EXECUTIVE SUMMARY
This item requires that Commission members provide ex -parte disclosure. Should a hearing be held on this
item, all participants are required to be sworn in. Recommendation to adopt an Ordinance amending
Ordinance Number 90-028, the Monterey Planned Unit Development (PUD), to correct a scrivener’s error
in Section 2.04.05 of the PUD Document relating to floor area; and providing for an effective date. The
subject 194.03 ± acre PUD is located on the south side of Vanderbilt Beach Road and north of Orange
Blossom Drive approximately 900 feet east of Goodlette-Frank Road in Section 2, Township 49 South, Range
25 East, in Collier County, Florida.

OBJECTIVE: To have the Board of County Commissioners (BCC) correct a Scrivener’s Error in Ordinance
Number 90-028 relating to the Monterey RPUD, formerly known as the Woodbridge RPUD.
CONSIDERATIONS: On June 4, 1985, the BCC approved Ordinance Number 85-25, the Woodbridge PUD,
which quantified the minimum floor area for single-family residences in Section 2.04.05 as shown below:
2.04.05 MINIMUM FLOOR AREA:
One Story: 800 Square Feet
Two Story: 1,200 Square Feet
The original Woodbridge RPUD Ordinance was later amended in a strike-through and underline format. On April
19, 1990, the amendments were adopted in Ordinance Number 90-028, the Monterey RPUD. Section 2.04.05 of
Ordinance Number 90-025 was inadvertently changed from “minimum” floor area to “maximum” floor area, as
shown below:
2.04.05 MAXIMUM FLOOR AREA:
One Story: 800 square feet
Two Story: 1200 square feet
Amendments to Ordinances such as this are depicted in a “strike-through and underline” format. While the
language in Ordinance 90-025 was changed, it was not depicted in the proper strike -through and underline format,
indicating the revision was unintended and in error.
The purpose of this Scrivener’s Error to Ordinance Number 90-028 is to correct this error to be consistent with the
existing single-family homes and allow for a building addition to a single-family residence.
FISCAL IMPACT: It should be noted that this amendment is only to correct an inadvertent change to Section
2.04.05 of Ordinance Number 90-025. Therefore, this change by and of itself will have no fiscal impact on the
County.
GROWTH MANAGEMENT IMPACT: The original petition was reviewed for consistency and was found to be
consistent with all the applicable provisions of the Growth Management Plan. This Scrivener’s Error is only to
revise Section 2.04.05 of Ordinance Number 90-025 for consistency with the BCC-approved Section 2.04.05 of
Ordinance Number 85-25.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and it requires a majority vote for
approval. (HFAC)
RECOMMENDATION: To adopt the proposed ordinance to correct the Scrivener’s Error in Ordinance Number
90-025.

COMMISSIONERS AMENDING ORDINANCE NO. 85-25
AS AMENDED BY ORDINANCE NO. 90-28, THE
MONTEREY PLANNED UNIT DEVELOPMENT (PUD), TO
CORRECT A SCRIVENER’S ERROR IN SECTION 2.04.05
OF THE PUD DOCUMENT RELATING TO FLOOR AREA;
AND PROVIDING FOR AN EFFECTIVE DATE. THE
SUBJECT 194.03± ACRE PUD IS LOCATED SOUTH OF
VANDERILT BEACH ROAD AND NORTH OF ORANGE
BLOSSOM DRIVE APPROXIMATELY 900 FEET EAST OF
GOODLETTE-FRANK ROAD IN SECTION 2, TOWNSHIP
49 SOUTH, RANGE 26 EAST, COLLIER COUNTY,
FLORIDA.
WHEREAS, on June 4, 1985, the Board of County Commissioners adopted Ordinance
No. 85-25 which created the Woodbridge Planned Unit Development (PUD); and
WHEREAS, on April 10, 1990, the Board of County Commissioners adopted Ordinance
No. 90-28, changing the name of the PUD from Woodbridge PUD to Monterey PUD; and
inadvertently changing the floor area from “Minimum” to “Maximum” in Section 2.04.05 of the
PUD document; and
WHEREAS, Planning staff has determined that the change to Section 2.04.05 of the PUD
document in Ordinance No. 90-28 constitutes a scrivener’s error.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE: Amendment to Section 2.04.05 of the PUD document attached to
Ordinance No. 90-28 to correct a scrivener’s error
Section 2.04.05 of Ordinance No. 90-28 is hereby amended as follows:
