Dear Commissioner,
This letter is a summary of our Nov. 16th meeting with Noel Davies, the applicant’s attorney.
Andrew Blitch called us on the evening of Wed. Nov. 15th, to advise us that Mr. Davies wanted to
meet the following morning. We agreed to attend the meeting with Andrew. We all assumed that
we were meeting to hear what the developers proposed to change, as per the Commissioner’s
instructions. The continuance was requested by Mr. Davies, and he agreed at the last
Commissioners meeting, to come up with a plan that we would be willing to negotiate. Once we
entered Mr. Davies’s conference room, he aggressively asked us what OUR proposal was. We
replied that the Commissioners told the developers to come to us with a plan. Mr. Davies stated
that he would not divulge their plan so that we could "shoot it down”. The meeting went downhill
from there. It was a very unpleasant meeting that resulted in nothing . We repeatedly asked Mr.
Davies what the new plans were, and we were ignored for the duration of the meeting. A few
days after this meeting, Mr. Davies’ office sent the neighborhood a letter stating that they were
willing to meet with anyone interested in speaking to him. We view this as their ploy to suggest
that they were willing to discuss their plans. We know this is not the case. As of today, Dec.5th,
Andrew has heard nothing from Mr. Davies. The Commissioners advised the developers that if
they wanted a continuance, they needed to include us in this process. As of now, they have
refused to do so.

We purchased our 5 acre property at 4316 13th Ave SW in 1998, and built our house on that property in 2002. We
first checked the zoning to be sure we were in a protected residential zone, and the zoning confirmed that the land was
in such an area. Our only concern was the FPL facility, but we knew that it was and is an essential need, and that FPL
would comply with all environmental, aesthetic, and safety codes.
Growth has had a negative impact on our homesite in several ways. First, the FPL site was expanded north to
13th Ave. This land was acquired from a private property owner. It was five acres of residential zoned land. While FPL
complied with code, we still would have preferred to have had homes built on the property that was zoned residential.
The second negative impact of growth in our immediate area was expanding to six lanes of Collier Blvd.. I don’t precisely
understand why, but it is now more difficult to access Collier Blvd for us on 13 th Ave and surrounding avenues . There
seems to be more traffic now than when Collier was 4 lanes. Go figure ! Going north on Collier now requires us to go
south on Collier approximately a mile and then make a U-turn at Green Blvd..

As reasonable citizens, we understand that these two developments are in the Essential Need category and we
just have to bite the bullet. The need category for this proposed storage unit is in the zero need category. In fact it is a
detriment. Also, the north end of the proposal is directly across the street from a residence. The home immediately
across from the proposal, is a family with four young children. For many reasons, this is a serious safety issue. There is a
school bus stop at the intersection that will be drastically impacted by this proposal ,as well. This would be an
extremely concerning safety issue for all the K-12 children and their parents, that have a bus stop at the end of 13 th Ave.
As far as the need issue, the smallest residential lots in the surrounding area are 1 ¼ acre and expand to five
acres. Anyone can easily obtain a permit, purchase a shed, and air condition it for much less than the cost to rent a
storage unit . This puts the storage facility in a zero need category for the area.
The applicants keep chanting that they want to be good neighbors. They can do that by simply putting their
project in an area already zoned for commercial. We bought homes here for a reason, and we want to continue to have
a quality of life that we envisioned would continue, and ultimately be protected from commercial rezoning. Just say no
to rezoning. Three of the Planning Commissioners did. We want to keep our quiet, safe street from commercial
encroachment.

As a Resident of 13th Ave SW I am writing to you to let you know that if this Rezone is OK'D
and that Colossal Self Storage Warehouse is built we will All Perish!
No building this Big, 174,000 SF, should be built on 5.4 Acres and right next to a 2
substation Florida Power & Light that sits on 20 Acres. We have had two fires on 13th Ave SW
before and the fire tore down the street and ended in our backyard. I was never so scared in
my life. The last fire was in April 2009 and the flames were 40ft high. They finally had to call in
two Helicopters to put it out. I never want to go through that again!
We are "Land Locked" in that I mean we have no where to go to get out and off of 13th Ave
should anything happen. The Residents of 11th Ave SW have the Brooks Shopping Center to
exit the street. The Residents of 15th Ave SW have the Medical Building and the Post Office to
escape. We have no escape anywhere should a fire start around the Warehouse with the
wires and spires of the Electric Facility. People throw their smoking butts anyplace and
especially with people coming to the warehouse. They are not careful where they throw them
and We would all be Trapped!

Please, think of us! We should not have to live in Fear! We all are Careful and love the
peace and quiet with No intruders!
We have to be very Careful these days because no one else is who do not live on this land.

Yesterday the planning commission voted on the Storage unit on 13th ave sw. The vote was 3-3, so
therefore they did not officially recommend this project move forward. I spoke at yesterday’s
meeting and also wrote a letter of opposition.I have attached my letter of opposition to the
proposed self storage unit on 13th ave sw. I outlined several inconsistencies with the Golden Gate
Area Master Plan and was hoping you had a moment to speak with me about it in person. Please let

I am writing on behalf of concerned residents to express our collective opposition to the
proposed construction of a 168,856 sq. ft. storage warehouse at the intersection of 13th
Ave SW and Collier Blvd. There are numerous legal and planning concerns that warrant
the reconsideration of this project, which I have detailed below.
1. Insufficient Public Disclosure: To date, there have been no renderings or visual
depictions of the proposed warehouse provided to the public. This lack of
disclosure may violate applicable notice and transparency requirements under

local zoning and land use regulations, and it raises concerns about the project's
compliance with community planning guidelines and architectural standards.
2. Non-Compliant Ingress/Egress: The warehouse's proposed access design includes
only one lane for ingress and egress from Collier Blvd. This arrangement
contravenes local traffic and access regulations and poses a significant safety risk
to both warehouse employees and nearby residents.
3. Inadequate Traffic Accommodations: The current infrastructure at the proposed
site does not account for a left turning lane for vehicles traveling from South to
North on Collier Blvd. This oversight could lead to increased congestion and
safety hazards and may necessitate further review under local traffic impact
assessment requirements.
4. Traffic Impact Analysis: A recent study conducted on April 12, 2023, recorded
6,371 vehicles traveling from North to South on Collier Blvd between 6:00 am and
9:00 am. The construction of this warehouse is likely to exacerbate existing traffic
problems and may require a comprehensive traffic impact analysis to ensure
compliance with local regulations and to identify necessary mitigation measures.
5. Proximity to Florida Power & Light Plant: The proposed warehouse, which would
be the largest in Collier County at four stories high, is located adjacent to a major
Florida Power & Light Plant. Building public storage facilities near power plants
generally contravenes best practices in land use planning due to the potential
safety risks and hazards associated with power plant operations.
6. Redundant Development: The existing warehouse inventory in the area, which
includes 13 warehouses on Collier Blvd and 57 in Collier County, calls into
question the need for additional storage facilities. This overdevelopment may run
counter to sustainable land use and community planning principles.
7. Emergency Access and Egress: The proposed warehouse's landlocked location on
13th Ave SW poses a significant concern regarding emergency access and egress.
Should an incident occur involving the storage facility and the adjacent electric
plant, the limited escape routes may impede emergency response efforts and
endanger occupants.
In light of the aforementioned legal and planning concerns, I respectfully request that
you reconsider the approval of the proposed warehouse at 13th Ave SW and Collier
Blvd. The safety, well-being, and responsible development of our community should be
prioritized.

Hi Bill,
As discussed, I’m forwarding the email from staff pushing our BCC hearing date from 6/13 to 9/26. As
we discussed, we don’t think this project is contentious other than us agreeing to disagree with
transportation staff about the desired access point. We relocated our access point from 13 th Ave to
951 following the NIM in order to address concerns from the neighbors. Staff still wants access to be
along 13th Ave.
We were found sufficient at the beginning of April. The proposed September date would represent a
6.5 month hearing process, after being found sufficient. We have been in process for over a year.
Our client is having to pay for contract extensions and experiencing hardship caused by this delay.
We respectfully ask to be kept on the June agenda as originally planned.

Commissioner, I watched some of the hearing of October 10th and then replayed the public testimony of the self
storage. your first speaker ( Richard LaGarge) was troubling on what he said under oath. Mr LaGarge compared the
sizing proposed self storage to WaterSide Shops, Naples Community Hospital and the Amazon distribution center. The
Fact are Waterside shops is almost a million square feet 915,768 Naples Community Hospital 599,385 square feet and
Amazon 477,062 square feet. My square footage figures are from the Collier County Property Appraiser and attached.
Mr LaGarge did not provide evidence , just testimony comparing these properties to the sel-storage on 13th
I guess what's disturbing that set the stage for the rest of the speakers and obviously all scripted. Mr LaGage is a trial
lawyer who practises in Texas And Florida you would think lawyers have a higher standard when it come the
testimony under oath. bottom line the three sites are much bigger then what was said in your meeting Tom Henning

Dear Commissioner McDaniel,
We purchased our 5 acre property at 4316 13th Ave SW in 1998, and built our house on that property in 2002. We
first checked the zoning to be sure we were in a protected residential zone, and the zoning confirmed that the land was
in such an area. Our only concern was the FPL facility, but we knew that it was and is an essential need, and that FPL
would comply with all environmental, aesthetic, and safety codes.
Growth has had a negative impact on our homesite in several ways. First, the FPL site was expanded north to
13th Ave. This land was acquired from a private property owner. It was five acres of residential zoned land. While FPL
complied with code, we still would have preferred to have had homes built on the property that was zoned residential.
The second negative impact of growth in our immediate area was expanding to six lanes of Collier Blvd.. I don’t precisely
understand why, but it is now more difficult to access Collier Blvd for us on 13 th Ave and surrounding avenues . There
seems to be more traffic now than when Collier was 4 lanes. Go figure ! Going north on Collier now requires us to go
south on Collier approximately a mile and then make a U-turn at Green Blvd..
As reasonable citizens, we understand that these two developments are in the Essential Need category and we
just have to bite the bullet. The need category for this proposed storage unit is in the zero need category. In fact it is a
detriment. Also, the north end of the proposal is directly across the street from a residence. The home immediately
across from the proposal, is a family with four young children. For many reasons, this is a serious safety issue. There is a
school bus stop at the intersection that will be drastically impacted by this proposal ,as well. This would be an
extremely concerning safety issue for all the K-12 children and their parents, that have a bus stop at the end of 13 th Ave.
As far as the need issue, the smallest residential lots in the surrounding area are 1 ¼ acre and expand to five
acres. Anyone can easily obtain a permit, purchase a shed, and air condition it for much less than the cost to rent a
storage unit . This puts the storage facility in a zero need category for the area.
The applicants keep chanting that they want to be good neighbors. They can do that by simply putting their
project in an area already zoned for commercial. We bought homes here for a reason, and we want to continue to have
a quality of life that we envisioned would continue, and ultimately be protected from commercial rezoning. Just say no
to rezoning. Three of the Planning Commissioners did. We want to keep our quiet, safe street from commercial
encroachment.

Dear Commissionier McDaniel,
I am writing to express my deep concern about the proposed construction of a massive self storage warehouse at
4050 13th Ave SW and Collier Blvd in our family neighborhood. As a concerned citizen and young professional who
recently purchased a family home nearby on 11th Ave SW, I strongly believe that this facility should not be built, and
I urge you to oppose its construction.
The proposed self storage warehouse would be the largest in Collier County, and its construction poses a significant
risk to our community. Self storage facilities are known to attract criminal activity such as theft and vandalism, and
studies have shown that areas surrounding these facilities are at a higher risk of crime. Furthermore, these facilities
are also known to contribute to increased traffic congestion, which is already a problem in our neighborhood.
The ingress/egress for the proposed warehouse is one lane in and one lane out from Collier Blvd, which is illegal
and poses a significant traffic risk, especially during peak hours. According to a study on April 12, 2023, there were
6,371 cars traveling from north to south on Collier Blvd from 6 am to 9 am, and the addition of a massive self
storage warehouse would only exacerbate this problem. The heavy traffic generated by this facility would be a
safety hazard for our children and families, particularly those who use the nearby bus stops.
Additionally, the proposed warehouse is four stories high and will be located next to a massive Florida Power and
Light plant. It is not generally recommended to build a public storage facility near a power plant due to inherent
safety risks associated with the operation of power plants and Florida's Electric Grid. In the event of a fire or other
emergency, the potential danger posed by this facility would be amplified, particularly given that 11th, 13th, and 15th
Aves are landlocked, and no one would be able to get out in such an event.
Furthermore, there is no real need for another self storage warehouse in our area. There is already one only three
miles away, and there are 13 on Collier Blvd and 57 in Collier County. Therefore, it is clear that the proposed
warehouse is unnecessary and would only serve to endanger our community and our neighborhood children.
In conclusion, I urge you to oppose the construction of the self storage warehouse in our neighborhood. Its potential
safety hazards, traffic congestion, and lack of need make it an inappropriate development for our community. I
believe that it is in the best interest of our community to find an alternative use for this property that does not pose
such a significant risk to our safety and wellbeing.
Thank you for your attention to this matter. I hope you will consider the data and risks associated with self storage
facilities in making your decision, and I look forward to hearing your thoughts on this issue and your support in
stopping the proposed development.

Good Day Commissioner McDaniel,
I appreciate your views expressed at the last hearing on the above items, now scheduled for Tuesday's BCC meeting. I
would like to show you an example of a residential area in Collier County that shares a property line with both an FPL
sub-station (2.6 acres in size) and a 6-lane separated highway (the same as the project site).
As you know, the applicant has made that argument that the "orphaned" nature of the 5+ ac. property resulting from its
location adjacent to an FPL substation on two sides, and a 6 lane road on the other, no longer lends itself to residential
use. I firmly disagree with the premised nature of the lot. SF Residential would be a viable use, as demonstrated by the
below example. Please keep in mind also, the property was never offered as a residential on the market, instead was
advertised as future commercial. It was purchased for pennies on the dollar when compared to commercial property
available for purchase.
Golden Gate Estates rural nature is highly valued by the people that live there. Large lots and ample natural landscaping
help to buffer those lots closer to busy roadways, such as the subject 5 acres. Lots are 2.5 acres in size minimum. We
want to see more houses, not industrial facilities. The GMP allows for a school or other essential service station, as
granted in the GGAMP by right, and these uses would be far more congruent. This storage facility is not a granted
right. We hope that you may provide support to the people who have lived their lives and spent their money in this
neighborhood, over the developers asking for the right to change the GGAMP.
The location of this facility can be found by entering the address of the house in yellow: 1405 SOLANA
RD. I have attached the image to this email as well. The FPL facility is located at the bottom of the image.

Our Collier County Commissioners, With the December 12 Zoning Hearing fast approaching, we want to bring you up to
date on our efforts to mitigate the impact of a request to rezone and amend our Marco Shores PUD. This request to add
another 90 apartment homes brings with it the potential of 180 more cars traveling up and down our quiet dead end
street. Mainsail Drive has been very inviting and popular over the years for “on road” walkers, joggers and bike
riders. It’s our Marco Shores lifestyle. Our narrow sidewalks are not conducive to this much activity. It’s hard to ignore
the substantial increase in traffic from the new 100 apartments racing up and down our curvy winding one mile
roadway. We are concerned about our SAFETY. By Collier County’s own admission “the benefits of median strip
landscaping have been directly related to traffic calming”.
We are appealing to the Collier County Land Development Code: 1.05.01 - Purpose and Intent
B. In order to foster and preserve public health, safety, comfort and welfare, and to aid in the harmonious,
orderly, and progressive development of the unincorporated areas of Collier County, it is the intent of this
LDC that the development process in Collier County be efficient, in terms of time and expense, effective, in
terms of addressing the natural resource and public facility implications of proposed development, and
equitable, in terms of consistency with established regulations and procedures, respect for the rights of
property owners, and consideration of the interests of the citizens of Collier County.
The Collier County Staff Report dated 08/23/2023 recommends approval. The Collier County Planning Commission
voted on October 5, 2023 to approve WITH the following amendment, “The petitioner, Marco Shores residents, as well
as the Airport Authority and the County come to an agreement for the Mainsail Drive median”. Our hope is that all
aforementioned parties have some “skin” in the game. Our Marco Shores community realizes the “traffic calming”
benefit of median landscaping and offer to establish a MSTU for future maintenance.
As requested by Commissioner LoCastro, Trinity Scott, Department Head Transportation and The Planning Commission,
we have opened a dialogue with the applicant/petitioner. We have had a couple of meetings that have
generated an offer from the developer. That offer falls way below what is nee ded to complete this
project and mitigate the impact to the 550 homes of Marco Shores (excluding Hammock Bay). We
are leaning on the developer to shoulder the initial cost of this project. After all it’s HIS petition to not just rezone this
property but to ALSO amend our PUD. We’re not asking for much. Estimates are less than 2 months of rental income
from the proposed 90 apartments. We liken our request to an “enhanced buffer” to calm the increased traffic and
strongly feel this is in proportion to the impact on our residents.

substation Florida Power & Light that sits on 20 Acres. We have had two fires on 13th Ave SW
before and the fire tore down the street and ended in our backyard. I was never so scared in
my life. The last fire was in April 2009 and the flames were 40ft high. They finally had to call in
two Helicopters to put it out. I never want to go through that again!
We are "Land Locked" in that I mean we have no where to go to get out and off of 13th Ave
should anything happen. The Residents of 11th Ave SW have the Brooks Shopping Center to
exit the street. The Residents of 15th Ave SW have the Medical Building and the Post Office to
escape. We have no escape anywhere should a fire start around the Warehouse with the
wires and spires of the Electric Facility. People throw their smoking butts anyplace and
especially with people coming to the warehouse. They are not careful where they throw them
and We would all be Trapped!

Please, think of us! We should not have to live in Fear! We all are Careful and love the
peace and quiet with No intruders!
We have to be very Careful these days because no one else is who do not live on this land.

Jaime it was good to meet with you this Tuesday morning before the BOCC meeting. Although we are
disappointed in not being on the consent agenda that morning, we are acceptable to the alternative you
provided.
To reiterate, this is my understanding of that conversation.
Neal Communities and the County will continue with the minor items remaining on the utility acceptance. For
reference the fire flow tests were completed on Tuesday and sent to the County. Lucia Martin has recorded
the legal documents and we are processing the payment for the recording as I write this.
Our next step is to schedule the site inspection with Joe Bianchi’s group. That will happen early next week
once the stop sign, ADA mats and striping are completed. One the site inspection passes we can then start
scheduling the 800 series inspections and final inspections on the individual homes. Once all of the required
inspections pass on the individual homes the County will issue a temporary CO. After the BOCC meeting on
12/13 where the utilities for this phase pass, you will coordinate with Fred Klum in the building department to
have the temporary CO’s changed to standard CO’s. This transition will happen immediately after the
approval of the consent agenda on 12/13.
We will provide you with the list of homes receiving temporary CO’s that will need to be changed in advance
of that meeting.
Let me know of any comments on this and after your confirmation with Fred Klum regarding the temporary
CO transfers to standard CO’s.

Jaime I had a chance to discuss the BOCC approval schedules for Skysail Phase 1.2 utilities with Commissioner
McDaniel.
As discussed earlier we have received the approval on the preliminary UFA package on 9/27.
Our site inspection is scheduled for this Thursday 10/20 at 9:00 AM.
Once that inspection has passed we will be ready for our final approval of the utilities in this phase of Skysail.
As we saw at the last BOCC meeting it is possible to have items "walked on" to the consent agenda.
Commissioner McDaniel stated that if we do pass our inspections on the 20th, which we will, he is amenable to adding
the final utility acceptance to the 10/25 BOCC Consent Agenda for Skysail Phase 1.2.
I trust that this scenario is acceptable to your team as well.

Bill below is an e-mail I sent to Jaime. I have been in discussions with her on this new process and how long it is taking
to get approvals. I asked that we can be put on the consent agenda based on the UFA being approved instead of the
inspection passing. As you can see the inspections are lagging.
If this was the case we would be on the 11/8 BOCC meeting. However since I saw the item walked onto the consent
agenda this morning (your item) I am wondering why we cannot be scheduled even earlier and get delayed if an issue
comes up.
