Recommendation to approve Petition VAC - PL20230005194, to disclaim, renounce, and vacate the County and the public interest in a portion of Preserve and Replant Area PA-79 and all of Preserve and Replant Area PA-86 of Vanderbilt Country Club- 2, as recorded in Plat Book 32, Pages 42 through 55, of the Public Records of Collier County, Florida, located approximately one-quarter mile east of County Road 951 (Collier Boulevard) and one-half mile north of Vanderbilt Beach Road, in Section 35, Township 48 South, Range 26 East, Collier County, Florida, and to accept Petitioner’s grant of a Conservation Easement to replace the vacated Preserve and Replant Areas. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of Preserve and Replant Area PA-79 and all of Preserve and Replant Area PA-86 of Vanderbilt Country Club-2, as recorded in Plat Book 32, Pages 42 through 55 of the public records of Collier County, Florida, in Section 35, Township 48 South, Range 26 East, Collier County, Florida and to accept Petitioner’s grant of a Conservation Easement to replac e the vacated Preserve and Replant Areas. CONSIDERATIONS: Petition VAC-PL20230005194 has been received, requesting to vacate a portion of Preserve and Replant Area PA-79 and all of Preserve and Replant Area PA-86 of Vanderbilt Country Club-2, as recorded in Plat Book 32, Pages 42 through 55, of the Public Records of Collier County, Florida, in Section 35, Township 48 South, Range 26 East, Collier County, Florida. This property is within the Vanderbilt Pines PUD, Ordinance No. 98-52, as amended. The purpose of this vacation request is to remove (0.42 acres +/-) from the Vanderbilt Country Club Golf Course area, easterly of Tract B, the Clubhouse property, in order to allow for improvements to be made while simultaneously providing a larger replacement (0.443 acres +/-) that is better situated and augments an existing conservation area. A portion of this area was part of the required preserve area for the PUD. The Vanderbilt Country Club is proposing to vacate and replace the existing Preserve Area 86 and part of Preserve Area 79. Preserve Areas 79 and 86 are small and disconnected from the other preserve areas in the club. The purpose of vacating and replacing those easements is to provide additional recreation space for the club's membership while replacing the preserve area in a location more advantageous for conservation land. By vacating the smaller preserve areas, the club will have space to expand the pool and build bocce courts in the vicinity of the clubhouse. The proposed plan keeps the recreational activities in a centralized area near the clubhouse while replacing the preserve area in a quieter location on the north part of the club, directly adjacent to the larger Conservation Area Easement #4. The proposed replacement easement is adjacent to an existing Conservation Area Easement #4, which is the largest conservation easement in the PUD. This PUD was created in 1998. Relocating some of these smaller preserve areas to create larger connected natural spaces is more consistent with the current LDC (3.05.07.A.5), which requires that “preservation areas shall be interconnected within the site and to adjoining off-site preservation areas or wildlife corridors.” This vacation will not result in a public detriment because the replacement conservation e asement will result in greater acreage than what is being removed. Also, this vacation will not affect the ownership or right of convenient access of persons owning other parts of the subdivision nor invade or violate individual property rights. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Community Development Department, Development Review Division staff has collected a $2,000 “Petition to Vacate” fee from the petitioner and deposited in the Developer Services Fund (1014), which covers the County’s cost of recording and processing the Petition. 17.A Packet Pg. 1336 04/09/2024 GROWTH MANAGEMENT IMPACT: No growth Management Impact is associated with this action. LEGAL CONSIDERATIONS: Petitioner is requesting to vacate a portion of Preserve/Replant Areas PA-79 and all of PA-86 of Vanderbilt Country Club-2, as recorded in Plat Book 32, Pages 42 through 55 of the Public Records of Collier County, Florida, as further described in Exhibit “A” to the attached Resolution. Pursuant to Resolution 2021-243 and Florida Statutes sections 177.101 and 704.06(4), the Board may adopt resolutions vacating public easements and plats in whole or in part of subdivisions in Collier County, returning the property covered by such plats either in whole or in part into acreage, when the following criteria are met: 1. The request is in the interest of the general public welfare, or no public detriment is established; 2. The request does not invade or violate individual property rights; 3. The Petitioner owns the fee simple title to the whole, or that part of the parcel sought to be vacated; and 4. The vacation will not affect the ownership or right of convenient access of persons owning other parts of the subdivision. Section 704.06(4), Florida Statutes, states that “[a] conservation easement may be released by the holder of the easement to the holder of the fee even though the holder of the fee may not be a governmental body or a charitable corporation or trust.” This item has been approved as to form and legality and requires a majority vote for Board approval. --DDP RECOMMENDATION: To approve the attached Resolution relating to Petition VAC-PL20230005194, vacating the County and the public interest in a portion of Preserve and Replant Area PA-79 and all of Preserve and Replant Area PA-86 of Vanderbilt Country Club-2, as recorded in Plat Book 32, Pages 42 through 55, of the Public Records of Collier County, Florida, in Section 35, Township 48 South, Range 26 East, Collier Coun ty, Florida, being more specifically shown in Exhibit “A,” to accept the Petitioner’s grant of a Conservation Easement to replace the vacated Preserve and Replant Areas, and direct the Clerk of Courts to record a certified copy of the Resolution in the Public Records and to make proper notation of this Resolution on the plat of Vanderbilt Country Club-2, as recorded in Plat Book 32, Pages 42 through 55, of the Public Records of Collier County, Florida. Grantor and Grantee may hereafter be collectively referred to as the "parties." WHEREAS, Grantor is the owner of that certain tract of land located in Collier County, Florida described in Exhibit "A" attached hereto (hereinafter referred to as the "Easement Property"); and WHEREAS, Collier County is requiring that this Conservation Easement ("Conservation Easement") be entered into and recorded in the land records of Collier County to bind Grantor; and WHEREAS, the parties wish to establish their respective rights and responsibilities relative to the use and maintenance of the conservation area upon the Easement Propefty. NOW, THEREFORE, Grantor hereby conveys a Conservation Easement to Collier County as follows: 1. Grantor, its successors, heirs, assigns and/or transferees, hereby grants a non- exclusive easement to Collier County over and across the Easement Propefty described on Exhibit "A" hereto for the purpose of conservation. Collier County shall have no responsibility for maintenance of the Conservation Easement. 2. No buildings, structures or impediments of any nature may be constructed, placed or permitted on, over or across the Easement Property. There shall be no removal or destruction of trees, shrubs or other vegetation with the exception of exotic/nuisance vegetation removal. Excavation, dredging or removal of soil material, peat, rock or other material substance in such a manner as to affect the surface shall be prohibited on the Easement Propety. No dikes or fencing shall be permitted on the Easement Propety. There shall be no other activities detrimental to drainage, flood control, water conservation, erosion control or fish and wildlife habitat conservation or preservation permitted on the Easement Propety. The Easement Property shall be in no way altered from its natural or permitted state. The following exceptions apply: a. Archaeological surveys or excavations are permissible for areas designated as archaeological sites by the State or Federal governments or by Grantee; or b. Uses as permitted by Section 3.05.07.H of the Collier County Land Development Code. In accordance with LDC Section 3.05.07.H.1.d, oil extraction and related processing operations are uses which are exempt from the restrictions herein and shall remain allowed uses on the lands described herein, provided it is an allowable use in the underlying zoning district. 3. Grantor, its heirs, successors or assigns shall bear the responslbility for maintaining the Easement Property, including, but not limited to, regular maintenance as may be required by any governmental agency having jurisdiction relative thereto. The Easement Property shall at all times be maintained in accordance with applicable requirements of the Collier County Land Development Code. 4. No right of access by the general public to any paft of the Easement Property is being conveyed. Collier County shall have the right to access and use of the Easement Property for the purpose of making inspections; however, Collier County shall have no obligation to maintain the Easement Property, nor shall Collier County have the right to use the Easement Property for any purpose inconsistent with the terms of this Conservation Easement. 5. Grantor reserves all rights as owner of the Easement Property, including the right to engage in uses of the Easement Propety that are not prohibited herein and which are not inconsistent with any County ordinance, regulation or development permit, and the intent and purposes of this Conservation Easement. 6. Grantor shall pay any and all real property taxes and assessments levied by competent authority on the Easement Property. 7. All notices, consents, approvals or other communications hereunder shall be in writing and shall be deemed properly given if sent by United States certified mail, return receipt requested, addressed to the appropriate paty or successor in interest. 10. This Conservation Easement shall run with the land and shall be binding upon and inure to the benefit of all present and future owners of any portion of the Easement Property and their successors and/or assigns, it being the intention of the Grantor that this Conservation Easement be perpetual. 11. If any provisions of the Conservation Easement or the application thereof to any person or circumstances is found to be invalid, the remainder of the provisions of this Conservation Easement shall not be affected thereby, as long as the purpose of the Conservation Easement is preserved. 72. Enforcement of the terms, provisions and restrictions of this Conservation Easement shall be at the reasonable discretion of Grantee, and any forbearance on behalf of Grantee to exercise its rights hereunder in the event of any breach hereof by Grantor, shall not be deemed or construed to be a waiver of Grantee's rights hereunder. 13. The terms and conditions of this Conservation Easement may be enforced by the Grantee by injunctive relief and other appropriate available remedies, and Grantor consents that venue of such enforcement actions shall lie exclusively in the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida. In any enforcement action in which the Grantee prevails, Grantee shall be entitled to recover reasonable attorney's fees and costs in the trial and appellate courts in addition to the cost of restoring the land to the natural vegetative and hydrologic condition existing at the time of execution of this Conservation Easement or to the natural vegetative state required for a development permit. These remedies are in addition to any other remedy, fine or penalty, which may be applicable under Chapters 373 and 403, Florida Statutes. POLICY: When a request is in the interest of the general public welfare or where no public detriment is established and when said request does not invade or violate individual property rights and otherwise qualifies under Ssection 336.09, Florida Statutes, the Board of County Commissioners (BCC)may: 1.
