EXECUTIVE SUMMARY
Recommendation to approve the release of five (5) code enforcement liens with an accrued value of
$1,145,600 for a reduced payment of $2,027.30 in code enforcement actions titled Board of County
Commissioners (BCC) vs. Lorraine Burgess and Lindell McFadden Case No. 2002080878 CEB 2003-016,
and BCC vs. Melissa Nicole Williams Case Nos. CEPM20160015272, CENA20160015273, and
CEV20160015274 relating to 246 Singletary, Folio 01134800201, Collier County, Florida.

OBJECTIVE: To have the Board of County Commissioners (Board) accept an offer to release code enforcement
liens with an accrued value of $1,145,600 for a reduced payment of $2,027.30 in relation to Code Enforcement
Board Case No. 2002080878 CEB 2003-016, and Special Magistrate Case Nos. CEPM20160015272,
CENA20160015273, and CEV20160015274.
CONSIDERATIONS: The Code Enforcement Board ordered the imposition of a lien against Lorraine Burgess and
Lindell McFadden in Case No. 2002080878 CEB 2003-016. The violation consisted of three mobile home
structures and one occupied travel trailer placed on village residential zoned parcels without the required Collier
County building permits. The lien was recorded in the Official Records on August 9, 2003, at O.R. Book 3365,
Page 1508, and on February 4, 2004, at O.R. Book 3495, Page 0761, in the amount of $4,430.45, of which
$1,130.45 was paid on February 14, 2024, leaving a balance of $3,100. Fines continued to accrue at 4,790 days of
accrued fines ($100 per day from July 25, 2003, through September 2, 2016), resulting in a total balance of
$482,300. The property was brought into compliance on September 2, 2016.
In Case No. CEPM20160015272, the Special Magistrate ordered an imposition of a lien against Melissa Nicole
Williams due to code violations consisting of flooring, walls, and ceiling in disrepair and broken or missing
bathroom fixtures and plumbing, and the kitchen sink plumbing in a state of disrepair. The lien was recorded in the
Official Records on November 22, 2017, at O.R. Book 5451, Page 0665, in the amount of $53,730.36, of which
$230.36 was paid on February 14, 2024, leaving the balance of $53,500. Fines continued to accrue at 1,973 days of
accrued fines ($250 per day from November 4, 2017, through March 30, 2023), resulting in a total balance of
$546,750. The property was brought into compliance on March 30, 2023.
In Case No. CENA20160015273, the Special Magistrate ordered an imposition of a lien against Melissa Nicole
Williams due to code violations consisting of litter and debris, including wood, metal, plastic, discarded appliances,
and other items throughout the property. The lien was recorded in the Official Records on November 22, 2017, at
O.R. Book 5451, Page 0667, in the amount of $25,430.13, of which $230.13 was paid on February 14, 2024,
leaving the balance of $25,200. Fines continued to accrue at 525 days of accrued fines ($100 per day from
November 4, 2017, through April 12, 2019), resulting in a total balance of $77,700. The property was brought into
compliance on April 12, 2019.
In Case No. CEV20160015274, the Special Magistrate ordered an imposition of a lien against Melissa Nicole
Williams due to code violations consisting of unlicensed and inoperable vehicles on the property. The lien was
recorded in the Official Records on November 22, 2017, at O.R. Book 5451, Page 0669, in the amount of
$12,830.13, of which $230.13 was paid on February 14, 2024, leaving the balance of $12,600. Fines continued to
accrue, at 525 days of accrued fines ($50 per day from November 4, 2017, through April 12, 2019), resulting in a
total balance of $38,850. The property was brought into compliance on April 12, 2019.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose a severe financial hardship on the owner.
Mr. Danny Daniels purchased the property via Tax Deed, recorded on February 11, 2021, at O.R. Book 5891, Page
1049. Permit # PRDM20220311765 was issued, and the residence was demolished.
Mr. Daniels has offered to pay $3,000 to settle the liens; however, Code Enforcement recommends following
Resolution 2023-90, Section (4), which states, “the lien shall be reduced to a sum not to exceed ten percent (10%)

of the assessed value of the property,” and accept payment of $2,027.30 based on ten percent of the Collier County
Property Appraiser’s Assessed Value of $20,273. There are no known violations at this time.
FISCAL IMPACT: The acceptance of a payment of $2,027.30 to settle the liens will correspond to what is
outlined in Collier County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form
and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in
Resolution 2023-90. RTT
RECOMMENDATION: To approve the recommended reduction of fines in the amount of $1,143,572.70, accept
payment in the amount of $2,027.30, release the liens, and authorize the Chairman to sign the attached releases and
satisfaction of liens for recording in the Official Public Records.

At no time was notice received of any non compliance from pre-€xisting lien #3, from the county. Once the
power trom the side of the house to a temporary pole, for which the permit was applied for and approved,
however the county insisted we must removed the temporary pole, which was not connecled to power but in
preparation to permit a new building, and apparently they continued the fines. Since obtaining ownership of
the property, il has only continued to improve. I would like to continue to do lhal and any help would be appreciated.

On site with Inv Asaro and 3 Deputies from
CCSO at their request to identify property
maintenance and common violation issues
inside and around dwelling and property. Inv
Asaro will be addressing all other issues with
the exception of the interior of the dwelling.
Entry consent was signed by one of the
female tenants and I along with CCSO was
allowed entry. While inside I observed 1 of 2
bathrooms in complete disrepair, wallboals
removed, fllorboards removed, no sink or
toilet. Tenant Joanne states she is in the
process of making repairs within the dwelling.
I also observed wood flooring that was not
stable throughout the dwelling, the floor
boards (plywood) were easily depressed
when stepped on. Also, the kitchen sink,
while operational drains onto the ground
below the structure. Photos have been

up to a week. At this point the dwelling
remains occupied and the violations remain, I

possession and will be applying for the permit
immediately. Once that is accomplished he
will notify myself and once issued he will
notify Cpt Godette to move forward with
