Ai'SOCIATES, REPRESENTING COASTAL BEACH FRONT JOINT
VENTURE, REQUESTING A VARIANCE FROM THE COASTAL
CONSTRUCTION CONTROL LINE (CCCL) FOR PROPERTY
LOCATED JUST SOUTH OF CLAM PASS PARK ON SEAGATE
DRIVE (SECTION 16, TOWNSHIP 49, RANGE 25).
WHEREAS, Hole, Montes, & Associates, Inc. , agent for Coastal
Beach Front Joint Venture, has requested a variance from the Coastal .

Construction Control Line (CCCL) as required by Ordinance 75-19 for the
•
purposes of constructing a dune zone elevated boardwalk, removing
Australian pines, revegetating the dune zone with native species, and
using a 25 foot wide strip parallel and adjacent to the CCCL as an
access corridor on the following property: 1

Commencing at the Southeast corner of Government Lot 1, Section 16,
. Township 49 South, Range 25 East, Collier County, Florida; thence 4, '
4 Westerly along the South boundary of said Government Lot 1 for a distance
of 2,326.85 feet to a concrete monument; thence North 04°41'40" West a
distance of 225 feet to a concrete monument which is the POINT OF •
BEGINNING, thence continuing North 04°41'40" West to a point designated
by a concrete monument, caid point being 475 feet Northerly from the
South boundary of Government Lot 1 measured on a perpendicular from said r .
South Boundary of Government Lot 1; thence Westerly and parallel to said ,
South boundary on Government Lot 1 a distance of 400 feet, more or less,
to the waters of the Gulf of Mexico; thence Southerly along said waters

BEGINNING; EXCEPTING THEREFROM a strip of land sixty (60) feet wide for rt
roadway purposes being described as follows: The Easterly 60 feet as
measured normal to the Easterly line of the lands as set out in
Instrument Number 45237 as recorded in Official Record Book 34 at Pages •
301 and 302 of the Public Records of Collier County, Florida; and •

Y`1c WHERFAS, the Collier County Board of County Commissioners has
reviewed the Executive Summary prepared by the Natural Resources
Management Department (NRMD) regarding the petition,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Collier County, Florida that petition CCCL-86-2C be granted subject
57 =' to the conditions listed below:
(1) The boardwalk must be built to Florida Department of Natural •'
� ' +r Resources specifications and impact on the dune and native dune
vegetation must be kept to a minimum.
(2) Australian pines must be removed from the dune zone.
(3) The construction access corridor to run
proposed parallel to
the CCCL just must conform to the following:
(a) The 25 foot wide access corridor shall exist as proposed
•
for the northern half of the site.
(b) The southern half of the subject property dune zone
contains a well developed coastal hammock consisting of large • •
seagrape, sabal palms, and associated vegetation. Impact on
this coastal vegetation shall be minimized by restricting the
• c' �, • access corridor to a width of 14 feet in the areas adjacent to
the seagrape. Prior to use of the access corridor, portions
of the sengrape in this 14 foot strip shall be carefully
removed by qualified persons, and any rooted portions replanted
along the seaward edge of the seagrape.
• (c) The coastal hammock to be preserved shall be fenced or
roped off for the duration of construction activities.
(4) All portions of the dune zone negatively affected by construc—
tion operations shall be restored to natural grade and revegetated
using plants native to the dune zone of south Florida.
(5) The NAM must be notified one (1) week prior to any work in the
•
dune zone.
• (6) A vehicle on the beach permit must be secured from the NR11D
prior to any construction vehicles using the access corridor.
(7) No vehicles may be stored overnight in the dune zone.
(8) No equipment or construction materials may be stored in the
dune zone.
