Mr. Kelly I spoke with you briefly some time ago, when as a neighbor, I received a copy of the Petition by mail from the Watermark Condominium seeking approval to allow a private multi-family boat docking facility for boats up to 35 feet that would protrude 123 feet into a waterway in the Vanderbilt Lagoon. You were kind enough to advise me the hearing date was changed to February 8, 2024. I am writing as a neighbor and boater because of my concern with the proposal. I am not sure if I will be able to attend the hearing because I recently fell, but I am expressing my concern and the concerns I have heard from others in case I cannot attend. You previously advised I could ask to include my comments in the record for consideration and I request that they be included. The proposal which seeks a 103 foot boat dock extension in public waterways goes significantly beyond the 20 feet allowed by the Collier County Land Development Code. My issue and that of others is that the Statement that the waterway is 1,695 wide is totally misleading. That may be technically correct, I do not know, but it is literally immediately next to a much narrower area. As a practical matter the waterway is really only a small fraction of that width. There is land from a finger street and canal on the east side of the lagoon which is perhaps several hundred feet wide which extends into the lagoon in the area where the proposed docks would go. Any boat traffic heading north or south immediately by the requested docks would be forced into a very narrow space, nothing like 1,695 feet. The 1,695 feet cited as the width is perhaps the width immediately by the docks but if you go just a few feet away it would be much narrower. I cannot see how it would not be a real safety hazard for boaters, particularly at night. The public good and common sense require that the request for use of public waterways be denied. It is incredible overreach. I believe that a review of photos of the area or maps or a site visit would make this abundantly clear. Thank you for your attention in this matter.
