EXECUTIVE SUMMARY
Recommendation to renew a Certificate of Public Convenience and Necessity for Class 2 ALS non -
emergency inter-facility ambulance transports to MedTrek Medical Transport, Inc., to provide inter-facility
and out of county ambulance transfer services.
OBJECTIVE: To proceed in the best interest of the public health, safety, and welfare by awarding a
Certificate of Public Convenience and Necessity (COPCN), Class 2 Advanced Life Support (ALS) for inter-facility
ambulance transport services and out of county transport services in Collier County to MedTrek Medical Transport,
Inc. These certificates are subject to certain conditions noted below.
CONSIDERATIONS: MedTrek Medical Transport, Inc. was originally granted a Certificate of Public
Convenience and Necessity on March 28, 2023, by the Board. The certificate requires annual renewal, and the
current COPCN expires on April 5, 2024.
The Board’s Emergency Medical Authority (EMA) has not convened due to the absence of a quorum for the two
meetings assigned to the EMA to hear this item. Staff recommends that the Board approve this routine annual
COPCN renewal for one (1) year operating with five (5) ambulances, with three (3) ambulances authorized to
operate twenty-four (24) hours a day and (2) ambulances available in reserve. The Emergency Medical Authority
will be briefed at their next meeting on the recommendation and certificate being granted.
Section 50-60 of the Code of Laws and Ordinances provides:
Each certificate holder shall file within 90 days of expiration applications for renewal of his certificate.
Renewals shall be based upon the same standards as the granting of the original certificate along with such
other factors as may be relevant. The renewal application shall be accompanied by a $250.00 renewal fee.
The renewal certificate may be approved routinely by the Board, upon advice of the administrator, or the
Board may hold a hearing on the same.
These requirements have been met, and the administrator recommends renewal.
FISCAL IMPACT: There is no fiscal impact in granting the Certificate. The Board shall also recognize and
accept the $250 application fee as revenue in Fund (0001).
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting from this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. A hearing is not required
for renewal. If a hearing is held, the Board must find that the standards set forth in Section 50 -57 of the Code of
Laws and Ordinances have been satisfied based on competent evidence as follows:
(1) That there is a public necessity for the service. In making such determination, the Board of County
Commissions shall consider, as a minimum, the following factors:
(a) The extent to which the proposed service is needed to improve the overall Emergency Medical
Services (EMS) capabilities of the County.
(b) The effect of the proposed service on existing services with respect to quality of service and cost of
service.
(c) The effect of the proposed service on the overall cost of EMS service in the County.
(d) The effect of the proposed service on existing hospitals and other health care facilities.

(e) The effect of the proposed service on personnel of existing services and the availability of
sufficient qualified personnel in the local area to adequately staff all existing services.
(2) That the applicant has sufficient knowledge and experience to properly operate the proposed service.
(3) That, if applicable, there is an adequate revenue base for the proposed service.
(4) That the proposed service will have sufficient personnel and equipment to adequately cover the proposed
service area.”
Additionally, the Board has the option to appoint a hearing officer as provided by Section 50-58 of the Collier
County Code of Laws and Ordinances.
Sec. 50-58. - Appointment of hearing officer.
In making the determinations provided for in 50-57 above, the board may, in its sole discretion, appoint a
Hearing Officer to hold a public hearing and to make factual findings and conclusions as a result of the
hearing. Should a Hearing Officer be appointed, said Hearing Officer shall render a written report to the Board
within 30 days of the hearing, which report shall contain the officer's findings and conclusions of fact , and a
recommended order. The findings and conclusions of fact shall be binding upon the Board, but the
recommended order shall be advisory only.
Accordingly, this item is approved as to form and legality and requires a majority vote for Board action. -

RECOMMENDATION: That the Board of County Commissioners:
1. Accept the findings of the Director of the Bureau of Emergency Services;
2. Grants the Certificate of Public Convenience and Necessity to MedTrek Medical
Transport, Inc., and authorizes the Chairman to execute the Permit and Certificate; and
3. Approves a Budget Amendment to recognize and appropriate the $250 application fee.
