EXECUTIVE SUMMARY
Recommendation to approve a Resolution establishing an outdoor burning ban in the
unincorporated areas of Collier County in accordance with Ordinance No. 2023-38, as amended,
the Regulation of Outdoor Burning and Incendiary Devices during Drought
Conditions.
OBJECTIVE: That the Board of County Commissioners (Board) adopts the attached Resolution which
will enact an outdoor burning ban in accordance with (Ordinance No. 2023-38, as amended).
CONSIDERATIONS: On August 22, 2023, the Board adopted Ordinance No. 2023-38, revising the
Regulation of Outdoor Burning and Incendiary Devices during Drought Conditions Ordinance, for the
purpose of protecting public health, safety and welfare, and averting the destruction of real and personal
property caused by wildfires. In that the Board meets but twice a month, the revision enables the County
Manager, working with the Chair, to both declare and later rescind the burn ban.
Due to significant rainfall deficits in 2024, Southwest Florida is experiencing near drought conditions that
have resulted in multiple wildfires in eastern Collier County. As such, the Emergency Management
Division and the Collier County Fire Chiefs Association are recommending a ban on all outdoor burning
until such time as these severe drought conditions cease. The proposed Resolution implements the
provisions set forth in Ordinance No. 2023-38.
FISCAL IMPACT: There is no fiscal impact associated with this request.
LEGAL CONSIDERATIONS: The proposed Resolution was drafted by the County Attorney and is
legally sufficient for Board action. Although the County Manager has the authority to declare the burn
ban, in consultation with the Chair, given that the ordinance empowers the Sheriff to arrest violators, for
enforcement purposes the better practice is to hold a public hearing and have the Board declare the ban.
A majority vote is required for approval. - JAK
GROWTH MANAGEMENT IMPACT: There is no growth management impact related to this request.
RECOMMENDATION: That the Board of County Commissioners adopts the attached Resolution which
will establish an outdoor burning ban in unincorporated Collier County pursuant to Ordinance No. 2023-
38.
