EXECUTIVE SUMMARY
Recommendation to adopt an Ordinance amending Ordinance No. 2019-14, which established the Currents
Community Development District, in order to contract the external boundaries of the District resulting in a
net contraction of 5.12f acres from 516.25f acres to 511.152f acres.
OBJECTIVE: For the Board of County Commissioners ("Board") to approve the petition submitted to the County
by adopting an ordinance amending the Currents Community Development District, ("District") Ordinance No.
2019-14, by consenting to the contraction of external boundaries by approximately 5.12f acres from 516.25f acres
to 511.152± acres.
CONSIDERATIONS: On August 22, 2023, the Board of Supervisors of the District, represented by Gregory L.
Urbancic, Esq. of Coleman, Yovanovich, & Koester, P.A. ("Petitioner") filed a petition with the Growth
Management Community Development Department to modify the boundaries of the District by contracting and
expanding the external boundaries. A mandatory $1,500 application fee was submitted with the amendment
petition.
The District is located entirely within Collier County, Florida, and is generally south of Tamiami Trail East and east
of Collier Boulevard. The Marco Shores Fiddler's Creek Planned Unit Development (PUD) encompasses the entire
land area of the District. The proposed contraction area is located along the western boundary of the District and
totals f5.12 acres.
Exhibit "E" in the Petition provides the metes and bounds legal description of the Existing External Boundaries,
and Exhibit "F" the modified metes and bounds legal description, after contraction. Maps depicting the contraction
of land are provided in Exhibits "C" and "D" of the Petition.
Pursuant to Chapter 190, Florida Statutes, the Board shall consider the following:
1. The statements made within the Petition are true and correct.
2. Amending the Ordinance is not inconsistent with any applicable element or portion of Collier County's
comprehensive plan.
3. The land within the District continues to be of sufficient size, to be sufficiently compact, and to be
sufficiently contiguous to be developable as a functionality interrelated community.
4. The amendment to the boundaries of the District will not comprise greater than 50 percent of the land in the
initial district and, in no event, greater than 1,000 acres on a cumulative net basis.
5. The District continues to be the best alternative available for delivering community development services
and facilities to the area serviced by the District.
6. The service and facilities of the District will continue to not be incompatible with the capacity and uses of
any existing local and regional community development services and facilities.
7. The area remaining to be served by the District remains amenable to separate special district governance.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote
for Board approval. - DDP
FISCAL IMPACT: A $1,500 filing fee was submitted with this petition, deposited in Planning Services Fund
(1014), Planning Cost Center (138326).
GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action.
RECOMMENDATION: To adopt the proposed Ordinance amending Ordinance No. 2019-14, modifying the
external boundaries of the Currents Community Development District.

AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AMENDING ORDINANCE NO. 2019-14, THE CURRENTS
COMMUNITY DEVELOPMENT DISTRICT, BY
MODIFYING THE EXTERNAL BOUNDARIES OF THE
DISTRICT THROUGH CONTRACTION OF 5.12E ACRES
FROM 516.275� ACRES TO 511.152E ACRES; PROVIDING
FOR CONFLICT AND SEVERABILITY; PROVIDING FOR
INCLUSION IN THE CODE OF LAWS AND ORDINANCES;
AND PROVIDING AN EFFECTIVE DATE. [PL20230013790]
WHEREAS, on June 25, 2019, the Board of County Commissioners of Collier County,
Florida, a political subdivision of the State of Florida ("Board"), adopted Ordinance No. 2019-14,
the Currents Community Development District ("District"), as a community development district
within the meaning of Chapter 190, Florida Statutes; and
WHEREAS, the original boundaries set forth in Ordinance No. 2019-14 established
boundaries of the District resulting in 516.275± acres; and
WHEREAS, the Board of Supervisors of the District, represented by Gregory L. Urbancic,
Esq., of Coleman, Yovanovich & Koester, P.A. ("Petitioner"), petitioned the Board to modify the
external boundaries of the District through contraction of 5.12± acres from 516.275± acres to
511.152± acres (PL20230013790, hereinafter "CDD Amendment Petition"), as depicted in Exhibit
"A", attached hereto and incorporated herein by reference; and
WHEREAS, the Board considered the CDD Amendment Petition at a duly notice public
hearing advertised in accordance with Florida Statutes section 190.046; and
WHEREAS, upon consideration of the CDD Amendment Petition, the Board determined
the following:
1. The statements contained within the CDD Amendment Petition have been found to be
true and correct.
2. Amending the District is not inconsistent with any applicable element or portion of the
state comprehensive plan or of the effective local government comprehensive plan.
3. The area of land within the District continues to be of sufficient size, to be sufficiently
compact, and to be sufficiently contiguous to be developable as a functional interrelated
community.

4. The District continues to be the best alternative available for delivering community
development services and facilities to the area served by the District.
5. The services and facilities of the District will continue to not be incompatible with the
capacity and uses of existing local and regional community development services and
facilities.
6. The areas to be serviced by the District are amenable to separate special -district
governance.
7. The CDD Amendment Petition will not expand the District greater than 50 percent of
the land in the initial District, and in no event greater than 1,000 acres on a cumulative net
basis; and
WHEREAS, the Board finds that the Petitioner has otherwise satisfied all requirements set
forth in Florida Statutes section 190.046, and recommends approval of the contraction based on
the contents of the CDD Amendment Petition.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE: AMENDMENT OF ORDINANCE NO. 2019-14, THE CURRENTS
COMMUNITY DEVELOPMENT DISTRICT.
The original legal description of the District described in Exhibit `B", attached hereto and
incorporated herein by reference, is hereby superseded and replaced by the legal description of the
District described in Exhibit "C", attached hereto and incorporated herein by reference, to reflect
the expansion and contraction of the District.
SECTION TWO: EXTERNAL BOUNDARIES OF THE DISTRICT.
The external boundaries of the District encompasses 511.152± acres of land as described
in Exhibit "C".
SECTION THREE: CONFLICT AND SEVERABILITY
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a

separate, distinct, and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION FOUR: INCLUSION IN CODE OF LAWS AND ORDINANCES
The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinances may be re -numbered or re -
lettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or
any other appropriate word.
SECTION FIVE: EFFECTIVE DATE
This Ordinance shall become effective upon filing with the Florida Department of State.

PETITION TO AMEND COLLIER COUNTY ORDINANCE NO.2019-14 TO MODIFY
THE EXTERNAL BOUNDARIES OF CURRENTS COMMUNITY DEVELOPMENT
DISTRICT THROUGH CONTRACTION
The BOARD OF SUPERVISORS of CURRENTS COMMUNITY DEVELOPMENT
DISTRICT ("District"), by and through its undersigned attorney, petitions the BOARD OF
COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA ("Coun "), to adopt an
amendment to County Ordinance No. 2019-14 (the ordinance establishing the District), to amend
the total land area to be serviced by the District by modifying the external boundaries of the District
through contraction pursuant to Section 190.046, Florida Statutes.
In support thereof, the District submits:
1. Organizational Information. Currents Community Development District is a
uniform community development district created pursuant to Chapter 190, Florida Statutes and
established by County Ordinance No. 2019-14. Its District Office is located at 22301 Northeast
37th Street, Fort Lauderdale, FL 33308 and the Chair of the Board of Supervisors is Charles Cook.
Its District Manager is James P. Ward of JPWard & Associates, LLC.
2. Establishment. By County Ordinance No. 2019-14, dated June 25, 2019, which
Ordinance became effective on June 27, 2019 ("Ordinance No. 2019-14"), the District was
established on the property described in Ordinance No. 2019-14 and is currently in legal existence
and good standing. A copy of Ordinance No. 2019-14 is attached hereto and incorporated herein
as Exhibit "A".
3. Authority for Petition. On July 11, 2023, the Board of Supervisors of the District
("Board of Supervisors") adopted District Resolution 2023-10 to authorize the preparation and
filing of a petition to the Board of County Commissioners of Collier County for a modification of
the District's boundaries through contraction. A copy of Resolution 2023-10 is attached hereto
and incorporated herein as Exhibit "B".
4. Contraction. The land to be contracted from the District ("Contraction Land") is
located along the western boundary of the District, and totals approximately 5.12 acres. A sketch

and legal description of the Contraction Land is attached as Exhibit "C". A map showing the
location of the Contraction Land is attached as Exhibit "D".
5. Boundaries Before and After. A metes and bounds legal description of the existing
external boundaries of the District is attached as Exhibit "E". A metes and bounds legal
description of the boundaries of the District as modified through contraction is attached as Exhibit
"F". Both legal descriptions are provided in accordance with Section 190.046(1)(a), Florida
Statutes. When effected, these boundary changes will not exclude any real property within the
amended external boundaries of the District so that, therefore, there will be no enclave as a result
of the boundary amendment. The Contraction Land is a lake tract that is not part of the stormwater
management system operated and maintained by the District so the District does not have an
impact on the Contraction Land. After the contraction, the District will encompass approximately
511.152 acres.'
6. Consent. In accordance with Section 190.046(1)(g), Florida Statutes, attached as
Exhibit "G" is the written consent to the amendment of the boundaries of the District by one
hundred percent (100%) of the landowners of the Contraction Land. The last known address of
Taylor Morrison of Florida, Inc., a Florida corporation, as the sole landowner of the Contraction
Land, is 551 N. Cattlemen Road, Sarasota, FL 34232. The District has reviewed the Contraction
Land and determined that it is in the best interest of the District to amend its boundaries to remove
the Contraction Land. The filing of this Petition by the Board of Supervisors constitutes the
consent of all landowners residing within the current boundaries of the District as per Section
190.046(1)(g), Florida Statutes. Attached as Exhibit "G-1" are the most recent deeds of record
for the land to be removed.
7. Extent of Contraction. Further, in compliance with Section 190.046(1)(e), Florida
Statutes, the amendment of the external boundaries of the District (from 516.275 acres to 511.152
acres) as herein petitioned does not comprise (singularly and cumulatively) a cumulative net total
greater than 50% of the District's initial land in the District and will not result in an amendment
encompassing more than 1,000 acres on a cumulative net basis.
' Note: The computation of the net contraction is approximately 5.12 acres. However, the net computation based
upon a comparison of the overall legal descriptions of the District before and after the amendment is 5.123 acres.
This nominal difference is due to rounding within the individual parcel calculations.
8. District Services and Facilities. There are no existing facilities or services of the
District specifically servicing the Contraction Land.
9. Future Land Uses. The designations of future general distribution, location, and
extent of the public and private land uses proposed for the amended District by the future land use
plan elements of the local Comprehensive Plan, which are preliminary and subject to change, are
shown on Exhibit "H".
10. Statement of Estimated Re _ u�y Costs. The District submits the attached
Statement of Estimated Regulatory Costs ("SERC") for the District which contemplates the
granting by the County of this Petition to amend the District's boundaries through contraction as
required by Section 190.046(1)(a) and Section 190.005(1)(a)8., Florida Statutes, which SERC is
attached hereto as Exhibit "I".
11. Filing Fee. Prior to the filing of this Petition, the District submitted a copy of this
Petition, together with the required fee of $1,500 to Collier County.
12. The County Should Grant this Petition. This Petition should be granted for the
following reasons:
a. Amendment of the District's boundaries and all land uses and services
planned within the District as amended are not inconsistent with applicable elements or portions
of the adopted State Comprehensive Plan or the effective local Comprehensive Plan.
b. The area of land within the amended District is part of a planned
community. The District, as amended, will continue to be of sufficient size and sufficiently
compact and contiguous to be developed as one functional and interrelated community.
C. Existence of the amended District will prevent the general body of taxpayers
in the County from bearing the burden for installation of the infrastructure and the maintenance of
certain facilities within the development encompassed by the amended District. The District is the
best alternative for delivering community development services and facilities to the lands within
the amended District without imposing an additional burden on the general population of the local
general-purpose government. The proposed amendment of the District will allow for a more
efficient use of resources.

d. The community development services and facilities of the District as
amended will not be incompatible with the capacity and use of existing local and regional
community development services and facilities.
e. The area to be served by the District as amended is amenable to separate
special -district government.
WHEREFORE, the District respectfully requests the County to do the following:
A. Direct its staff to notice, as soon as practicable, a local, public, non -emergency
ordinance hearing in accordance with Section 190.046(1)(b) and Chapter 125, Florida Statutes, on
the subject of whether to grant this Petition to amend Ordinance No. 2019-14, to modify the
external boundaries of Currents Community Development District through contraction.
B. Grant this Petition and adopt the amendment to Ordinance No. 2019-14, to modify
the boundaries of Currents Community Development District pursuant to Section 190.046(1)(b),
Florida Statutes.

WHEREAS, Taylor Morrison of Florida, Inc., a Florida for profit company, has petitioned
the Board of County Commissioners (Board) of Collier County, Florida, a political subdivision of
the State of Florida, to establish the Currents Community Development District (District); and
WHEREAS, the Board of County Commissioners, after proper published notice has
conducted a public hearing on the petition and determined the following with respect to the factors
to be considered in Section 190.005(1)(e) Florida Statutes, as required by Section 190.005(2)(c),
Florida Statutes:
1. The petition is complete and meets the requirements of Section 190.005, Florida
Statutes, and all statements contained within the petition are true and correct.
2. Establishment of the proposed District is not inconsistent with any applicable
element or portion of the local comprehensive plan of Collier County, known as the
Collier County Growth Management Plan, or the State Comprehensive Plan.
3. The area of land within the proposed District is of sufficient size, is sufficiently
compact, and is sufficiently contiguous to be developable as one functional
interrelated community.
4. The District is the best alternative available for delivering community development
services and facilities to the area that will be serviced by the District.
5. The community development services and facilities of the District will not be
incompatible with the capacity and uses of existing local and regional community
development services and facilities.

6. The area that will be served by the District is amenable to separate special -district
government.
WHEREAS, it is the policy of this State, as provided for in Section 190.002(2)(c), Florida
Statutes, that the exercise by any independent district of its powers as set forth by uniform general
law comply with all applicable governmental laws, rules, regulations, and policies governing
planning and permitting of the development to be serviced by the district, to ensure that neither
the establishment nor operation of such district is a development order under Chapter 380, Florida
Statutes, and that the district so established does not have any zoning or permitting powers
governing development; and
WHEREAS, Section 190.004(3), Florida Statutes, provides that all governmental planning,
environmental, and land development laws, regulations, and ordinances apply to all development
of the land within a community development district. Community development districts do not
have the power of a local government to adopt a comprehensive plan, building code, or land
development code, as those terms are defined in the Local Government Comprehensive Planning
and Land Development Regulation Act. A district shall take no action which is inconsistent with
applicable comprehensive plans, ordinances, or regulations of the applicable local general-purpose
government.
WHEREAS, pursuant to Section 190.012(2)(a) and (d), Florida Statutes, upon the
establishment of the proposed community development district, the District Board of Supervisors
have sought consent from Collier County for the grant of authority to exercise special powers
without question as to the continued right, authority and power to exercise its limited powers as
established by this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE: AUTHORITY FOR ORDINANCE
This Ordinance is adopted pursuant to Section 190.005(2), Florida Statutes, and other
applicable provisions of law governing county ordinances.

SECTION TWO: ESTABLISHMENT OF THE CURRENTS COMMUNITY
DEVELOPMENT DISTRICT
The Currents Community Development District is hereby established within the
boundaries of the real property described in Exhibit "A" attached hereto and incorporated by
reference herein.
SECTION THREE: DESIGNATION OF INITIAL BOARD MEMBERS

SECTION FIVE: STATUTORY PROVISIONS GOVERNING THE DISTRICT
The Currents Community Development District shall be governed by the provisions of
Chapter 190, Florida Statutes, and all other applicable general and local law.
SECTION SIX: CONSENT TO SPECIAL POWERS
Upon the effective date of this Ordinance, the Currents Community Development District
will be duly and legally authorized to exist and exercise all of its powers as set forth in Section
190.012(1), Florida Statutes, and as otherwise provided by law. The Board hereby consents to the
exercise by the Board of Supervisors of the District of the special powers set forth in Section

190.012(2)(a) and (d), Florida Statutes, to plan, establish, acquire, construct or reconstruct, enlarge
or extend, equip, operate, and maintain additional systems and facilities for: (1) Parks and facilities
for indoor and outdoor recreational, cultural, and educational uses and (2) Security, including, but
not limited to, guardhouses, fences and gates, electronic intrusion -detection systems, and patrol
cars, when authorized by proper governmental agencies; except that the district may not exercise
any police power, but may contract with the appropriate local general-purpose government
agencies for an increased level of such services within the district boundaries.
SECTION SEVEN: PETITIONER'S COMMITMENTS
The adoption of this Ordinance is predicated upon the material inducements contained in
the foregoing recitals setting forth Petitioner's Commitments, re -stated as follows: (1) elect one
resident of the District to the five member Board of Supervisors at such time as residents begin
occupying homes in the District, and (2) record a Notice of Assessments containing the specific
terms and conditions of any special assessments imposed to secure bonds issued by the District,
which notice shall be recorded immediately after any such bond issuance. The Board shall retain
any and all rights and remedies available at law and in equity to enforce Petitioner's Commitments
against Petitioner, its successors and assigns.
SECTION EIGHT: CONFLICT AND SEVERABILITY
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION NINE: INCLUSION IN CODE OF LAWS AND ORDINANCES
The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or
relettered to accomplish such, and the word "ordinance" may be changed to "section," "article,"
or any other appropriate word.

PETITION WITH THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA FOR A MODIFICATION OF THE DISTRICT'S BOUNDARIES
AND THE JURISDICTION OF THE DISTRICT THROUGH CONTRACTION;
PROVIDING FOR CERTAIN REQUIREMENTS IMPLEMENTING SECTION
190.046(1), FLORIDA STATUTES; PROVIDING FOR SEVERABILITY, CONFLICTS
AND AN EFFECTIVE DATE.
WHEREAS, the Currents Community Development District (the "District") is a community
development district that was established pursuant to the provisions of Chapter 190, Florida Statutes by
Ordinance No. 2019-14 adopted by the Board of County Commissioners of Collier County, Florida, on June
25, 2019, which Ordinance became effective on June 27, 2019; and
WHEREAS, the District is in legal existence and in good standing; and
WHEREAS, Taylor Morrison of Florida, Inc., a Florida corporation (the "Developer") and its
affiliates are presently developing the real property within the District; and
WHEREAS, the Developer has approached the Board of Supervisors of the District (the "Board")
and requested that the District file a petition with the Board of County Commissioners of Collier County,
Florida to amend the District's boundaries (the "Petition") to remove certain lands currently located
within the District as generally depicted on Exhibit "A" attached hereto and made a part hereof; and
WHEREAS, the modification of the external boundaries and jurisdiction of the District through
contraction will provide better service to the landowners, both existing and future, and ultimately the
residents and citizens of the District; and
WHEREAS, Chapter 190, Florida Statutes, provides a mechanism by which the land area and
jurisdiction of the District may be modified by contraction; and
WHEREAS, the District desires to authorize the District Manager, District Counsel and District
Engineer to petition the Board of County Commissioners of Collier County, Florida to amend its boundaries
in accordance with the procedures and processes described in Chapter 190, Florida Statutes, which
includes the preparation of the Petition to the Board of County Commissioners of Collier County, Florida,
and such other actions as are necessary in furtherance of the boundary amendment process.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF CURRENTS
COMMUNITY DEVELOPMENT DISTRICT:
SECTION 1. INCORPORATION OF RECITALS. All of the above representations, findings and
determinations contained within the foregoing recitals of this Resolution are recognized as true and
accurate and are expressly incorporated into this Resolution.
SECTION 2. PETITION. The District hereby authorizes the preparation and filing of a Petition with
the Board of County Commissioners of Collier County, Florida for a modification of the external boundaries

SECTION 3. SEVERABILITY. If any section or part of a section of this Resolution be declared invalid
or unconstitutional, the validity, force and effect of any other section or part of a section of this Resolution
shall not thereby be affected or impaired unless it clearly appears that such other section or part of a
section of this Resolution is wholly or necessarily dependent upon the section or part of a section so held
to be invalid or unconstitutional.
SECTION 4. CONFLICTS. All District resolutions or parts thereof in actual conflict with this
Resolution are, to the extent of such conflict, superseded and repealed.
SECTION S. EFFECTIVE DATE. This Resolution shall take effect immediately upon the passage and
adoption of this Resolution by the Board.

Owner's Written Consent
LANDOWNER'S CONSENT TO EXCLUSION OF
CERTAIN PROPERTIES WITHIN THE MODIFIED BOUNDARIES OF THE
CURRENTS COMMUNITY DEVELOPMENT DISTRICT
TAYLOR MORRISON OF FLORIDA, INC., a Florida corporation ("Owner") certifies that it
is the owner of the real property located in Collier County, Florida and more particularly described on
Exhibit "A" attached hereto and incorporated herein by reference (the "Property').
Owner understands and acknowledges that Currents Community Development District (the
"District") intends to submit a petition to amend its boundaries to Collier County in accordance with the
provisions of Chapter 190, Florida Statutes. As a landowner (as defined by Chapter 190, Florida Statutes)
of lands which are intended to be removed from the District, Owner understands and acknowledges that
pursuant to the provisions of Section 190.046, Florida Statutes, the District is required to include the written
consent of one hundred percent (100%) of the owners of the lands to be removed from the District.
Owner hereby consents to the exclusion of the Property in the District and agrees to further execute
any documentation necessary or convenient to evidence this consent and joinder during the application
process for the amendment to the boundaries of the District. Owner acknowledges that this consent will
remain in full force and effect until the boundaries of the District are amended, provided that if final
approval of the Petition is not granted by Collier County within three (3) years from the date hereof, Owner
shall have the right to withdraw this consent by delivering written notice to the District and the Board of
County Commissioners of Collier County, Florida within any time thereafter, but prior to final approval of
the Petition. If the Property is sold by Owner prior to final approval of the Petition, Owner further agrees
that Owner will provide to the next purchaser or successor in interest of all or any portion of the Property a
copy of this consent form and obtain, if requested by District, the same consent in substantially this form.
Owner represents and warrants that it has taken all actions and obtained all consents necessary to duly
authorize the execution of this consent and joinder by the officer executing this instrument. Owner further
agrees to the recording of this document, if required by Collier County.

1.0 Introduction
1.1 Purpose and Scope
This Statement of Estimated Regulatory Costs ("SERC") supports the Petition Amend ("Petition") the
boundaries of Currents Community Development District ("District"). The District currently encompasses
516.275 acres of land, more or less, located within Collier County, Florida and this Petition will remove 5.12
acres of land, which the District will then encompass 511.152 acres of land more or less. The limitations on
the scope of this SERC are explicitly set out in Section 190.002(2)(d), F.S. (governing District establishment
or alteration) as follows:
"That the process of establishing [or amending the boundaries of] such a district pursuant to uniform
general law shall be fair and based only on factors material to managing and financing the service delivery
function of the district. so that anv matter concernine oermittine or plannine of the development is not
material or relevant (emphasis added)."
1.2 Overview of the Development and the District
A Community Development District ("CDD") is an independent unit of special purpose local government
created and chartered by Chapter 190, Florida Statutes, to plan, finance, construct, operate and maintain
community -wide infrastructure in large, planned community developments. A CDD may be established
and/or amended on the proposed property by ordinance and this SERC is related only to the petition to
amend the boundaries of the District. CDDs provide a "solution to the state's planning, management and
financing needs for delivery of capital infrastructure to service projected growth without overburdening
other governments and their taxpayers." Section 190.002(1)(a), F.S.
A CDD is not a substitute for the local, general purpose, government unit, i.e., the County in which the CDD
lies. A CDD does not have the permitting, zoning or police powers possessed by general purpose
governments. A CDD is an alternative means of financing, constructing, operating, and maintaining
community infrastructure for planned developments. The scope of this SERC is limited to evaluating the
consequences of approving the petition to amend the boundaries of the District.
2.0 Statement of Estimated Regulatory Costs
2.1 Requirements for a Statement of Estimated Regulatory Costs
Section 120.541(2), F.S., defines the elements a statement of estimated regulatory costs must
contain the following elements:
a) An economic analysis showing whether the rule directly or indirectly:
Is likely to have an adverse impact on economic growth, private sector job creation or
employment, or private sector investment in excess of $1 million in the aggregate within
5 years after the implementation of the rule.
ii. Is likely to have an adverse impact on business competitiveness, including the ability of
persons doing business in the state to compete with persons doing business in other

states or domestic markets, productivity, or innovation in excess of $1 million in the
aggregate within 5 years after the implementation of the rule.
iii. Is likely to increase regulatory costs, including any transactional costs, in excess of $1
million in the aggregate within 5 years after the implementation of the rule.
b) A good faith estimate of the number of individuals and entities likely to be required to comply with
the rule, together with a general description of the types of individuals likely to be affected by the
rule.
c) A good faith estimate of the cost to the agency, and to any other state and local government
entities, of implementing and enforcing the proposed rule, and any anticipated effect on state or
local revenues.
d) A good faith estimate of the transactional costs likely to be incurred by individuals and entities,
including local government entities, required to comply with the requirements of the rule. As used
in this section, "transactional costs" are direct costs that are readily ascertainable based upon
standard business practices, and include filing fees, the cost of obtaining a license, the cost of
equipment required to be installed or used or procedures required to be employed in complying
with the rule, additional operating costs incurred, the cost of monitoring and reporting, and any
other costs necessary to comply with the rule.
e) An analysis of the impact on small businesses as defined by s. 288.703, and an analysis of the
impact on small counties and small cities as defined in s. 120.52. The impact analysis for small
businesses must include the basis for the agency's decision not to implement alternatives that
would reduce adverse impacts on small businesses.
f) Any additional information that the agency determines may be useful.
g) In the statement or revised statement, whichever applies, a description of any regulatory
alternatives submitted under Section 120.541(1)(a) and a statement adopting the alternative or a
statement of the reasons for rejecting the alternative in favor of the proposed rule.
The references to the "rule" in the statutory requirements for the Statement of Estimated
Regulatory Costs also apply to an "ordinance" under Section 190.005(2)(a), F.S., as amended.
3.0 Analysis of Required Elements of the Statement of Estimated Regulatory Costs
3.1 Questions:
3.1.1 Is likely to have an adverse impact on business competitiveness, including the
ability of persons doing business in the state to compete with persons doing
business in other states or domestic markets, productivity, or innovation in
excess of $1 million in the aggregate within 5 years after the implementation of
the rule.

3.1.2 Is likely to increase regulatory costs, including any transactional costs, in excess
of $1 million in the aggregate within 5 years after the implementation of the rule.
3.1.3 A good faith estimate of the number of individuals and entities likely to be
required to comply with the rule, together with a general description of the types
of individuals likely to be affected by the rule.
3.2 Responses:
3.2.1 The ordinance to amend to reduce the acres in the District will not have any
adverse impact (direct or indirect) on economic growth, private sector job
creation or employment, private sector investments, business competitiveness,
the ability of persons doing business in the State to compete with persons doing
business in other states or domestic markets, productivity, or innovation.
There will be no increases in regulatory costs as a result of the reduction of 5.12
acres from the District.
Next, the District boundary is being amended to remove land that will be deeded to an adjoining
property owner only.
3.3 Question:
3.3.1 Likelihood on an increase in regulatory costs, including any transactional costs,
in excess of $1 million in the aggregate within 5 years after the implementation
of the rule.
3.4 Response:
3.4.1 The amendment to the boundaries of the District will not increase any regulatory
costs of the State or the County. The District will pay a one-time filing fee to
Collier County to offset any expenses that the County may incur in the processing
of this petition. Similarly, the District will continue to pay the required to pay
the annual Special District Filing Fee, which fee is meant to offset any State costs
related to its oversight of all special districts in the State.
The amendment of the boundaries t of the District will not increase regulatory
costs to existing landowners within the District.
3.5 Question:
3.5.1 A good faith estimate of the number of individuals and entities likely to be
required to comply with the ordinance, together with a general description of
the types of individuals likely to be affected by the ordinance.
3.6 Response:
3.6.1 The District boundaries as amended will continue to serve land that, as
amended, comprises 511.152 acres in size and in the master planned residential
development, currently planned to be made up of an estimated 1,090 residential

dwelling units along with currently planned facilities in the District of a
clubhouse/amenity feature such as pool and meeting room(s) and outdoor
recreational uses. The property owners in the District will be individuals that may
operate industrial, manufacturing and other retail and non -retail related
businesses outside the boundaries of the District.
3.7 Question:
3.7.1 A good faith estimate of the cost to the agency, and to any other state and local
government entities, of implementing and enforcing the proposed rule, and any
anticipated effect on state or local revenues.
3.8 Response:
3.8.1 There is no state agency promulgating any rule relating to this project that is
anticipated to effect state or local revenues. In this regard it is important to note
that any debt obligations incurred by the District to construct its infrastructure,
or for any other reason, are not debts of the State of Florida, the County, or any
other unit of local government. In accordance with State law, debts of the District
are strictly its own responsibility.
3.9 Question:
3.9.1 A good faith estimate of the transactional costs likely to be incurred by
individuals and entities, including local government entities, required to comply
with the requirements of the rule. As used in this section, "transactional costs"
are direct costs that are readily ascertainable based upon standard business
practices, and include filing fees, the cost of obtaining a license, the cost of
equipment required to be installed or used or procedures required to be
employed in complying with the rule, additional operating costs incurred, the
cost of monitoring and reporting, and any other costs necessary to comply with
the rule.
3.10 Response:
3.10.1 Individuals and Entities:
There are not individuals of entities that will incur any costs for services as a
result of amending the boundaries of the District.
State Governmental Agencies:
There will no cost to the Department of Economic Opportunity and any other
State governmental entity to amend the boundaries of the District. The District
as proposed is within unincorporated Collier County.
Local Government: (Collier County)
The District is located in unincorporated in Collier County, Florida, and, will
consist of approximately 511.152, acres more or less, as amended. Collier County

and its staff may process, analyze, conduct a public hearing, and vote upon the
petition to amend the District. These activities will absorb some resources. The
costs to review the record of the local hearing, the transcript of the hearing, and
the ordinance adopted by the local general-purpose government will be offset
by the filing fee required under 190.005 (1), F.S.
These costs to Collier County are modest for a number of reasons. First,
according to Chapter 190, F.S., review of the Petition to amend the District does
not include analysis of any community developments within the boundaries of
the District. Second, the Petition itself provides much of the information needed
for a staff review. Third, local governments already possess the staff needed to
conduct the review without the need for new staff. Fourth, there is no capital
required to review the Petition. Fifth, the potential costs are offset by the
required filing fee. Finally, general purpose local governments routinely process
petitions for land uses and zoning changes that are far more complex than is the
Petition to amend a community development district.
The annual costs to the County as a result of this amendment are zero, since the
District filing requirements to the County will continue for the District and which
consist of the District filing certain reports with the County, such as proposed
and adopted budgets, notice of annual meetings, etc.
3.11 Question:
3.11.1 An analysis of the impact on small businesses as defined by s. 288.703, F.S., and
an analysis of the impact on small counties and small cities as defined in s.
120.52, F.S. The impact analysis for small businesses must include the basis for
the agency's decision not to implement alternatives that would reduce adverse
impacts on small businesses.
3.12 Response:
3.12.1 There will be no impact on small businesses because of the amendment to the
boundaries of the District. If anything, the impact may be positive. Collier
County has an estimated population that is greater than 75,000 according to the
Census estimates as of April, 2020; therefore the County is not defined as a
"small" County according to Section 120.52 (18), F.S, and there will accordingly
be no impact on County because of the amendment of the boundaries of the
District.
3.13 Question:
3.13.1 Any additional information that the agency determines may be useful.
3.13.2 In the statement or revised statement, whichever applies, a description of any
regulatory alternatives submitted under paragraph (1)(a) of Chapter 120.541
and a statement adopting the alternative or a statement of the reasons for
rejecting the alternative in favor of the proposed rule.

3.14 Response:
3.14.1 This is a small amendment reducing the acres within the District by 5.12 acres,
to the boundaries of the District to remove land, and as such, there is no
additional analysis applicable.
