If there are questions concerning the above, please do not hesitate to contact our office. *The request for the time extension in the amount of 98 days is based on three main reasons: 1. The Design Development (60%) package's cost estimate came in approximately$9.2M higher than the Schematic Design estimate (30%). To address this, a round of value engineering (VE) was necessary, aiming to bring the estimated cost down to $49.9M. This change in estimated cost required notification to the Board of Collier County Commissioners. 2. The selected VE measures to reduce construction costs now need to be incorporated into the design. This process includes obtaining approval for a Change Order to execute the redesign associated with the VE. 3. In December 2020, the Environmental Protection Agency (EPA) transferred the responsibility of implementing Section 404 of the Clean Water Act from the U.S.Army Corps of Engineers (ACOE) to the Florida Department of Environmental Protection (FDEP), known as the State 404 Program. However, a federal judge ruled in favor of the Plaintiffs on February 15, 2024, overturning EPA's approval of FDEP's assumption of the program. Consequently, FDEP suspended processing all pending State 404 applications. Although ACOE has begun accepting Section 404 permit applications, the project site, the Collier County Behavioral Health Center, is not expected to RGArchitects,P.A. Nonetheless, the Design Team will proceed with the standard South Florida Water Management District(SFWMD) Environmental Resource Permit(ERP) process.This entails submitting a Dry Land Approved Jurisdictional Determination Form to ACOE, seeking confirmation that there are no jurisdictional waters of the United States on-site. The original June 24, 2024 deadline for project permitting on this site has been delayed by a minimum of six(6) months due to the pause in design review prompted by the case news and the subsequent hold status.Additionally, it may take several months to navigate the evolving process with ACOE.
