Agenda 03/12/2024 Item #16A 9 (Esplanade by the Islands Lucerna Street - Final acceptance of the potable water and sewer utility facilities)03/12/2024 EXECUTIVE SUMMARY Recommendation to approve final acceptance and accept the conveyance of the potable water and sewer utility facilities for Esplanade by the Islands Lucerna Street, PL20230008065. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water-Sewer District, approve final acceptance and accept the conveyance of these potable water and sewer facilities and appurtenance utility easement, in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The Developer of Esplanade by the Islands Lucerna Street has constructed the potable water and sewer facilities within dedicated easements to serve this development. (See attached location map). The potable water and sewer facilities were offered for conveyance to the County, as described in O.R. Book 6324, Page (PG) 3778, and are located within County utility easements dedicated by the plat of Esplanade by the Islands Lucerna Street, recorded in Plat Book 72, Pages 16-17, of the Public Records of Collier County, Florida. These potable water and sewer utility facilities (assets) were valued at $85,194.99 and $58,875.64, respectively. 2) Staff recorded all final acceptance documents associated with the facilities being conveyed to the County in the public records of Collier County, which were reviewed and approved by the County Attorney’s office as to form and legality. The County acquired its interest in the potable water and sewer facilities by Utilities Facilities Warranty Deed and Bill of Sale recorded in O. R. Book 6324, PG 3778 (“the Utilities Facilities Deed”). 3) The Development Review staff conducted a final inspection to discover defects in materials and workmanship on December 6, 2023, in coordination with Public Utilities, and these facilities are satisfactory and acceptable. 4) Staff recommends final acceptance of the subject utility facilities in the amount of $144,070.63. Staff also recommends acceptance of the Utilities Facilities Deed and the facilities described therein. 5) This final acceptance is in accordance with Collier County Ordinance No. 2004-31, as amended. 6) Staff is unaware of any issues that would serve to negate the recommendation to release the applicable security. FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact. However, approval of this executive summary will result in the Collier County Water -Sewer District receiving title to the potable water and sewer utility facilities, which have a total gross value of $144,070.63 (no depreciation applied), and an asset will be recorded in the financial records of the County. GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -DDP RECOMMENDATION: To approve final acceptance and accept the conveyance of the potable water and sewer utility facilities and appurtenant utility easement for Esplanade by the Islands Lucerna Street, PL20230008065, and accept the conveyance of the Utilities Facilities Deed and the facilities described therein.
