental consent for minors, and allowing the life of the unborn to be taken right up
to the moment of birth. Therefore, because of the wide removal of sensible protections, I believe Amendment 4
would be detrimental to Collier County and the State of Florida, and request that the Board adopt the attached
Resolution in opposition to Amendment 4.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues at this
time and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board adopt the attached Resolution in opposition to Amendment 4.
