FIRST AMENDMENT TO AGREEMENT No. 23-8061R
FOR
HVAC MAINTENANCE AND REMEDIAL REPAIRS
THIS FIRST AMENDMENT is made and entered into on thisZB day of Ma 2024,
by and between B&I Contractors, Inc. (the "Contractor") and Collier County, a political ubdivision
of the State of Florida, (the "County" or"Owner") (collectively, the "Parties"):
WHEREAS, on August 22, 2023 (Agenda Item No. 16.F.3), the County entered into
Agreement No. 23-8061R "HVAC Maintenance and Remedial Repairs" (the "Agreement") with the
Contractor to provide for maintenance and repair services for County-owned mechanical systems; and
WHEREAS, due to increased costs of parts and materials, the Parties desire to amend the
Agreement to increase the not-to-exceed amount for single repair projects.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein
contained, it is agreed by the Parties as follows:
1. The above recitals are hereby incorporated into this First Amendment as if fully set forth herein.
2. Paragraph 2.1 of the Scope of Services is hereby amended as follows:
"2.1 Upon request,maintenance and/or repair services shall be provided and billed per labor rates
on the Exhibit B Fee Schedule. No single repair project shall exceed 85000 $100,000."
3. All other terms and conditions of the Agreement, as previously amended, shall remain the same.
