Agenda 01/23/2024 Item #16A 3 (Release of Code Enforcement Lien - Leonel Garza)01/23/2024 EXECUTIVE SUMMARY Recommendation to approve the release of a code enforcement lien with an accrued value of $46,800 for a reduced payment of $1,704.20 in the code enforcement action titled Board of County Commissioners v. Leonel Garza et al., in Code Enforcement Board Case No. CEPM20090017577, relating to property located at 111 S. 7th St., Collier County, Florida. OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with an accrued value of $46,800 for a reduced payment of $1,704.20 in relation to Code Enforcement Board Case No. CEPM20090017577. CONSIDERATIONS: In Case No. CEPM20090017577, the Code Enforcement Board ordered the imposition of a lien against Leonel Garza et al., for violations consisting of missing window screens, unsafe footsteps, exterior walls with holes, breaks, and loose or rotting materials on a structure that was not weatherproofed or maintained in good repair. The lien was recorded in the Official Records on February 10, 2011, at O .R. Book 4651, Page 568, in the amount of $13,884.01. Fines continued to accrue for 234 days ($200 per day from November 13, 2009, through July 11, 2011) for a total of $46,800 plus $84.01 in operational costs for a final total of $46,884.01. Payment of operating costs in the amount of $84.01 was made, leaving an outstanding balance of $46,800. Raul and Leonel Garza, Thomas Garza’s parents, brought the property into compliance on July 11, 2011, by obtaining a demolition permit and leaving the parcel as an unimproved property. Thomas Garza’s father, Raul Garza, passed away on April 22, 2012, without having resolved the lien on the property. Thomas Garza became the property owner as of December 2, 2020, and is now seeking relief. FISCAL IMPACT: Acceptance of a payment of $1,704.20 to settle the lien will correlate to what is outlined in Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: No growth management impact is associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2023-90. RTT RECOMMENDATION: To approve the recommended reduction of fines in the amount of $45,095.80, accept payment in the amount of $1,704.20, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records.
