Agenda 05/14/2024 Item #16B 8 (Change Order #6 under Professional Service Agreement #06-4000, Project #60168)05/14/2024 EXECUTIVE SUMMARY Recommendation to approve Change Order No. 6 under Professional Service Agreement No. 06-4000 with Jacobs Engineering, Inc., f/d/b/a CH2M Hill, Inc., adding 330 days and $234,100 for the Post Design Services Task for the "Vanderbilt Beach Road Extension from Collier Boulevard to 16th Street N.E.," and authorize the Chairman to sign the Change Order. (Project Number 60168) _____________________________________________________________________________________ OBJECTIVE: To modify the task for Post Design Services for Agreement No. 06 -4000 for the Vanderbilt Beach Road Extension from Collier Boulevard to 16th Street N.E. CONSIDERATIONS: On December 12, 2006 (Agenda Item 10.A), the Board approved Professional Service Agreement No. 06-4000 (the “Agreement”), with CH2M Hill, Inc., n/d/b/a Jacobs Engineering, Inc., (collectively, the “Design Consultant”) to complete the design of the Vanderbilt Beach Road Extension from Collier Boulevard to Desoto Boulevard. On April 4, 2008, the County issued the Design Consultant a suspension letter halting the completion of the design due to the economic downturn. On April 25, 2017 (Agenda Item 11.D), the Board approved staff’s recommendation to advertise a Notice of Intent to resume the Vanderbilt Beach Road Extension project. On December 12, 2017 (Agenda Item 11.D), the Board approved Amendment No. 1 to the Agreement for the Design Consultant to update and complete the design of the Vanderbilt Beach Road Extension project. Amendment No. 2 was approved on October 20, 2020, to include the design and permitting of a new 12 -inch water main from the North County Regional Water Treatment Plant to Valencia Trails, a new 12 -inch water main on Massey Street from Vanderbilt Beach Road to Mockingbird Drive, relocation of an existing wastewater force main, relocation of the wellfield’s Fiber Optic Conduit, and a minor design of fiber optic conduit as requested by Collier County IT Department. The construction agreement with SACYR Construction USA (VBR Extension contractor) was awarded on 7/12/22 (Item #11F). We did not effectuate a change order for post -design services at the time of the construction contract award, and this change order will align the post-design services with the actual construction duration. The construction agreement has been extended 173 days (Change Order #1, BCC Approval 3/26/24 Agenda Item #16.B.7). It is projected that during the next two years of work, the construction contract will be extended again due to weather conditions and holidays. Considering the extended construction contract time and the time necessary to certify, accept, and close out a project of this magnitude, the Engineer of Record has requested an extension of 330 days. Proposed Change Order No. 6 provides for a 330-day extension under the Agreement and an additional $234,100 to cover the extended Post Design Services during the construction of this project. Approval of Change Order No. 6 will allow the Design Consultant to remain on the Project until it is completed. Post Design Services during and after construction include answering Requests for Information, changes to design plans, approving shop drawings, and the required certifications of completion of construction. Below is a synopsis of the previously approved change orders associated with this project: 16.B.8 Packet Pg. 976 05/14/2024 Change Order/Amendment Summary CO# AMD# Description COST TIME Justification Additive (+) Deductive (-) Days Added New Amount 1 Add Services and scope to update the 60% plans and extend project limits. $3,901,850 1,825 1,825 Resume project after economic crisis, expand project limits and deliver revised scope in order to meet project capacity. 2 Additional funds requested to design several Public Utilities and County IT facilities. $380,440 0 Potential cost-saving measures, as well as avoiding disturbance of recently build Roadway facilities by designing and building PUD and IT facilities simultaneously with this project. 3 Additional funds requested due to design changes based on outcome of extension public involvement and Board of County Commissioners actions to modify design changes $885,345 0 If this change order is not approved, the public and commissioner approved changes on 9/25/18 (Item 11.A) and 10/22/19 (Item 11.F) cannot be completed by the consultant. 4 Additional funds requested due to plan reviews, changes to State Regulatory agencies requirement and additional infrastructure requirements $499,810 0 Not processing the change order will generate additional cost due to future construction cost escalation, throw away of redundant infrastructure, and disruption of the traveling public. 5 Add time to reflect prior changes, permitting process and construction duration estimate. $0 1,140 2,965 Time needed for Consultant to complete “Task V - Post-Design Services” of the Agreement. 6 Additional funds and time requested for Post-Design services $234,100 330 3,295 Funding and time needed for Consultant to complete “Task V - Post- Design Services” of the Agreement.
