Estates—Mixed Use District — C. List of Maps 4. Mission Emmanuel Lutheran Church Community Facilities and Services Subdistrict The Mission Emmanuel Lutheran Church Community Facilities and Services Subdistrict is located on the south side of Oil Well Road,approximately one quarter mile west of Everglades Boulevard, and consists of 21.72 35.92 acres. The Subdistrict has been designated on the Rural Golden Gate Estates Future Land Use Map and the Emmanuel Lutheran Church Community Facilities and Services Subdistrict Map. The purpose of this Subdistrict is to provide for churches and related uses, and other community facilities and services to serve the population of this area of Collier County and to provide public space for community engagement.Including community outreach. The subdistrict shall be zoned Planned Unit Development (PUD). The PUD shall include development standards and perimeter buffering to ensure compatibility with adjacent lands. The following uses are allowed: a. Churches and places of worship. b. Child care centers services. must be not for profit and affiliated with a church c. Private or public schools. must be not for profit and affiliated with a church. d. Individual and family social services (activity centers, elderly or handicapped only; counseling centers, day care centers, adult and handicapped only);-disaster services; helping hand services; meal delivery programs; multiservice centers, neighborhood; outreach programs; relief services, temporary; service leagues; must be not-for-profit. and affiliated with a church within the Subdistrict. e. Medical outreach to the community,to include activities such as administering influenza vaccines, providing medical check-ups, and related examinations, checking blood pressarc, and conducting blood donation drives. must be not for profit. To facilitate these services a medical/health clinic is permitted, not to exceed 3,600 square in size, and operated by a not-for-profit organization. affiliated with a church or within the Subdistrict. f. Colleges and universities—must be not-for-profit. g, Job training and vocational rehabilitation services—must be not-for-profit. Vocational rehabilitation services shall not include uses such as outboard or diesel engine repair that could emit noise beyond the boundaries of the subdistrict. Physical fitness facilities —must be not-for-profit and operated with a church or place of worship within the Subdistrict. a. Essential services, including law enforcement, fire, emergency medical services and facilities, public park, and public library services and facilities, including a mobile or manufactured home for use by a sheriff's deputy (and family). b. United States Postal Service, except major distribution center. c. Interim agricultural activities, including, but not limited to: Crop raising; horticulture; fruit and nut production;forestry;groves;nurseries; ranching; beekeeping;poultry and egg production; milk production; livestock raising, and aquaculture for native species subject to Florida Fish and Wildlife Conservation Commission permits; these uses are interim uses allowed prior to issuance of a Certificate of Occupancy for any other permitted principal use. d. Food trucks (SIC 5963), limited to a maximum of four at any time. Other limitations or standards may be provided for within the PUD. e. Garden Plots, to be utilized by church members or students and their families. f. Recreational facilities including outdoor play areas and athletic field, administration offices and facilities, and youth recreation centers indoor to support church uses. The athletic field shall be limited to the location depicted on the PUD Master Plan as "Football/Soccer Field" and "Softball Field". Soup kitchens and homeless shelters are prohibited in this Subdistrict. The maximum total floor area allowed in this Subdistrict is 90,000 square feet. The maximum height of buildings shall be 30 feet zoned height, except the worship center shall be permitted a zoned height of 35 feet. Development in this Subdistrict shall be designed to be compatible with the existing, and allowed future, development in the surrounding area. In the alternate to the foregoing uses, measures of development intensity, and development standards, this Subdistrict may be developed with single family dwellings in accordance with the Residential Estates Subdistrict. Seventy-five foot (75') wide buffer areas are required along the east, west and southwest property lines abutting residential development as shown on the CFPUD Master Plan. However, play fields are permitted in a portion of the 75-foot-wide buffer area shown on the west and southwest property lines along with an existing lake, as shown on the CFPUD Master Plan. One entity (hereinafter the Managing Entity) shall be responsible for PUD monitoring until close-out of the PUD, and this entity shall also be responsible for satisfying all PUD commitments until close-out of the CFPUD. No. 1973-23. It included provisions for a tree removal permit process, and it identified a short list of tree species that were exempted from protection. The ordinance was amended in 1974 and then repealed/replaced twice; once in 1975 and again in 1976, the latter of which representing the time when the County adopted comprehensive zoning regulations for the Coastal Area Planning District (i.e., Ord. No. 1976-30). When Ord. No. 1979-73 was adopted, the County started requiring the removal of exotic plants on properties where improvements were proposed, except on lands used for agricultural purposes or on properties zoned and platted for single-family residential homes. In January 1982, the County adopted a new zoning ordinance (Ord. No. 1982-2); however,this new ordinance inadvertently omitted the Exotic Vegetation Section and was corrected in May 1982 with the adoption of Ord. No. 1982-37, reinstituting the requirement that exotics be removed on all lands, except for single-family residential use or agriculturally zoned lands. Additional changes to the code would be made over the years, notably with the adoption of Ord. No. 2004-08, which introduced the requirement for preserve management plans and the removal of exotic vegetation within the first 75 feet of the outer edge of every preserve; however, single family residences were specifically exempted. When the code was comprehensively updated again with the passage of Ord. No. 2004-41, the requirement for removing exotic vegetation prior to the issuance of a certificate of occupancy was extended to include new principal and accessory structures on single and two family lots. However, tents,awnings,cabanas,utility storage sheds, and screen enclosures were not exempted until the adoption of Ord. No. 2005-27. Subsequent amendments to LDC section 3.05.08 occurred in 2008 and 2015. PUD MONITORING One entity (hereinafter the Managing Entity) shall be responsible for PUD monitoring until close- out of the PUD, and this entity shall also be responsible for satisfying all PUD commitments until close-out of the PUD. At the time of this PUD approval, the Managing Entity is Livingston Veterans Commercial, LLC,5020 Tamiami Trail N.,#112, Naples, FL 34103.Should the Managing Entity desire to transfer the monitoring and commitments to a successor entity,then it must provide a copy of a legally binding document that needs to be approved for legal sufficiency by the County Attorney. After such approval, the Managing Entity will be released of its obligations upon written approval of the transfer by County staff, and the successor entity shall become the Managing Entity. A minimum of 0.44± acres of native vegetation shall be mitigated off-site in accordance with LDC Section 3.05.07.H.1.f. b. Off-site preservation mitigation shall be satisfied through monetary payment to Collier County. Funds shall be used by the County for the purchase and management of off-site conservation lands within the county.The monetary payment amount shall be based on the post development appraisal value per acre multiplied by 0.44-acres of required preserve, then multiplied by 1.25 to establish the endowment amount. The appraisal shall be performed by a state certified appraiser. In addition, the fee for initial exotic vegetation removal shall be paid by the applicant as established in the Parks and Recreation Division Fee Schedule. c. The monetary payment for off-site preservation mitigation and exotic removal fees shall be made prior to the preconstruction meeting for the Site Development Plan or final plat construction plans,whichever occurs first. 5. SPECIAL CONDITIONS a. No adult orientated sales are permitted. b. Outdoor amplified sound shall be limited to areas abutting Livingston Road and/or Veterans Memorial Boulevard.
