BCC Agenda 02/13/2024 Item #16F 6 (Change Order #2 adding 425 days to Contract #21-7884)02/13/2024 EXECUTIVE SUMMARY Recommendation to approve Change Order No. 2, adding 425 days to the Professional Services Agreement 21-7884 with Matern Professional Engineering, Inc., for the New Chiller Plant Building K. (Project No. 50214) OBJECTIVE: To retain design services throughout the construction phase of this project. CONSIDERATIONS: On January 25, 2022 (Agenda Item 16.C.5), the Board awarded Professional Services Agreement No. 21-7884 (the “Agreement”) to Matern Professional Engineering, Inc. (“Matern”) to provide design services for the new Chiller Plant Building K, Jail Generator and Platform. The project history is as follows: • Original Contract - Board approved January 25, 2022, Item 16C5. o Total contract amount of $1,406,974.00. Total contract time of 720 days. • Amendment #1 - Administratively approved on March 24, 2022. o Revised Schedule F to reflect the employees added/removed from the project. • Change Order #1 - Board approved January 10, 2023, Item 16C3 o Added 120 days to the project and utilized $125,659.20 of the Contingency. • Amendment #2 - Administratively approved on January 13, 2023. o Revised Schedules A, B, B.2.1, and C to include Task 9 Building K Flood Proofing. This added $86,578.40 to the total project amount. On January 9, 2024, the Board approved the Guaranteed Maximum Price (“GMP”) amendment with OAK for construction of the Chiller Plant project. That GMP provided a timeline of 425 days for completion. (Agenda Item 11.G.). The contract with the engineer of record, Matern Professional Engineering, Inc., does not presently provide sufficient days for engineering services to support the project through completion. The additional time needed was unknown until the GMP for the construction portion of this work was awarded. The recommended change order, Change Order No. 2, will add 425 days to Tasks 6 & 7 of the design contract allowing engineering days to match contract duration days. This change does not increase the cost of the Agreement. Change Order No. 2 revises Schedule C, Project Milestone Schedule, of the agreement as follows: Task 1: 30% Construction Documents - 60 days Task 2: 60% Construction Documents - 120 days 16.F.6 Packet Pg. 1823 02/13/2024 Task 3: 90% Construction Documents - 300 days Task 4: 100% Construction Documents - 330 days Task 5: Bidding 7 Permitting - 420 days Task 6: Observation of work - 1205 days Task 7: Commissioning - 1265 days If not approved, the design team will not be available through the completion of the construction and commissioning phase as required by the contract. This item is consistent with the Responsible Governance, Quality of Place, and Infrastructure and Asset Management strategic focus areas of the Collier County Strategic Plan. FISCAL IMPACT: There is no fiscal impact associated with the item. Funding for this project resides within the Infrastructure Sales Tax Fund 3018, New Chiller Plant Building K Project (50214). GROWTH MANAGEMENT IMPACT: There is no impact to the current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT RECOMMENDATION: That the Board approves Change Order No. 2, adding 425 days to Professional Services Agreement 21-7884 with Matern Professional Engineering, Inc., for the New Chiller Plant Building K, and authorize the Chairman to sign the attached Change Order.
