EXECUTIVE SUMMARY
Recommendation to approve final acceptance of the potable water and sewer utility facilities and accept the
conveyance of the potable water, a portion of the sewer utility facilities, and the appurtenant utility easement
for Randall at Orangetree, PL20230015538.
OBJECTIVE: To have the Board of County Commissioners, as the Ex-Officio Governing Board of the Collier
County Water-Sewer District, approve final acceptance of the potable water and sewer utility facilities, accept the
conveyance of the potable water and a portion of the sewer utility facilities and appurtenant utility easement, in
accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31, as amended.
CONSIDERATIONS:
1) The Developer has constructed the potable water and sewer utility facilities for Randall at Orangetree within
dedicated easements to serve this development (see attached location map). The potable water and a portion of
the sewer utility facilities were offered for conveyance to the County, as described in Official Records (O.R.)
Book 6349, Page (PG) 1392, and are located within County utility easements dedicated by the plat of Randall
at Orangetree, recorded in Plat Book 72, Pages 45-49, and appurtenant Deed of Utility Easement recorded in
O.R. Book 6336, PG 3953, of the Public Records of Collier County, Florida. These potable water and sewer
utility facilities (assets) were valued at $230,788.87 and $556,008.66, respectively. The remaining sewer
utility facilities will be private.
2) Staff recorded all final acceptance documents associated with the potable water and sewer utility facilities
conveyed to the County in the public records of Collier County, which were reviewed and approved by the
County Attorney’s Office as to form and legality. The County acquired its interest in the potable water and a
portion of the sewer utility facilities by Warranty Deed and Bill of Sale recorded in O.R. Book 6349, PG 1392
(“the Utilities Facilities Deed”).
3) Staff conducted a final inspection on February 22, 2024, in coordination with Public Utilities to discover
defects in materials and workmanship, and these facilities have been found to be satisfactory and acceptable.
4) Staff recommends final acceptance of the subject potable water and sewer utility facilities in the total amount
of $786,797.53. Staff also recommends acceptance of the Utilities Facilities Deed and the facilities described
in the Certification of Contributory Assets, which is attached to this Executive Summary.
5) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended.
6) Staff is unaware of any issues that would serve to negate the recommendation to approve this final acceptance.
FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact. However,
approval of this Executive Summary will result in the Collier County Water -Sewer District receiving title to the
potable water and a portion of the sewer utility facilities, which has a total gross value of $786,797.53 (no
depreciation applied).
GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote
for Board approval. - DDP

THIS INDENTURE made this 21fh day of June,2l23,between RCDG Partners, LLC,aGeorgia limited
liability company (hereinafter referred to as "Grantor"), and the BOARD OF COUNTY
COMMISSIONE,RS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER
COL,NTY AND AS THE EX-OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER-
SEWER DISTRICT, its successors and assigns, (hereinafter referred to as "Grantee").
WITNESSETH:
That said Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other good and valuable
consideration to said Grantor in hand paid by said Grantee, the receipt whereof is hereby acknowledged,
has granted, bargained and sold to the said Grantee, and Grantee's heirs, successors and assigns forever, all
water and wastewater utility facilities and/or system(s) or portion(s) thereof lying in, on, over and under the
following described land, for operation, relocation, installation, repair and/or maintenance of said facilities,
system(s) or portion(s) thereof, all situate and lying and being in Collier County, Florida, to wit:
(See Exhibit "A" attached hereto and incorporated by reference herein.)
(Exhibit "B" attached hereto is a sketch or other graphic representation
that depicts the physical location of the utility systems being conveyed.)
and said Grantor does hereby fully warrant the title to said utility facilities and/or system(s) or portion(s)
thereof, be they realty, personalty, or mixed, and Grantor will defend such title against all claims of all
persons whomsoever. For the purposes of this conveyance, the utility facilities, system(s) and/or portion(s)
thereof conveyed herein shall not be deemed to convey any of the lands described in either exhibit. Grantor
and Grantee are used for singular or plural, as context allows. A sketch or other graphic representation
showing the location of the utility facilities, etc., being conveyed is attached as Exhibit "8".
TO HAVE AND TO HOLD the same unto the Grantee and its assigns, together with the right to enter upon
said land, excavate, relocate and/or take or introduce materials for the purpose of constructing, relocating,
