Agenda 03/12/2024 Item #16B 3 (Policy and Easement Use agreements - 16th Street NE Bridge Project 60212)03/12/2024 EXECUTIVE SUMMARY Recommendation to establish a policy and authorize the Chair to execute Easement Use Agreements for certain existing minor encroachments discovered as part of the 16th Street NE Bridge Project (60212). OBJECTIVE: To establish a policy for allowing certain existing minor encroachments in the right-of-way as discovered during the 16th Street NE bridge and associated corridor enhancements project to remain and to authorize the Chair to execute such Easement Use Agreements on behalf of the Board. CONSIDERATIONS: On January 14, 2020, (Agenda Item 16.A.25), the Board established a policy for allowing minor structures in utility, drainage, or similar easements for residential properties. Minor structures include fences, air conditioning equipment/concrete pad, pool equipment/concrete pad, generators, sidewalks, and other minor structures as determined by Collier County Growth Management staff. On December 2, 2020, (Agenda Item 8.A.1), the Infrastructure Sales Tax Committee validated the 16t h Street NE Bridge Project (60212), listed within Exhibit “A” under the Transportation Projects category of Ordinance No. 2018-21. During the design phase of the 16th Street NE Bridge Project, staff discovered various encroachments in the right-of-way, ranging from 0.09 feet to 54.61 feet, and including fences, walls, luminaires, hedges, trees, and parking pads. Some encroachments were permitted, others not; and many conflict with the project. The application of this policy has not included right-of-way (whether held in fee simple or via easement), as such encroachments are not authorized, per the Right-of-Way Handbook (e.g., “fencing that encloses public property or that indicates that public property is being used for private purposes will not be permi tted to be placed in a public right-of-way”), pursuant to Resolution No. 2016-136 and Ordinance No. 2003-37, as amended. However, similar to the policy described above, Staff is proposing that the Board adopt a policy to allow certain encroachments (fences, walls, and luminaires) to remain in place that: (1) do not interfere with the project or the County’s foreseeable right- of-way needs; (2) encroach less than three feet into the right -of-way; and (3) are formally allowed through a standard template easement use agreement. The encroachments will be allowed to remain in place until they are replaced by the property owner (and the replacement will be moved out of the right - of-way and placed wholly on private property through normal County permitting), and the property owner is on notice that the encroachments exist in the right-of-way and the County may still remove them at its discretion. Staff has identified 11 properties that would be eligible for this policy (attached). More than half of these properties’ encroachments are less than one foot; and only one encroachment is more than two feet (but less than three feet). If approved, staff would allow these property owners to execute a standard form Easement Use Agreement, for the Board Chair to sign and have recorded in the public records at the property owner’s expense. Should a property owner refuse to enter into the agreement, then their encroachment into the right -of-way will be removed as part of the construction project or the violation forwarded to code enforcement for prosecution, at the determination of the County Manager or designee. This item is consistent with the Collier County strategic plan objective to design and maintain an effective transportation system to reduce traffic congestion and improve the mobility of our residents and visitors. FISCAL IMPACT: There is no fiscal impact to the County associated with this action. Property owners are responsible to pay all recording fees for the easement use agreement. GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and Objective 1 of the Transportation Element of the Collier County Growth Management Plan to maintain the major roadway system at an acceptable Level of Service. The County agrees that until otherwise notified, Owner may continue the use of Encroachment within the Easement Area, however, the County retains the right, in its sole discretion, to demand by written request that the Encroachment be removed from the Easement Area, which Owner shall do at their sole cost and expense within a reasonable time from receipt of such request. 4.
