EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners determine a valid public purpose and authorize
payment, not to exceed $3,750, for Collier County Planning Commissioner Joseph Schmitt, to attend the
Florida Chamber of Commerce 38th-41st Annual Environmental Permitting Summer School, an Annual
Environmental Permitting Seminar for the dates of July 2024- July 2027.

OBJECTIVE: To have the Board of County Commissioners determine a valid public purpose and authorize
payment for Collier County Planning Commissioner Joseph Schmitt, to attend the Florida Chamber of Commerce
Annual Environmental Permitting Summer School.
CONSIDERATIONS: Section 250-33(c)(3) of the Code of Laws (special act) provides:
“(3) Members of a planning commission may receive salary and such travel and other expenses while on official
business for the commission as are made available by the governing body for these purposes.” In addition, Section
2-1160 of the Code of Laws (regarding the Planning Commission) provides: “The members of the Planning
Commission shall serve without compensation, but may be reimbursed for such travel, mileage, and/or per diem
expenses as may be authorized by the BCC.”
Section 106-1(f) of the Code of Laws (regarding the land planning agency) provides:
“(f) Compensation. The members of the local planning agency shall serve without compensation but may be
reimbursed for such travel, mileage, and/or per diem expenses as may be authorized by the BCC. The BCC shall
appropriate funds at its discretion to the local planning agency for expenses necessary in the conduct of its work.
The local planning agency may, to accomplish the purposes and activities required by the Local Government
Comprehensive Planning and Land Development Regulation Act (F.S. § 163.3161 et seq.), expend all sums so
appropriated and other sums made available for use from fees, gifts, state or federal grants, state or federal loans,
and other sources; provided, acceptance of loans or grants must be approved by the board of county
commissioners.”
PUBLIC PURPOSE: The Collier County Planning Commission (CCPC) sits as the Environmental Advisory
Council (EAC) which is an advisory board to the BCC. In accordance with Section 2-1157 of the Collier County
Code of Laws and Ordinances, Planning Commissioner Joseph Schmitt was specifically appointed to fill one of the
two CCPC membership positions that are required to provide environmental technical expertise. This provision
specifically requires that these two CCPC members provide the Planning Commission with technical expertise on
environmental matters, and shall demonstrate evidence of expertise in one or more of the following areas related to
environmental protection and natural resources management that includes the following:
• Biology (including botany, ecology, zoology, etc.).
• Coastal processes, estuarine processes, hazardous waste, hydrogeology.
• Pollution control, solid waste, stormwater management, water resources, wildlife
management, or other representative area deemed appropriate by the BCC, with a
Board preference for one of these members with expertise in biology and/or
wildlife management, and the other with expertise in water and/or hydrology.
As Mr. Schmitt’s role on the Planning Commission is to provide environmental technical expertise, his attendance
at the Environmental Resource Permitting Seminar would be in support of his activities on the CCPC/EAC. This
seminar is comprised of 10 sessions. At each session, there are between 6-9 course choices providing insight into
the regulatory, planning, and water supply development programs of Florida’s five water management districts that
include Collier County. Other courses involve water resource development and water supply planning that can
assist in developing land use regulations for the County. This seminar will also include updates on environmental
permitting and enforcement that can have a direct bearing on the CCPC as the local planning agency and in their

role as the County’s Environmental Advisory Council. The relevant classes include the following topics:
• Linking Growth with Water Supply Availability
• Comprehensive Planning and Growth Management Update
• Federal Environmental Regulation and Enforcement Update
• Strategic Planning and Permitting for Development
• WMD Planning, Regulatory, and Policy Update
• FDEP Regulatory and Policy Update
• Improving Coastal Resiliency in Response to the Threats of Sea Level Rise and
Climate Change
It should also be noted that Mr. Schmitt is employed by an environmental consulting firm that does business in
Collier County and that he may have a proprietary interest in the environmental consulting firm.
FISCAL IMPACT: The estimated registration fee up to $750 per year for a total not to exceed $3,750 from 2024-
2027 is paid from the Collier County Planning Commissioner’s travel budget, Fund 1014 Cost Center 138326.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and
legality and requires a majority vote for Board approval. -JAK
RECOMMENDATION: To approve a payment, in the amount of approximately $750 annually not to exceed
$3,750, for Planning Commissioner Joseph Schmitt to attend the Florida Chamber of Commerce 38 th-41st Annual
Environmental Permitting Summer School, an Environmental Permitting Seminar for the dates of July 16-19, 2024,
through July 2027 once a year, a function serving a valid public purpose.

Continuing Education
FLORIDA BAR – Summer School participants
will have the opportunity to earn Continuing
Legal Education credits through the Florida
Bar’s Designation Plan. The summer school has
RECEIVED approval for 20 hours of general
credit, plus an additional 5 credits for those
attending the “early bird” discussion session
“B” in the area of ethics (2.5 credits) and
technology (2.5 credits). Course number and
details on receiving these credits will be listed
in the conference program which will be
distributed to attendees at the conference.
ENGINEERS – Florida Environmental Network,
Inc. is an approved provider (0003339) of
continuing education credits for registered
engineers through the Florida Board of
Professional Engineers. Engineers can receive
20 PDHs by attending the Summer School
program. Applicable forms will be available at
the conference for those wishing to apply for
credit and instructions will be listed in the
conference program which will be distributed
to attendees at the conference. In addition, the

for continuing education (CE) credits through
the International Society of Technical and
Environmental Professionals, Inc. (INSTEP).
