Agenda 04/09/2024 Item #16F 6 (Execute a Memorandum of Understanding with Volunteer Florida and to accept an award for the repair of damage to Caxambus)04/09/2024 EXECUTIVE SUMMARY Recommendation to authorize the County Manager as designee to execute a Memorandum of Understanding with Volunteer Florida and to accept an award of up to $250,000 for the repair of damage to the Caxambas Park and Boat Ramp resulting from Hurricane Ian. _____________________________________________________________________________________ OBJECTIVE: To provide Collier County with additional funding for recovery efforts in response to Hurricane Ian. CONSIDERATIONS: On February 15th, 2024, staff received notification from Volunteer Florida of a Florida Disaster Fund Award of $250,000 for the repair of damage to the Caxambas Park and Boat Ramp resulting from Hurricane Ian. Award eligibility requires an application and executed Memorandum of Understanding (MOU) with Volunteer Florida to provide mutual support of Emergency Support Function (ESF) 15 volunteers and donations in communities impacted by Hurricane Ian during response and recovery operations. On February 21st, 2024, staff submitted an MOU application with Volunteer Florida for support of Emergency Support Function (ESF) 15. Once the attached MOU is executed by both parties Volunteer Florida will issue an award letter defining the award and will distribute the associated funding. FISCAL IMPACT: Funding from this award, in an amount up to $250,000 will be deposited in the Boater Improvement Emergency cost center within Disaster Recovery Fund (1813). GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this request. This agreement will improve the ability of our agencies to assist disaster survivors; utilize volunteers and donations; and ensure the success of ESF 15. Nothing in this MOU shall be construed to impose on either party or the State of Florida any additional liability. Any provision of the MOU that is inconsistent with the State’s sovereign immunity statutes shall be considered null and void. Each party agrees to assume its own liability and responsibility for the acts, omission, or conduct of such Party’s own employees or agents in relation to this MOU, subject to the provisions of Section 768.28, Florida Statutes, where applicable, and subject to other relevant State law. The mission of the Collier County Board of County Commissioners is to deliver high-quality, best- value, public services, programs, and facilities to meet the needs of its residents, visitors, and businesses today and tomorrow. Under the Florida Comprehensive Emergency Management Plan (CEMP), Volunteer Florida is the lead agency for ESF 15 Volunteers and Donations. Collier County Board of County Commissioners agrees to serve as an ESF 15 Support Organization for Hurricane Ian It is understood that Volunteer Florida will: 1. Include Collier County Board of County Commissioners in the capabilities Matrix for Hurricane Ian and an e-mail notification listing of all current and/or Hurricane Ian MOU partners for use during the Hurricane Ian Emergency Management Operation; 2. Inform Collier County Board of County Commissioners about opportunities to apply for available reimbursement for disaster related expenses for which Collier County Board of County Commissioners may qualify as it pertains to Hurricane Ian; 3. Update Collier County Board of County Commissioners on any changes in Volunteer Florida ESF 15 personnel or contact information; It is understood that Collier County Board of County Commissioners will: 1. Notify Volunteer Florida / ESF 15 of any disaster deployments of staff and resources for Hurricane Ian, and submit situation reports that may include the location(s) and the type(s) of services and resources being provided, and numbers of volunteers involved. 2. Provide monthly activity reports/situation reports for the duration of their operations during Hurricane Ian; This Memorandum of Understanding will take effect upon the date it is signed by representatives of both organizations and remain in effect for 90 days.
