Item 10A to be heard at 5PM: Moratorium ordinance on privately-initiated Growth Management Plan amendment applications. 1/23/2024 11:42 AM 01/23/2024 EXECUTIVE SUMMARY Recommendation that the Board approve a proposed Ordinance Modification to Collier County Ordinance No. 2006-56, the Rock Road Improvement Municipal Service Taxing Unit (MSTU), to reestablish an advisory committee to provide input to the County on matters related to the MSTU. OBJECTIVE: To allow citizens to provide input and guidance to the County on matters related to the Rock Road MSTU. CONSIDERATION: On November 28, 2006 (Agenda Item #8B), the Board of County Commissioners adopted Ordinance 2006-56, establishing the Rock Road Improvement Municipal Service Taxing Unit (MSTU), providing a means to maintain the roadways and other facilities such as drainage, sidewalks, and street lighting, within the defined boundaries. On June 14, 2011 (Agenda Item #17F), the Board of County Commissioners adopted Ordinance 2011-22 which modified Ordinance 2006-56 and added a five-person advisory committee primarily due to increased interest in paving a portion of Rock Road. On March 28, 2017 (Agenda Item #17.B.1), the Board of County Commissioners adopted Ordinance 2017-09 which modified Ordinance 2006-56 by dissolution of the Rock Road Improvement Municipal Service Taxing Unit Advisory Committee. The northern one mile of Rock Road had been paved, and no additional money was available for future projects until the improvement loan was satisfied. Two of the three advisory committee positions had remained open for some time. Two town hall meetings have been held during the past year to discuss relevant issues with the citizens using Rock Road and adjacent roadways. The reestablishment of an advisory committee is recommended to improve communication between the property owners within the MSTU and the County. An advisory committee can bett er communicate recommendations for future projects within the MSTU. The proposed five-member advisory committee would meet quarterly to help set the work program within the MSTU. This item is consistent with Collier County’s responsible governance strategic plan objective to encourage active community engagement and participation. Permission to advertise this Ordinance Modification was given by the Board on July 11, 2023, (Agenda Item #16B1) and advertised on September 6, 2023, and January 3, 2024., this item (Agenda Item #17B) was continued at the September 26, 2023 Board meeting. The Business Impact Estimate required by Section 125.66(3) F.S. was timely posted to the county website and is attached as backup to this agenda item. This item is consistent with Collier County’s responsible governance strategic plan objective for quality of place. FISCAL IMPACT: The current Rock Road MSTU budget is based on the adopted FY24 millage rate of 0.2847 per $1,000 of taxable value which is anticipated to generate $24,300. Reimbursement for administrative costs associated with the operations of the MSTU is covered by a transfer to the Unincorporated General Fund (1011) from Rock Road MSTU Fund (1632). Summary of the proposed ordinance (must include a statement of the public purpose, such as serving the public health, safety, morals and welfare): The Ordinance is proposed to add an Advisory Committee to the Rock Road MSTU. The public purpose of this ordinance will serve the safety and welfare of this community. This 5-member committee will meet and vote on any beautification and safety improvements within the Rock Road MSTU boundary per the guidelines of the ordinance. 2. An estimate of the direct economic impact of the proposed ordinance on private, for - profit businesses in the County, if any: (a) An estimate of direct compliance costs that businesses may reasonably incur; (b) Any new charge or fee imposed by the proposed ordinance or for which businesses will be financially responsible; and (c) An estimate of the County’s regulatory costs, including estimated revenues from any new charges or fees to cover such costs.
