ORDER OF THE SPECIAL MAGISTRATE
THIS CAUSE came before the Special Magistrate for public hearing upon the Respondent's
Challenge to the Petitioner's Determination of a Dangerous Dog on January 19, 2024,and the Special
Magistrate,having heard argument respective to all appropriate matters, hereupon issues his Findings of
Fact,Conclusions of Law and Order of the Special Magistrate, as follows:
FINDINGS OF FACT
1. Respondent,Zachary Waldstein is the owner of the dog named Balashi.
2. On June 3,2023 Balashi bit a minor referred to herein as"A.J."at a birthday party being held
at the Respondent's residence. It is undisputed that A.J. was bitten and Balashi was the dog
which bit her.
3. The Petitioner made a determination,pursuant to Collier County Code of Laws and
Ordinances, Chapter 14, Article II, Section 14-38,that Balashi was a dangerous dog.Notice
of such determination was transmitted verbally to the Respondent on or about October 11,
2023.Notice of such determination was made to the Respondent via hand delivery of a
document entitled"Collier County Domestic Animal Services Sufficient Cause to Classify
Dog as"Dangerous"Pursuant to Collier County Ordinance Chapter 14 Article II Section 14-
38 and/or Chapter 767 Florida Statutes"on November 25,2023. Such hand delivery was
acknowledged by the Respondent signing a"Dangerous Dog Acknowledgement". The
Dangerous Dog Acknowledgement reflected that"Zak Waldstein"had received the following
forms and/or documents:"CCACO 14-38 and Chapter 767 Florida Statutes,Dangerous Dog
Sufficient Cause Letter, including appeal options, Dangerous Dog Registration Application."
(hereafter Notice)Danielle Jersey and Olivia Martinez of Collier County Domestic Animal
Services testified to the delivery of the aforementioned Notice.
4. The notice provided made reference to the applicable laws and ordinances that set out
procedures and penalties for a dangerous dog determination.
5. Respondent timely challenged the Petitioner's determination that Balashi was a dangerous
dog.

6. A Notice of Hearing was mailed to the Respondent by the Petitioner. The Notice of Hearing
stated that a hearing was to be held on a violation of"Dangerous Dog 14-38."
7. Respondent was duly noticed for the public hearing and was present at the hearing and was
represented by counsel Marcy L. Lahart,Esq,
8. All testimony presented at the hearing was under oath.
9. Petitioner's witnesses from Domestic Animal Services(DAS)staff testified to the method of
their investigation of the incident.Those witnesses were Danielle Jersey—Field Operations
Manager, Olivia Martinez—Animal Control Officer and Tad Bartareau.The DAS staff
testified that contact was made with the Respondent, Respondent's wife and other parties
who were in attendance at the birthday party. The witnesses for the Petitioner described an
extensive investigation procedure involving interviews with A.J.,A.J.'s parents and other
witnesses. There were also affidavits produced from Respondent,Respondent's wife Erika
Waldstein, Whitney Stalker,and Anna Rickert. While there were no interviews conducted
with the Respondent, it is found that the investigation substantially met the standards set forth
in §767.12(1), Fla. Stat.
10. The Petitioner's witnesses testified that the dangerous dog determination was authorized by
the County Attorney based upon the investigation undertaken by the DAS staff. The
determination required a legal opinion. The County Attorney's office acts as counsel for the
DAS. The Notice had a signature line for Danielle Jersey, Field Operations Manager for
DAS.
11. It is uncontroverted that the bite took place at a birthday pool party at the Respondent's home.
12. Ms.Adrian Rickert,the mother of A.J. testified that she took A.J.to the party and was called
after A.J. was bitten by Balashi. She further testified that the injury to A.J.took
approximately nine(9) stitches to close and that the care of a plastic surgeon was required.
She also testified that A.J.will need to be evaluated by a plastic surgeon one year after the
injury to determine the need for additional surgery.
13. A.J.,the victim of the bite,testified to the event and was cross-examined by Respondent's
counsel. She testified that Balashi was the animal who bit her. She testified that she did not
squirt the dog with a water gun. There was also an affidavit submitted and authenticated from
Anna Rickert.
14. Photographic evidence was presented and admitted into evidence of the injury to A.J. both
prior to and after medical treatment.
15. Evidence was presented in the form of an affidavit from Richard Szatkowski, an attendee at
the birthday party,which confirmed that Balashi was the animal that bit A.J. Mr. Szatkowski
also testified as a witness for the Respondent. Mr. Szatkowski stated that A.J. was the only
girl at the party and that water guns were out at the party.
16. Affidavits from the Respondent, Respondent's wife Erika Waldstein,and Whitney Stalker
were presented and authenticated. All affidavits confirmed that Balashi had bitten A.J. at the
birthday party. The Affidavits were admitted into evidence.

17. The affidavit submitted by Ms. Stalker provided her impressions of Balashi as being a"really
good dog"and well behaved.
18. Witnesses for the Respondent testified that the Affidavits referenced in Paragraph 16 were
submitted to the Petitioner on behalf of the Respondent, but not requested or elicited by the
Petitioner.
19. The Respondent presented oral testimony of the Respondent,the Respondent's wife Erika
Waldstein, family friend Whitney Stalker, and Richard Szatkowski.
20. The testimony of Zachary Waldstein(Respondent)described the activities of the day and the
events which led to the bite and his reactions to the incident.
21. Ms. Stalker's testimony was solely as to her impressions of Balashi's behavior as she was not
at the event. Her testimony was as to her interactions with Balashi in that he was not an
aggressive animal.
22. Mr. Szatkowski's testimony was eyewitness testimony of the actions of Balashi and A.J. at
the event. His testimony was that A.J. approached Balashi from behind and appeared to try to
hug him immediately prior to the bite.
23. Respondent's counsel advised that the full investigative file was obtained from the Petitioner
by virtue of a public records request.
24. Dr. James W. Crosby testified for the Respondent. He was accepted by the Special Magistrate
as an expert witness on the subject of dog bites. He testified that the dog bite was a Level 4
on the Dunbar Dog Bite Scale. He testified that that was a Moderate bite. The Special
Magistrate has researched the Dunbar Dog Bite scale independently. A Level 4 dog bite,
based upon the Official Authorized Version of the Dunbar scale states in relevant part,
"Levels 4: The dog has insufficient bite inhibition and is very dangerous. Prognosis is poor
because of the difficulty and danger of trying to teach bite inhibition to an adult hard-biting
dog and because absolute owner-compliance is rare."
25. The contradictory nature of Dr. Crosby's testimony results in the testimony as to the
characterization of a Level 4 bite being a"moderate" bite having minimal credibility.
CONCLUSIONS OF LAW
26. There are several issues of law which must be addressed in determining whether the initial
finding that Balashi is a dangerous dog can be upheld.
a. Was the Respondent provided with procedural due process?
b. Was Balashi a dog that inflicted severe injury on a human being pursuant to §767.11
(1)(a)Fla. Stat.?
c. Did A.J. act in a manner that would be considered "... tormenting, abusing, or
assaulting the dog or its owner or a family member." § 767.12 (2)(a), Fla. Stat. such
that Balashi could not be found to be dangerous?
d. Was the investigation "adequate"pursuant to §767.12 (1), Fla. Stat.?

27. Was the Respondent Provided with Procedural Due Process?
The Respondent was provided with the Notice that advised him of the applicable law
regarding dangerous dogs and the penalties which could be imposed if the dog was found
dangerous,see Collier County Domestic Animal Services Sufficient Cause to Classes Dog as
"Dangerous"Pursuant to Collier County Ordinance Chapter 14 Article II Section 14-38
and/or Chapter 767 Florida Statutes, The Respondent was also supplied notice of the hearing
which is evidenced by the appearance of the Respondent represented by counsel at the
January 19, 2024 hearing. Respondent's counsel was well prepared for the case,to the extent
of having retained an expert witness, obtained affidavits from several witnesses, and having
prepared several witnesses to testify.
The Respondent had a significant opportunity to be heard as was evidenced by the
approximately three hour forty five minute length of the hearing.
Thus, it is found that, based upon clear and convincing, substantial competent evidence
presented at the hearing,the Respondent was provided with due process as required by law.
"A quasi-judicial hearing generally meets basic due process requirements if the parties are
provided notice of the hearing and an opportunity to be heard."Jennings v. Dade Cty., 589
So. 2d 1337, 1340 (Fla. 3d DCA 1991)
28. Was Balashi a Dog that Inflicted Severe Injury on a Human Being?
The testimony of Dr. James W. Crosby was that the wound was a Level 4 wound on the
Dunbar Dog Bite Scale. While Dr. Crosby testified that such a wound was a"moderate"bite,
research by the Special Magistrate revealed that is not how the Dunbar Dog Bite Scale
characterizes a Level 4 bite. As noted in Paragraph 21,supra, a level 4 bite is considered very
serious. The remedial actions suggested by the Dunbar Dog Bite Scale for a Level 4 biting
dog are: "...should therefore, be confined to the home at all times and only allowed contact
with adult owners. 2. Whenever, children or guests visit the house, the dog should be confined
to a single locked room or roofed, chain-link run with the only keys kept on a chain around
the neck of each adult owner(to prevent children or guests entering the dog's confinement
area.) 3. The dog is muzzled before leaving the house and only leaves the house for visits to a
veterinary clinic. "
Thus, it is found that the Petitioner proved to a clear and convincing standard of proof, by
substantial competent evidence that Balashi did inflict severe injury on A.J.
29. Did A.J.Act in a Manner that would be considered"... tormenting, abusing,or
assaulting the dog or its owner or a family member." § 767.12 (2) (a),Fla. Stat. ?
Merriam-Webster's online dictionary defines assault as"a violent physical or verbal attack".
Assault is defined in the Wolters Kluwer Bouvier Law Dictionary, Desk Edition as; "An
unlawful act that places a person in reasonable apprehension of an imminent battery."There
was no testimony or evidence that would support the conclusion that A.J. was assaulting
Balashi.
Merriam-Webster's online dictionary defines abuse as applied to this situation as "physical
maltreatment". Abuse is further defined as"Physical or mental maltreatment" in Black's Law
Dictionary 10 (6th Ed. 1990). The evidence presented by the parties does not support a
conclusion that A.J. was abusing Balashi.
Tormenting is defined in Florida Statutes in various ways. "...the words"torture,""torment,"
and "cruelty" shall be held to include every act, omission, or neglect whereby unnecessary or
unjustifiable pain or suffering is caused, except when done in the interest of medical science,
permitted, or allowed to continue when there is reasonable remedy or relief..." § 828.02, Fla.

Stat. The term is defined in Merriam-Webster's online dictionary as"..to cause severe,
usually persistent or recurring distress of body or mind, or distort, twist".
There was no substantial competent evidence presented that would suggest that A.J. was
either"...tormenting, abusing, or assaulting the dog or its owner or a family member..."
Thus, the actions of Balashi are not excused under§ 767.12 (2)(a), Fla. Stat.
30. Was the investigation "adequate" pursuant to 4767.12 (1),Fla. Stat.?
It is found that there was substantial, competent evidence presented that showed to a clear
and convincing standard of proof that the investigation was"adequate"and substantially met
the standards set forth in §767.12 (1), Fla. Stat.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority
granted in Chapter 162, Florida Statutes,to Collier County Code of Laws and Ordinances, Chapter 14,
Article II, Section 14-38, and Collier County Ordinance No. 07-44, as amended,
IT IS HEREBY ORDERED:
The Petitioner's determination of Balashi as a dangerous dog is hereby AFFIRMED. The Petitioner may
avail itself of the remedies set out in Collier County Ordinance Chapter 14 Article II Section 14-38.

APPEAL: If the Special Magistrate's determination is to uphold the dangerous dog classification,
animal services shall provide written notification to the owner as required above in Collier County Code
of Laws and Ordinances, Chapter 14,Article II, Section 14-38. The Respondent may file a written request
for a hearing in circuit court to appeal the classification within ten (10)business days after receiving
notice. This request for hearing must be filed with the circuit court, and a copy provided to animal
services within the time provided. Any such appeal shall not be a hearing de novo but, shall be limited to
appellate review of the record created before the Special Magistrate.

THIS CAUSE, after due and proper notice to Respondents, came on for Public Hearing before the

twelve percent(12%)per annum commencing on the date that this Order is recorded. The Secretary to the
Special Magistrate shall (by regular mail) provide a copy of this Order and the Notice of Assessment of
Lien to the Respondents. If within twenty (20) days of the date of this mailing the Respondents fail to
deliver payment in full to Collier County,the Order and the Notice of Assessment of Lien shall be recorded
in the Official Records of Collier County constituting a lien against the above-described property and, to

ORDER OF THE SPECIAL MAGISTRATE
THIS CAUSE came before the Special Magistrate for public hearing on January 5,2024, and the
Special Magistrate,having received evidence and heard argument respective to all appropriate matters,
hereupon issues his Findings of Fact,Conclusions of Law and Order of the Special Magistrate, as
follows:
FINDINGS OF FACT and CONCLUSIONS OF LAW
1. Respondents, Robert P. and Loretta L. Yardley are the owners of the property located at NO
SITE ADDRESS, Folio 60780560004.
2. Respondents were duly notified of the date of hearing by certified mail and posting and were
not present at the hearing.
3. The Petitioner presented substantial competent evidence in the form of testimony and
pictorial evidence that proved by a preponderance of the evidence that the real property of the
Respondents is in violation of the Collier County Land Development Code 04-41,as
amended, Chapter 5, Section 5.03.02(F)(3),to wit chain link fence in disrepair around entire
parcel.
4. The violation had not been abated as of the date of the public hearing.
5. Respondents were duly noticed for the public hearing regarding the County's Motion and
were not present at the public hearing. Pursuant to Collier County Code of Laws and
Ordinances, Chapter 2,Article IX, Division 4, Section 2-2029(a)(5), "Where notice of the
hearing has been provided to the Violator as provided for herein, a hearing may be conducted
and an order rendered even in the absence of the Violator."It is found that proper notice was
provided in this matter.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority
granted in Chapter 162, Florida Statutes,and Collier County Ordinance No. 07-44, as amended,
IT IS HEREBY ORDERED:
A. Respondents are found guilty of violation of Collier County Land Development Code 04-41, as
amended,Chapter 5, Section 5.03.02(F)(3),to wit chain link fence in disrepair around entire
parcel.
B. Respondents are ordered to pay operational costs in the amount of$111.70 incurred in the
prosecution of this case within thirty(30)calendar days from the date of this hearing
(February 4,2024).
C. Respondents must abate the violation by obtaining all required Collier County Building
Permit(s)or Demolition Permit,inspections,and Certificate of Completion/Occupancy for
the repair of the chain-link fence within 30 calendar days of the date of this hearing
(February 4,2024)or a fine of$100.00 per day will be imposed until the violation is abated.
D. Respondents shall notify the Code Enforcement Investigator within 24 hours of abatement or
compliance in order for the County to conduct a final inspection to confirm abatement.
E. If Respondents fail to abate the violation and comply with this Order,the Collier County Code
Enforcement Department may abate the violation using any appropriate method to bring the
violation into compliance. If necessary,the County may request the services of the Collier County
Sheriffs Office in order to access the property for abatement and enforce the provisions of this
Order. All costs of abatement shall be assessed against the property owner and may become a
lien on the property.

ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted in Chapter 162,
Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Code of Laws & Ordinances, Chapter 14, Article II,
SEC. 14-33(2)FAILURE TO VACCINATE.
B. Respondent is ordered to pay the administrative surcharge in the amount of $5.00 plus a $2.00 surcharge to be
applied to the costs of the 40-hour minimum standards training course for animal control enforcement officers.
C. Respondent is ordered to pay the fine imposed by Collier County Ordinance in the amount of $107.00.
D. Respondent is ordered to pay in total$107.00 on or before March 03,2024.
E. This order may be recorded in the Public Record and shall constitute a lien on all real and personal property
owned by Respondent within Collier County.
