EXECUTIVE SUMMARY
Recommendation that the Board approve a proposed Ordinance Modification to Collier County Ordinance
No. 2006-56, the Rock Road Improvement Municipal Service Taxing Unit (MSTU), to reestablish an
advisory committee to provide input to the County on matters related to the MSTU.
OBJECTIVE: To allow citizens to provide input and guidance to the County on matters related to the Rock Road
MSTU.
CONSIDERATION: On November 28, 2006 (Agenda Item #8B), the Board of County Commissioners adopted
Ordinance 2006-56, establishing the Rock Road Improvement Municipal Service Taxing Unit (MSTU), providing a
means to maintain the roadways and other facilities such as drainage, sidewalks, and street lighting, within the
defined boundaries.
On June 14, 2011 (Agenda Item #17F), the Board of County Commissioners adopted Ordinance 2011-22 which
modified Ordinance 2006-56 and added a five-person advisory committee primarily due to increased interest in
paving a portion of Rock Road.
On March 28, 2017 (Agenda Item #17.B.1), the Board of County Commissioners adopted Ordinance 2017-09
which modified Ordinance 2006-56 by dissolution of the Rock Road Improvement Municipal Service Taxing Unit
Advisory Committee. The northern one mile of Rock Road had been paved, and no additional money was
available for future projects until the improvement loan was satisfied. Two of the three advisory committee
positions had remained open for some time.
Two town hall meetings have been held during the past year to discuss relevant issues with the citizens using Rock
Road and adjacent roadways. The reestablishment of an advisory committee is recommended to improve
communication between the property owners within the MSTU and the County. An advisory committee can bett er
communicate recommendations for future projects within the MSTU. The proposed five-member advisory
committee would meet quarterly to help set the work program within the MSTU. This item is consistent with
Collier County’s responsible governance strategic plan objective to encourage active community engagement and
participation.
Permission to advertise this Ordinance Modification was given by the Board on July 11, 2023, (Agenda Item
#16B1) and advertised on September 6, 2023, and January 3, 2024., this item (Agenda Item #17B) was continued at
the September 26, 2023 Board meeting.
The Business Impact Estimate required by Section 125.66(3) F.S. was timely posted to the county website and is
attached as backup to this agenda item. This item is consistent with Collier County’s responsible governance
strategic plan objective for quality of place.
FISCAL IMPACT: The current Rock Road MSTU budget is based on the adopted FY24 millage rate of 0.2847
per $1,000 of taxable value which is anticipated to generate $24,300. Reimbursement for administrative costs
associated with the operations of the MSTU is covered by a transfer to the Unincorporated General Fund (1011)
from Rock Road MSTU Fund (1632).
LEGAL CONSIDERATIONS: The item has been reviewed by the County Attorney, is approved as to form and
legality and requires majority vote for Board approval. -JAK
GROWTH MANAGEMENT IMPACT: This item supports the transportation element objective to encourage
safe and efficient mobility for the rural public that remains consistent with the character of the rural areas of Collier
County.

WHEREAS. on November 28. 2006. the Board of County Commissioners adopted
Ordinance No. 2006-56, establishing the Rock Road Improvement Municipal Service Taxing Unit;
and
WHEREAS, the Board of County Commissioners is the governing body of the Rock Road
Improvement Municipal Service Taxing Unit (the "MSTIJ") and directed staff to advertise an
amendment to Ordinance No. 2006-56 to: (1) amend the geographical boundaries of the MS11J to
remove those property owners that no longer have access to nor otherwise derive any benefit from
the MSTU's stated purpose and to include all property owners within the MSTU's amended
geographical boundaries; and (2) create an advisory committee that will meet semi-annually to work
with County Staff to review and recommend work programs and priorities to accomplish the
MSTU's purpose; and
WHEREAS, on June 14.2011, the Board of County Commissioners as the governing body
of the MSTU approved this amendment to Ordinance No. 2006-56.

The functions. DOwers and duties of the Committee shall be as follows:
A. To aid and assist the Board of County Commissioners in carrying out the PlIrj)Ose of the
MSTU as set forth in this Ordinance.
B. The Committee shall meet semi-annually to review and recommend work proarams and
priorities to the County Manager or his designee in accordance with the adopted budget
or budget amendments which may be adopted bv the Board of County Commissioners.
The execution of work programs shall be under the direct suoervision and responsibili~
of the County ManaDer or his designee. Said work may be performed under contract (in
accordance with law) or by County forces.
C. The Committee may adopt and amend "Guidelines" to govern the operation of the
MSlU. subiect to approval bv the Board of County Commissioners.
Section SiI: Confliet and Sevenbilitv
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
Sedion Seven: Iaelu.ion ia The Code of Laws and Ordinanees
The provisions of this Ordinance sball become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-
lettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or
any other appropriate word.
Section Eiaht: Effeetive Date
This Ordinance shall be effective upon filing with the Florida Department of State.

ROAD IMPROVEMENT MUNICIPAL SERVICE TAXING UNIT
ADVISORY COMMITTEE; PROVIDING FOR CONFLICT AND
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF
LAWS AND ORDINANCES; AND PROVIDING FOR EFFECTIVE DATE.

which was accomplished in 2015; and
WHEREAS, with this objective met, staff recommends dissolving the Advisory
Committee and removing all references to the Advisory Committee from the Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,that
SECTION ONE: Dissolution of the Rock Road Improvement Municipal Service Taxing
Unit Advisory Committee.
Except for Section One, which amended the boundaries of the MSTU, Ordinance No.
2011-22 is hereby repealed, and the Rock Road Improvement Municipal Service Taxing Unit
Advisory Committee is hereby dissolved.

SECTION TWO: Conflict and Severability
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION THREE: Inclusion in the Code of Laws and Ordinances
The provisions of this Ordinance shall become and be made a part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or
re-lettered to accomplish such, and the word "ordinance" may be changed to "section," "article,"
or any other appropriate word.
SECTION FOUR: Effective Date
This Ordinance shall be effective upon filing with the Florida Department of State.

Proposed ordinance’s Short Title: Modify Ordinance to add Advisory Committee to Rock
Road MSTU.
This Business Impact Estimate is provided in accordance with section 125.66(3), Florida
Statutes. If one or more boxes are checked below, this means t he County is of the view
that a business impact estimate is not required by state law1 for the proposed ordinance,
but the County is, nevertheless, providing this Business Impact Estimate as a courtesy
and to avoid any procedural issues that could impact the enactment of the proposed
ordinance. This Business Impact Estimate may be revised following its initial posting.

In accordance with the provisions of controlling law, even notwithstanding the fact that
an exemption noted above may apply, the County hereby publishes the following
information:
1. Summary of the proposed ordinance (must include a statement of the public purpose,
such as serving the public health, safety, morals and welfare):
The Ordinance is proposed to add an Advisory Committee to the Rock Road MSTU. The
public purpose of this ordinance will serve the safety and welfare of this community. This
5-member committee will meet and vote on any beautification and safety improvements
within the Rock Road MSTU boundary per the guidelines of the ordinance.
2. An estimate of the direct economic impact of the proposed ordinance on private, for -
profit businesses in the County, if any:
(a) An estimate of direct compliance costs that businesses may reasonably incur;
(b) Any new charge or fee imposed by the proposed ordinance or for which businesses
will be financially responsible; and
(c) An estimate of the County’s regulatory costs, including estimated revenues from any
new charges or fees to cover such costs.
This ordinance modification creates no direct economic impact on any bus inesses within
the Rock Road MSTU boundary.
3. Good faith estimate of the number of businesses likely to be impacted by the proposed
ordinance:
