Agenda 05/28/2024 Item #16F 8 (Award Invitation for Qualification "HVAC Replacement and Installation Services to Ameresco, Inc and United Mechanical, LLC)05/28/2024 EXECUTIVE SUMMARY Recommendation to award Invitation for Qualification No. 23-8123, “HVAC Replacement and Installation Services,” to Ameresco, Inc., and United Mechanical, LLC, and to authorize the Chairman to sign the attached Agreements. OBJECTIVE: To obtain HVAC Replacement and Installation Services in a fair and competitive manner in accordance with the Procurement Ordinance. CONSIDERATIONS: The Facilities Management Division oversees the maintenance of county-owned and leased buildings and facilities, which includes managing the HVAC equipment at such locations and engaging contractors to ensure proper HVAC replacements and installations. On July 6, 2023, the Procurement Services Division released notices for Invitation for Qualification (“IFQ”) No. 23-8123, HVAC Replacement and Installation Services. The County received three proposals by the September 6, 2023 deadline. Staff determined one proposal non-responsive and non-responsible as shown in the below chart. Staff recommends issuing contracts to both responsive and responsible contractors and, as indicated in the solicitation, will be requesting quotes from both firms for all work. Ameresco, Inc., has been registered to transact business in Florida since 2000. In 2021, Ameresco, Inc., acquired Plug Smart, an awarded vendor under the previous solicitation No. 18-7313. United Mechanical, LLC, formerly known as United Mechanical, Inc., incorporated in Florida in 2020 and was also an awarded vendor under the prior solicitation. Importantly, there were no performance issues reported as to either of those vendors during their previous contracts for these services. FISCAL IMPACT: The historical spend for these services was, on average, $400,000.00 per contract year during the previous contract, which began July 10, 2018. Funding for this contract is available within the various maintenance projects within the County-wide Capital Project Fund 3001. Other County Manager Divisions utilizing this contract will provide funding from their respective budgets. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. The Contractor(s), at a minimum, must achieve the requirements of the Specifications or Scope of Work stated. The results of this solicitation may be used by other Collier County departments once awarded according to the Board of County Commissioners Procurement Ordinance. The County is soliciting the most qualified Contractor(s) for an annual contract for heating, ventilation, and air conditioning (HVAC) replacements, and new installations. Work may include HVAC and/or energy management services for construction, retrofit, and/or maintenance services on any county facility involving any of the systems, services, or products. Historically, county departments have spent approximately, on average, four hundred thousand dollars ($400,000) annually for these services over the life of the current contract., however, this may not be indicative of future buying patterns. Collier County, located in southwest Florida, is the largest county by land area in the state. The county seat is in East Naples, where the county offices were moved from Everglades in 1962. The county area is over 2,300 square miles with an estimated population of over 375,000. The county has experienced steady growth over the past few years through visitors and residents alike. Thus, the infrastructure and county facilities will continue to expand to meet the needs of the county. The county owns 878 buildings of various uses comprising more than 4.8 million sf of gross floor area, of which 145 buildings and 3.7 million sf are under air conditioning. Systems and equipment vary widely, some facilities are served by a central chiller plant, others are served by packaged rooftop units, and others are served by split-system units, and/or a combination of any of the foregoing. Facilities include office buildings, public meeting spaces, park facilities, swimming facilities, secure facilities, detention facilities, and public utility infrastructure, among others. Control systems range from integrated building automation systems with central monitoring to independent localized thermostatic control. The contract term, if an award(s) is/are made is intended to be for three (3) years with one (1) two (2) year renewal option. Prices shall remain firm for the initial term of this contract. Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. The County Manager, or designee, may, at his discretion, extend the Agreement under all of the terms and conditions contained in this Agreement for up to one hundred eighty (180) days. The County Manager, or designee, shall give the Contractor written notice of the County's intention to extend the Agreement term not less than ten (10) days prior to the end of the Agreement term the n in effect. All goods are FOB destination and must be suitably packed and prepared to secure the lowest transportation rates and to comply with all carrier regulations. Risk of loss of any goods sold hereunder shall transfer to Collier County at the time and place of delivery, provided that risk of loss prior to actual receipt of the goods by Collier County nonetheless remains with Contractor. INTRODUCTION BACKGROUND TERM OF CONTRACT 16.F.8.a Packet Pg. 1939 Attachment: 23-8123 Solicitation (28866 : Award Invitation for Qualification (“IFQ”) No. 23-8123, HVAC Replacement & Installation Services) Section 1. The awarded Contractor(s) shall use qualified technicians to complete all work in accordance with the requirements specified in the Scope. Technician credentials may be requested by the Division. The technicians shall be experienced in all facets of HVAC systems and related control systems. Experience shall include, but not be limited to the following work: 1. Installation, maintenance, test, and balance of chiller water and air handlers, and operation of all related systems. 2. The Contractor(s) shall be competent in the replacement and installation of equipment including, but not limited to: chillers, pumps, cooling towers, heat exchangers, boiler plants, smoke-evacuation systems, direct cooling systems, constant and variable volume airside systems, variable primary/ secondary/tertiary hydronic systems, thermal storage, packaged DX systems, split DX systems, exhaust fans, dehumidification systems, dedicated outside air systems, variable refrigerant systems, and computer room air- conditioners. 3. When the Division adds, repairs, or replaces HVAC equipment, the mechanical and control work must interface with the existing front-end controller. The Contractor(s) shall evaluate the control needs based on the scope of the project, functionality controls, and the age of the equipment. The existing front-end controller is Reliable Controls. Therefore, the qualified Contractor(s) must be familiar with this system and must be competent in HVAC b uilding automation system integration. All new controls will be BTL Certified and native BACnet protocol devices. All new and existing controllers shall be integrated via open BACnet protocol hardware and software tools into the existing controls system and existing dashboard. 4. The Contractor(s) shall furnish all necessary qualified labor, materials, equipment, tools, consumables, transportation, skills, and incidentals required for the services requested. All work, equipment, parts, and materials not sp ecified in project plans and specifications must then meet Collier County Vertical Standards/Facilities Master Specs and the Florida Building Code (FBC). If any work, equipment, parts, and materials are not addressed in the project plans and specifications or Collier County Vertical Standards/Facilities Master Specs, approval by the Collier County Project Manager shall be required. 5. Contractor(s) must ensure proper installation of all HVAC equipment, per manufacturer’s instructions, relevant standards and/or guidelines. 6. Contractor(s) must provide and install any control system components necessary to provide the Division with a fully functioning system. Division must have sufficient control of all components after construction and must have the ability to obtain status updates, alarms/alerts, history/trend data logs, and generate reports of all new components installed/repaired by Contractor(s). 7. Training associated with new equipment for O&M as required, as well as necessary literature. 8. Work of similar nature and not specifically outlined above. Section 2. Minimum Qualifications 1. Contractor(s) shall be State of Florida registered and maintain a current Mechanical Contractor’s license, and certifications per Florida Statutes 489.105, throughout the life of the contract. 2. The Contractor's technicians shall have at least an EPA Section 608 Type II CFC Certification. Section 3. Procedures for Distribution of Work The Contractor(s) awarded an assignment shall perform on the site, and with its own organization, work equivalent to at least fifty- one percent (51%) of the total amount of work to be performed under the assignment. This percentage may be reduced if, while performing the work, the Contractor(s) requests a reduction, and the Collier County Project Manager determines that the reduc tion would be in the best interest of Collier County. All awarded Contractors are expected to submit quotes for each Request for Quotation that will be issued under the resultant contract, for the duration of the contract. Repeatedly failing to submit a quote, when requested, may result in the removal of the awardee from the contract pool. DETAILED SCOPE OF WORK 16.F.8.a Packet Pg. 1940 Attachment: 23-8123 Solicitation (28866 : Award Invitation for Qualification (“IFQ”) No. 23-8123, HVAC Replacement & Installation Services) 3.1 For all projects with a value up to $500,000, the procedure for obtaining quotes from the awarded Contractors is outlined below: 1. A Summary of Work and a Request for Quotation will be sent to all the selected Contractors. Completion time and the collection of liquidated damages may be specified in the Request for Quotation. 2. The Division’s Project Manager will set the required response time for each project, but the Contractors will be given a minimum of ten (10) business days to provide a quote. Other projects may require a longer quoting period to allow for proper coordination. This period may also include a pre-bid meeting. 3. The County may negotiate terms and conditions of the Scope of Work. 4. The County’s Project Manager will review all quotes received by the given due date and may negotiate with the Contractor who submits the lowest quote, if outside the budget. 5. Payment and Performance Bonds will be required for projects over $200,000 and shall be provided within ten (10) business days after notification of intent to award. 6. Contractor will commence work upon the County’s issuance of a Notice to Proceed/Purchase Order. The Contractor agrees that any Purchase Order that extends beyond the expiration date of the resultant contract will survive and remain subject to the terms and conditions of the resultant contract until the completion or termination of work. The County reserves the right to waive any or all of these requirements and to separately solicit any job if it’s in the best int erest of the County. The County reserves the right to supply all necessary parts for selected projects and repairs. Projects exceeding the $500,000 threshold will be formally solicited. 3.2 Price Methodology. The Contractor will be compensated for a lump sum, unit price, and time and material not to exceed (T&M NTE) work, as applicable, including material and specialty equipment markup. The markup for subcontractors shall not exceed 15%. The markup for materials and rental equipment shall not exceed 10%. All T&M NTE work will utilize a fee schedule. Fee schedule rates, which are subject to additions or deletions, will be negotiated with the awarded Contractors and will be added to the contract for utilization. For all T&M NTE work, Contractor(s) shall be required to provide backup documentation of the Contractor’s time and proof of the subcontractor services and/or parts/materials/ equipment/rental equipment by providing invoices and receipts at the time of invoice submission . Ancillary charges may be transferred to the County in the actual amount; however, mark-ups will not be allowed. Mark-ups will not be allowed on freight, sales tax, consumer fees or taxes, use, and other similar taxes or fees associated with any work under the resultant contract. Section 4. Non-Urgent Work Work will be performed during normal business hours Monday through Friday, 7:00 AM to 5:00 PM, but shall not interfere with County operations. In some cases, work may be limited to after-hours and weekends. Project schedule shall be approved by the Division Representative or designee. Section 5. Urgent Work Urgent work shall be defined as any work that is not scheduled. 24 -hour availability is needed to complete on-call urgent work. Urgent work will be completed on a rotating schedule with one (1) Contractor designated for a one (1) week period. Each awarded Contractor shall supply all County departments utilizing the resultant contract with a minimum of two (2) twenty -four (24) hour urgent contact phone numbers. All Contractors must participate in the urgent work rotation, which will be equally divided among the awarded Contractors. The annual schedule will be developed at a meeting with all awarded Contractors at the beginning of the contract term, and annually thereafter. The Facilities Management Division will manage and maintain rotation schedules such that three (3) months of future assignments are accessible to all Contractors. Urgent work requests require telephone or email acknowledgment of the request within two (2) hours. Contractor must provide a Time and Materials Not to Exceed (T&M NTE) quote within 24 hours of the visit and also provide a schedule to complete require d repairs. The County may require the Contractor to secur e damaged work area via a temporary repair. Should a Contractor fail to respond to an urgent call the next Contractor in rotation shall be contacted. Any failure to provide coverage by a Contractor , may be subject to termination. Section 6. General Requirements The selected Contractor(s) is to provide assurances of quality work throughout the project phases and maintain records of work and costs. 16.F.8.a Packet Pg. 1941 Attachment: 23-8123 Solicitation (28866 : Award Invitation for Qualification (“IFQ”) No. 23-8123, HVAC Replacement & Installation Services) 1. During construction, the selected Contractor(s) must provide: • Oversight of construction to ensure quality of work that is compliant with any relevant industry standard and/or guideline. • Contractor(s) to ensure work matches the design. If any changes are made to the design, they must be approved by the Design Professional, Collier County Project Manager, and clearly documented. • Supplemental drawings, when required. • If the Contractor(s) is to use any subcontractors during construction, the Contractor(s) shall be fully responsible to ensure that the subcontractors have sufficient insurance, licenses, certification, etc. for work with the Division. • Measurement and Verification upon completion. 2. The Contractor(s) shall not remove any equipment containing a Collier County asset sticker unless r equested by Division Representative or designee. The Contractor(s) shall request that, when replacing equipment, the asset sticker be removed by a Division staff member authorized to adjust the equipment inventory records. The Contractor(s) will place asset stickers on the equipment, as necessary for no charge. 3. Contractor(s) must provide disposal and recycling of all equipment and materials, including any existing systems that may be removed and/or replaced 4. Upon close out of the project, manufacturer/labor and extended warranties will be provided to the Division. 1.1 The Proposers will submit a qualifications proposal which will be scored based on the criteria in Grading Criteria for Development of Shortlist, which will be the basis for short-listing firms. The Proposers will need to meet the minimum requirements outlined herein in order for their proposal to be evaluated and scored by the COUNTY. The COUNTY will then grade and rank the firms and re commend multiple firms to establish a library for services needed. The COUNTY reserves the right to issue an invitation for oral presentations to obtain additiona l information after grading and before the final ranking. A contract will be developed with the selected firms, based on their qualifications and scope of services, and submitted for approval by the Board of County Commissioners. 1.2 The COUNTY will use a Selection Committee in the Invitation for Qualification selection process. 1.3 The intent of the scoring of the proposal is for respondents to indicate their interest, relevant experience, financial capability, staffing, and organizational structure. 1.4 The intent of the oral presentations, if deemed necessary, is to provide the Proposers with a venue where they can conduct discussions with the Selection Committee to clarify questions and concerns before providing a final rank. 1.5 Based upon a review of these proposals, the COUNTY will rank the Proposers based on the qualifications, discussion, and clarifying questions, and recommend multiple firms in a pool for quoting services. GRADING CRITERIA FOR DEVELOPMENT OF SHORTLIST: 1.6 For the development of a shortlist, this evaluation criterion will be utilized by the COUNTY’s Selection Committee to score each proposal. Contractors are encouraged to keep their submittals concise and to include a minimum of marketing materials. Proposals must address the following criteria: Evaluation Criteria Maximum Points 1. Local Vendor Preference 10 Points TOTAL POSSIBLE POINTS 100 Points Tie Breaker: In the event of a tie at final ranking, award shall be made to the proposer with the lower volume of work previously awarded. Volume of work shall be calculated based upon total dollars paid to the proposer in the twenty-four (24) months prior to the IFQ submittal deadline. Payment information will be retrieved from the County’s financial system of record. The tie-breaking procedure is only applied in the final ranking step of the selection process and is invoked by the Procurement Services Division Director or designee. In the event a tie still exists, selection will be determined based on random selection by the Procurement Services Director before at least three (3) witnesses. Each criterion and methodology for scoring is further described below. INVITATION FOR QUALIFICATION (IFQ) PROCESS 16.F.8.a Packet Pg. 1942 Attachment: 23-8123 Solicitation (28866 : Award Invitation for Qualification (“IFQ”) No. 23-8123, HVAC Replacement & Installation Services) EVALUATION CRITERIA NO. 1: COVER LETTER/MANAGEMENT SUMMARY (5 Total Points Available) Provide a cover letter, signed by an authorized officer of the company, indicating the underlying philosophy of the company providing the services stated herein. Include the name(s), telephone number(s), and email(s) of the authorized contact person(s) concerning proposal. Submission of a signed proposal is Contractor’s certification that the Contractor will accept any awards as a result of this IFQ. EVALUATION CRITERIA NO. 2: CERTIFIED WOMAN AND/OR MINORITY BUSINESS ENTERPRISE (5 Total Points Available) Submit certification with the Florida Department of Management Service, Office of Supplier Diversity as a Certified Woman and/or Minority Business Enterprise. EVALUATION CRITERIA NO. 3: EXPERIENCE AND CAPACITY OF THE BUSINESS (40 Total Points Available) In this criterion, include but not limited to: Provide information that documents your company’s qualifications to produce the required deliverables: • Contractors shall have documented experience with multiple building facilities and various types of county or municipality facilities such as corrections, administration, maintenance, library, operations, recreational and educational facilities. • How many installations crews does your business have? • What licenses does your staff maintain and how many are licensed? • How many years of experience does your business have with replacements and new installations (please break down by commercial and residential)? • How many new installation projects has your company completed in the last year and what was the total project cost? The County requests that the proposer submits a minimum of five (5) completed reference forms from clients (during the last five (5) years) whose projects are of a similar nature to this solicitation as a part of their proposal. Provide information on the projects completed by the contractor that best represent projects of similar size, scope, and complexity of this project using the Reference Questionnaire form provided. With each reference, please include a brief description of the HVAC replacement and new installation projects including start date, end date, original budget, and final project cost. It is preferable that the example projects include some of the following systems/sequences: chiller/boiler plants, smoke-control, district cooling systems, constant and variable volume airside systems, variable primary and primary/secondary/tertiary hydronic systems, thermal storage, packaged DX systems, split DX systems, exhaust fans, dehumidification systems, dedicated outside air systems, variable refrigerant systems, and computer room air -conditioners. Proposers may include two (2) additional pages for each project to illustrate aspects of the completed project that provides the information to assess the experience of the Proposer on relevant project work. EVALUATION CRITERIA NO. 4: SPECIALIZED EXPERTISE OF TEAM MEMBERS (40 Total Points) In this criterion, include but not limited to: • Description of the proposed contract team and the role to be played by each member of the team. Please include the following information for each team member: • number of years of experience with commercial equipment. • certifications (minimum Type II CFC Certification). • licenses, if any. • Copies of the following: • State of Florida registration. • Mechanical Contractor’s license. • The Contractor's technicians EPA Section 608 Type II CFC Certification. • Attach brief resumes of all proposed project team members who will be involved in the management of the total package of services, as well as the delivery of specific services. EVALUATION CRITERIA NO. 5: LOCAL VENDOR PREFERENCE (10 Total Points Available) Local business is defined as the vendor having a current Business Tax Receipt issued by the Collier or Lee County Tax Collector prior to proposal submission to do business within Collier County, and that identifies the business with a permanent physical business address located within the limits of Collier or Lee County from which the vendor’s staff operates and performs business in an area zoned for the conduct of such business. The HVAC for the building is made up of a chilled water system containing 2 air-cooled chillers, pumps, (9) major AHUs, (114) VAV boxes, (14) unit heaters, and a complex smoke control system. When the two aging chillers began to fail, Ameresco (previously Plug Smart) won the request for proposal and was selected as the company to replace them. The project entailed leaving the hurricane protection lattice in place above the chillers, requiring them to be removed and replaced by rigging and subsequent crane work. The electrical system was updated, and new energy meters were installed to determine the total energy consumption of the plant. It has a large central plant with 2 centrifugal chillers and a cooling tower system. The Hilton had constant problems with maintaining the correct temperatures in specific areas and reached out for help. The healthcare system consists of two hospitals: the Baker Hospital located in downtown Naples and the North Naples campus. Ameresco (previously Plug Smart) has had a long-term relationship with the Naples Community Hospital System since 2014. NCH regularly hires Ameresco for HVAC upgrades, replacements, and improvements. The project in reference entailed Ameresco (previously Plug Smart) being hired to replace two major Air Handling Units that provided conditioned air to the entire south tower patient rooms of the Baker Hospital.
