Agenda 05/28/2024 Item #16A11 (Discontinue the deferral of permitting fees related to permits submitted for Hurricane Ian damage)05/28/2024 EXECUTIVE SUMMARY Recommendation to discontinue the deferral of permitting fees related to permits submitted for Hurricane Ian damage. _____________________________________________________________________________________ OBJECTIVE: To discontinue the deferral of permitting fees related to permits submitted for Hurricane Ian damage. CONSIDERATIONS: At the October 11, 2022, post-Hurricane Ian, Board of County Commissioners (Board) meeting, as part of agenda item 11A, the Board gave direction to the Growth Management Community Development Department to allow the deferral of permitting fees for property owners applying for permits that had verifiable damage because of Hurricane Ian. The established process normally requires fees to be paid at the time of submission and before a permit can be issued. The deferral of the permitting fees for Hurricane Ian's damage was so permits could be issued quickly without any up front hard costs to the impacted property owners. Hurricane Ian permits were given a review time of three days so permits that qualified could be issued. This allowed work to begin without delay to get property owners back in their homes. Permit fees were to be paid in full when work was completed, all inspections passed, and any conditions resolved. A Certificate of Completion or Occupancy would be issued at that time. The option to defer fees for permits relating to Board-Declared Disasters is still available through the Fee Schedule, found on page 16, OO-Board Declared Disaster Provisions. The applicant would work with an intake Supervisor at the time of submittal to determine whether requirements are met, and the correct fee codes are applied to the permit. OO) BOARD DECLARED DISASTER PROVISIONS 1) When a disaster declaration is announced by the Collier County Board of County Commissioners, and Board-declared provisions are enacted by the Board, the permit application and plan review fees referenced in Sections L - Q and T (Zoning, Building, Structural, Electrical, Plumbing and Gas, Mechanical and Mobile Home/Other Trailer), and domestic water heaters, shall be reduced by 50%. The reduction applies only to Florida Building Code residential structures and mobile/manufactured homes that are considered primary residences, including their attached garages and carports. Excluded from the provision are all other structures not identified above or not within the Florida Building Code residential code, non-primary residences, damages to outbuildings, and accessory structures, including but not limited to sheds, detached carports, guest houses, and pool cages. Also excluded from this provision are inspection fees. 2) Eligibility criteria under the Board Declared Disaster Provisions are as follows: • Proof of ownership and occupancy as a primary residence • Damage assessment report from property’s insurance adjuster, Collier County Building Official, or authorized FEMA/FDEM representative • Photographs depicting declared disaster-related damage • Attestation that damage was caused by the declared disaster, signed by owner • Owner verification that no other monetary aid from the Collier County Board of County Commissioners has been or will be applied in relation to disaster relief 3) Eligible applicants will have 180 days following the Board's declaration of a disaster to apply for reduced fees. There will be an additional 90-day period beyond the initial 180 days for application, during which an eligible applicant who paid the full fees could apply for a refund of 50% of the applicable permit application and plan review fees. 16.A.11 Packet Pg. 338 05/28/2024 It has been 20 months since Hurricane Ian made landfall in Florida on September 28, 2022; the submittal of permit applications for damages from Hurricane Ian-related has decreased significantly, indicating that many permitted repairs and insurance claims are in process or have been completed. Staff is requesting that there is no longer a practical need to continue with the permitting fee deferral. FISCAL IMPACT: Extrapolating the data from Cityview reports, staff determined that approximately $143,893 in permit fees related to Hurricane Ian remain outstanding for collection. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -DDP RECOMMENDATION: To authorize the discontinuation of permit fee deferral related to Hurricane Ian damage permit applications.
